RESOLUTION NO. 70R-152
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIN GRANTING VARIANCE NO. 2152
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from
Richard B. Walsworth, 1238 W. Collins, Oranqe, Aqent for various owners,
of certain real property situated in the City of Anaheim, County
of Orange, State of California, described as follows:
Beginning at a point in the Westerly line of the Rancho
Santiago de Santa Ana, bearing North 320 42-1/2' East
612.62 feet fram a stake marked S.S.A. 69, as shown on a
map of a portion of the Travis Tract recorded in Book 2,
page 8, Miscellaneous Maps, records of said Orange
County; thence North 320 42-1/2' East 706.38 feet along
said Rancho line to Station 68; thence North 280 38-3/4'
East 163.80 feet along said Rancho line to a point bearing
North 890 45-1/2' West 1144.56 feet from the Northeast
corner of Lot five (5) of the Travis Tract, as shown on
a map recorded in Book 5, page 120, Miscellaneous Records
of Los Angeles County, California, thence South 890 45-1/2'
East 247.68 feet to a point, said point being the point of
beginning of the property herein described; running thence
South from said point of beginning 00 10-1/2' West 1070.2
feet parallel to the East line of said Lot five (5) to a
point 11 feet North of the South line of said Lot five (5);
thence South 890 45-1/2' East 407.02 feet to a point in
the West line of the East 12.16 acres of said Lot five (5);
thence North 00 10-1/2' East along the West line of said
East 12.16 acres 10.70.2 feet to a point in the North line
of said Lot five (5); thence North 890 45-1/2' West, 407.02
feet to the point of beginning.
EXCEPT THEREFROM that portion lying Southerly and Easterly
of the Westerly line of the land described in deed to the
State of California recorded April 20, 1967 in Book 8229,
page 953, Official Records.
fu~D WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
peti tion on March 5, 1970 , notice of which said public
hearing was duly given as required by law and the provisions of
Title 18, Chapter 18.76 of the Anaheim Municipal Code: and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. PC 70-31
approvinq Variance No. 2152 subject to conditions

WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action taken by
the City Planning Commission in approving said variance and
did set a public hearing thereon to be held on the 31st day
of March , 19 70 , at 1:30 o'clock P.M. in the City
Hall in the City of Anaheim and notice of such public hearing
was duly given as required by law and the Provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code: and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the preser-
vation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and
the same is hereby granted permitting the establishment of an
industrial complex with a waiver of the following Anaheim Muni-
cipal Code requirement or limitation, subject to the conditions
hereinafter set forth:
Required structural set-back adjacent to residentially
zoned properties. (Section 18.52.060 (I-a)
That said Variance is granted subject to the following conditions:
1. That this variance is granted subject to the completion
of Reclassification No. 69-70-35, now pending.
2. That trash storage areas shall be provided in accordance
with approved plans on file with the Office of the
Director of Public Works.
3. That fire hydrants shall be installed as required and
determined to be necessary by the Chief of the Fire
Department.
4. That all air-conditioning facilities shall be properly
shielded from view.
5. That subject property shall be served by underground
utilities, subject to review by the Development Services
and utilities Department as to its feasibility or modi-
fication.

That Conditions Nos. 2, 3, 4 and 5, above mentioned,
shall be complied with prior to final building and
czoning in~pections.

That spbJect property shall be developed suDstant1ally
in acc~rdance with p~ans and sgecifigatio~s on file
with the City o~ ~aheim, ~arked Exh1bits Nos. 1, 2, 3
and 4, and Area Development Plah No; 105~ Alternate 6.
The CityCQuncil'-hereby reserves the right to revoke
such variance permit for good cause or failure of said owners, their
successors, heirs or assigns, to comply with the Anaheim Municipal
Code and regulations and the conditions herein. Said variance is
granted for the term prescribed by the Anaheim Municipal Code
unless otherwise specified herein.
