A RESOLUTION ,OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM A:ARDING A CONTRACT FOR THE CENTER
STREET PARKI G STRUCTURE, 235 EAST CENTER
STREET, IN T E CITY OF ANAHEIM, ACCOUNT NO.
82-362-6325. .
WHEREAS, the iCity Council of the City of Anaheim did
cause to be published in a newspaper of general circulation,
printed, published and1circulated in the City of Anaheim, to wit:
The Anaheim Bulletin, ~n the 23rd and 30th days of June, 1983, a
notice inviting sealed iproposals for furnishing the following:
All plant, labor, . services, mater ials and equipment,
and all utilities [and transportation, including power,
fuel and water, aqd performing all work necessary to
construct and com~lete in a good and workmanlike
manner, in strict laccordance with the specifications,
plans and drawing~ therefor on file in the Office of
the City Engineer lor City Clerk of the City of Anaheim,
the following pub~ic improvement, to wit:
Center Street Par~ing Structure, 235 East Center
Street, in the Ci~y of Anaheim consisting of furnishing
all labor and mat~rials necessary for the construction
of a parking struqture. The work includes, but is not
limited to, sitewqrk including landscaping and
irrigation, post-~ensioned concrete structure,
electrical, mecha~ical' masonry and metal work. All
work shall be performed in strict accordance with all
local codes and plans and specifications for this
project which are bn file in the office of the City
Engineer, Account No. 82-362-6325,
in accordance with the ~esign, plans, profiles and specifications
of said public improvement on file in the Office of the City Clerk
of the Ci ty of Anahe imi' and

WHEREAS, said! notice inviting sealed proposals for said
public improvement did provide that sealed proposals would be
received by the City of: Anaheim at the Office of the City Clerk of
the City of Anaheim up ~o the hour of 2:00 o'clock P.M. on the 21st
day of July, 1983, for ~he furnishing of all plant, labor,
services, mater ials and! equipment, all utili ties and
transportation, includi~g power, fuel and water, and performing all
work necessary to const~uct and complete in a good and workmanlike
manner, the public impr~vement hereinabove more particularly
mentioned and described!, and which notice did state and declare
that pursuant to the prbvisions of Section 1770 of the Labor Code,
the City Council of the City of Anaheim had ascertained the
prevailing rate of wage~ in the locality in which this type of
labor is to be performe~ for each craft or type of workman or
mechanic needed to execute the contract, and which wage scale is on
file in the offices of the City Clerk and City Engineer: and

WHEREAS, the City Clerk of the City of Anaheim did receive
the fOllowing sealed ptoposals prior to 2:00 o'clock P.M. on the 21st
day of July, 1983, in tesponse to the notice aforesaid inviting sealed
proposals, to wit: .

AND WHEREAS, ithe City Engineer did thereupon examine and
tabulate said sealed p~oposals and did report to the City Council the
result of his examinat~on and tabulation: and
WHEREAS, the :City Council finds that the sealed proposal
submitted by RAY WILSO~, 4660 Colorado Blvd., Los Angeles, California
90039, , is the lowest [responsible proposal submitted for the furnish-
ing of all plant, labo~, services, materials and equipment, all
utilities and transpor~ation, including power, fuel and water and per-
form ing all work nece~sary to construct and complete in a good and
workmanlike manner, in 'strict accordance with the specifications,
plans and drawings the~efor on file in the Office of the City Clerk of
the City of Anaheim, t~e public improvement hereinabove mentioned and
described, together wi~h the appurtenances thereto, and as specified
in the notice inviting Isealed proposals, and that said proposal of
said above-named bidder should be accepted and a contract awarded to
said bidder in accordance therewith: and
WHEREAS, the ~ity Council finds that the above-mentioned
sealed proposal is the Ilowest responsible proposal received and that
the person, firm or cor~oration submitting said proposal is a respon-
sible person, firm or c!orporation and that the proposal submi tted is
the best suited and fi~ted for the public improvement to be
constructed.
NOW, THEREFO~, BE IT RESOLVED by the City Council of the
City of Anaheim that thle sealed proposal submitted by said contractor
for the furnishing of a[l plant, labor, services, materials and equip-
ment, all utilities an~ transportation, including power, fuel and
water, and performing a~l work necessary to construct and complete, in
a good and workmanlike ~anner, in strict accordance with the specifi-
cations, plans and drawlings therefor on file in the Office of the City
Clerk of the City of An~heim and the notice inviting sealed proposals,
the public works and improvement hereinabove more particularly men-
tioned and described, tpgether with the appurtenances thereto, be, and
the same is hereby, acc~pted, and that a contract for the construction
and completion of said public improvement be, and the same is hereby,
awarded to the said above-named bidder.

AND BE IT FU!THER RESOLVED that the successful bidder or
bidders upon each cont~act awarded as hereinabove set forth, shall
be, and they are hereby required to execute a contract in the
required form with the City of Anaheim upon the terms and
conditions specified i$ the notice inviting sealed proposals and
the proposal submitted:by said successful bidder or bidders and in
accordance with the pl~ns and specifications for said public
improvement hereinabov$ described, and in accordance with the
terms, conditions and provisions of this resolution, and that said
successful bidder or bidders to whom each contract is awarded shall
be required to furnish a surety bond in an amount equal to one
hundred percent (100%) of the contract price for all labor,
materials and equipment to be furnished and performed, as set forth
in the sealed proposal 'submitted by said bidder for the
construction of said p~blic improvement, together with the
appurtenances thereto qr such portion thereof as is covered by said
contract, as security ~or the faithful performance of said
contract, and a separa~e surety bond in an amount equal to one
hundred percent (100%) i of the construction cost of said public
improvement covered by [said contract, as security for the payment
of all persons performtng labor and furnishing material for said
project.
AND BE IT FU1THER RESOLVED that said successful bidder
bidders be, and they a e hereby, required to furnish to the City
Anaheim in companies s tisfactory to the City of Anaheim, public
liability, property da age, compensation, and other insurance in
the amounts and for th~ purposes set forth and specified in the
notice inviting sealed [proposals, and subject to the approval of
the City Attorney as tq form and sufficiency.

AND BE IT FU~THER RESOLVED that the Mayor and the City
Clerk of the City of AQaheim be, and they are hereby, authorized
and directed to make, ~xecute and enter into, for and on behalf of
the City of Anaheim, a Iwritten contract with said successful bidder
or bidders for the furnishing of all plant, labor, materials, and
equipment and performi~g all work, as hereinabove more particularly
described, for the con~truction, installation and completion of
said public improvement hereinabove described upon the terms and
conditions as specifieq in the notice inviting sealed proposals,
the detailed design, p~ans, profiles, drawings and general
specifications and det~iled specifications and drawings, and all
addenda thereto, and a~l modifications incorporated therein prior
to the date of the ope~ing of bids, on file in the Office of the
City Clerk of the City of Anaheim and in strict accordance with the
terms, conditions and ~rovisions of this resolution, and in accord-
ance with all of the contract documents herein specified.
