RESOLUTION NO. 70R- 126
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF 4NAHEIM APPROVING THE ANNEXATION
TO THE CtTY OF ANAHEIM OF THE TERRITORY
KNOWN AND DESIGNATED AS ORCHARD - ORANGE-
THORPE ANNEXATION.
WHEREAS, the City of Anaheim did on the 6th day of
August, 1969, subm~t to the Local Agency Formation Commission
proof of written c~nsent signed by all of the owners of the
land within the te*ritory proposed to be annexed to the City
of Anaheim; and
WHEREAS, said Local Agency Formation Commission
authorized the City of Anaheim to annex said territory with-
out notice and hearing and without an election pursuant to
the authority vested in said Commission by Section 54797.1
of the Government Code; and
WHEREAS. said territory proposed to be annexed to
said City of Anaheim is situated in the County of Orange, State
of California, and is contiguous to the City of Anaheim, and
is uninhabited ter~itory. That said petition contained a des-
cription of said territory in words and figures as hereinafter
in this resolution described; and
WHEREAS, I the City Council of the City of Anaheim is
authorized to approve said annexation by resolution without
notice and hearing pursuant to the approval of said Local Agency
Formation Commission and Section 54797.1 of the Government Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Anaheim finds:
That the City of Anaheim did on the 6th day of August
1969, submit to the Local Agency Formation Commission proof of
written consent signed by all of the owners of the land within
the territory proposed to be annexed to the City of Anaheim.
That said territory proposed to be annexed to said City of Anaheim
is situated in the County of Orange, State of California, and is
contiguous to the City of Anaheim, and is uninhabited territory.
That said consent signed by all of the owners of land within
the territory proposed to be annexed contained a description of
said territory in words and figures as hereinafter in this
resolution described.
That the City of Anaheim filed said request to annex
said territory, containing the specific boundaries of the terri-
tory to be annexed, with the Local Agency Formation Commission
and said Local Agency Formation Commission approved said annexa-
tion request of the City of Anaheim pursuant to Section 54797.1
of the Government Code.
That on the 10th day of September, 1969, the Local
Agency Formation Commission duly adopted Resolution No. 69-138
in which said Commission authorized the City of Anaheim to annex
said territory in accordance with Section 54797.1 of the Govern-
ment Code and further approved such annexation of said territory
without notice or hearing.

That the Local Agency Formation Commission further,
by resolution, authorized the City Council of the City of Anaheim
to annex said territory without notice or hearing by the City
Council and without the requirement that an election be held
by the City on the question of said Annexation.

That parcel of land located in the County of Orange,
State of California, described as follows:
Beginning at a point in the existing City limit line
of the City of Anaheim, established as the Northeast
corner of the Warner-Lambert Annexation to the City of
Anaheim, passed by Ordinance No. 2427, October 3, 1967,
filed with the Secretary of State November 9, 1967, and
recorded November 14, 1967 in Official Records of Orange
County, California, said Northeast corner and point of
beginning being distant from the centerline intersection
of Orangethorpe Avenue and Orchard Way (formerly known
as Orchard Drive) the following courses and distances:
South 30 26' 00" West 75.84 feet, North 780 00 I 36"
West 20.22 feet, said centerline intersection is shown
on a Map of Tract No. 4181, recorded in Book 156, pages
21, 22 and 23 of Miscellaneous Maps, records of Orange
County, California; thence
North 780 00' 36" West 1,278.45 feet, following
along the existing City limit line of the City of Anaheim,
said City limit line being a portion of the Southerly
right of way line of the Atchison, Topeka and Santa Fe
Railroad, as said right of way line is shown on a Re-
cord of Survey Map filed in Book 37, page 25 of Record
of Surveys in the office of the County Recorder of Orange
County, California, to an intersection with the South-
erly prolongation of the Easterly line of Tract No. 4926,
as shown on a Map recorded in Book 179, pages 13 and 14
of Miscellaneous Maps, records of Orange County, Cali-
fornia; thence
Leaving the existing City limit line of the City
of Anaheim and following along said Southerly prolonga-
tion and the Easterly line of said Tract No. 4926,

corner of said Tract, said Northeast corner of Tract No. 4926
also being a point in the existing City limit line of the
City of Anaheim as established by the Orchard Drive Annexa-
tion to the City of Anaheim passed by Ordinance No. 2595,
November 6, 1968, filed with the Secretary of State December
9, 1968 and recorded December ll, 1968, 1n Official Records
of Orange County, California; thence
Following along a portion of the existing City limit
line of the City of Anaheim, as established by said Orchard
Drive Annexation the following courses and distances: South
8lo 23' 30" East 594.50 feet, South 77030' 00" East 20.00
feet, North llo 55' 00" East 20.00 feet to the Southwest
corner of the Esperanza High School Annexation to the City
of Anaheim, passed by Orange County Board of Supervisors by
Resolution No. 67-372 April 12, 1967, filed with the Secre-
tary of State May 5, 1967, said Southwest corner being dis-
tant from the centerline intersection of Orchard Drive with
the East West Orchard Drive, now known as Woodwind Lane, as
said intersection is shown on a Map of Survey filed in Book
7, page l2 of Record of Surveys in the office of the County
Recorder of Orange County, California, the following courses
and distances: South 770 30' 00" East 20.00 feet, North llo
55' 00" East 20.00 feet; thence
South 770 30' 00" East 244 feet, more or less, leaving
the existing City Limit line of the City of Anaheim as estab-
lished by said Orchard Drive Annexation, and following a por-
tion of the existing City limit line of the City of Anaheim,
being the Southerly line of the aforementioned Esperanza High
School Annexation to the City of Anaheim, to the Southeast
corner thereof, the Southeast corner of said Esperanza High
School Annexation being a point in the existing City limit
line of the City of Anaheim, as established by the Yorba
Annexation to the City of Anaheim, passed by Ordinance No.
1777, November 13, 1962, filed with the Secretary of State
August lO, 1964 and recorded August 13, 1964 in Official
Records of Orange County, California; thence

Annexation the following courses and distances: South 790

West 20.00 feet, more or less, South 830 ll' 38" East 20.00
feet, more or less, to the Northwest corner of Lot 1 of
Tract No. 4l81, as shown on a Map recorded in Book l56, pages
2l, 22 and 23 of Miscellaneous Maps, records of Orange County,
California; said Northwest corner of Lot 1 of said Tract 4181
being a point in a line parallel with and 40 feet Easterly of
the centerline of Orchard Way, formerly known as Orchard
Drive, as said centerline is shown on the Map of said Tract
No. 4l8l; thence
South 30 26' 00" West l030 feet, more or less, along a
portion of the existing City limit line of the City of Anaheim,
established by said Yorba Annexation, being the last mentioned
parallel line, also being the Westerly line of said Lot 1 and
the Southerly prolongation thereof, and the Westerly line of
Lots 80 through 89, and Westerly line of Lot l30 of said
Tract No. 4181, to a point, said point being the beginning
of a tangent curve concave Northeasterly and having a radius
of 27 feet, as shown on the Map of said Tract 4l8l; thence
South 30 26' 00" West l70 feet, more or less, leaving the
last mentioned existing City limit line of the City of Anaheim,
following along the Southerly prolongation of the Westerly
line of Lot l30 of said Tract No. 4l8l, to an intersection
with the Southerly right of way line of the Atchison, Topeka
and Santa Fe Railway, as said right of way line is shown on
a Map of Survey filed in Book 6, page 23' of Record of Surveys
in the office of the County Recorder of Orange County, Cali-
fornia; thence
North 780 00' 36" West 60.67 feet along the Southerly
right of way line of said Atchison, Topeka and Santa Fe Rail-
way to the point of beginning.

is hereby approved .nd said territory is hereby annexed to
and incorporated in the City of Anaheim, County of Orange,
State of California, and is hereby designated as the
ORCHARD - O~GETHORPE
ANNEXATION to the City of Anaheim.
BE IT FURTHER RESOLVED that from and after the date
of the adoption of this resolution and the filing of a certi-
fied copy thereof with the Secretary of State of the State
of California, the .nnexation of the territory herein described
shall be deemed to be and shall be complete and thenceforth
such annexed territ~ry shall be, to all intents and purposes,
a part of the City ~f Anaheim, and from and after the effective
date of such annexation, all property therein shall be subject
to taxation equally with the property within the City of Anaheim
and shall be taxed to pay its proportionate share of the existing
indebtedness and liability of said City of Anaheim contracted
prior to or existing at the time of such annexation pursuant
to the written consent of the owners of property in said annexed
territory filed with the Clerk of the City of Anaheim prior
to the adoption of this resolution.
