RESOLUTION NO. 83R- 418
A RESOLUTION OF APPLICATION OF THE CITY COUNCIL
OF THE CITY OF ANAHEIM INITIATING A PROPOSAL
FOR A MUNICIPAL REORGANIZATION DESIGNATED AS
REORGANIZATION NO. 68 AND APPROVING A NEGATIVE
DECLARATION IN CONJUNCTION THEREWITH.
WHEREAS, the City of Anaheim desires that certain
uninhabited territory currently within the City boundaries of
the City of Fullerton be detached from said City and that said
territory be annexed into the City boundaries of the City of
Anaheim; and
WHEREAS, said City desires to extend the full range
of municipal services to said territory and to integrate
development of said territory with the development of adjacent
property within the City of Anaheim; and
WHEREAS, Section 99(b) of the Revenue and Taxation
Code requires the adoption of a resolution by local agencies
agreeing to the exchange of property tax revenues prior to the
executive officer of the Local Agency Formation Commission
issuing a certificate of filing for a municipal
reorganization; and
WHEREAS, said City desires this resolution to be
deemed a resolution of application proposing a municipal re-
organization pursuant to Sections 35100, 35110 and 35140 of
the Government Code of the State of California.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim as follows:
1. That the within proposal is made pursuant to the
Municipal Organization Act of 1977 as set forth in Title 4,
Division 2, Part 2 of the Government Code of the State of
California.
2. That the nature of the proposed municipal re-
organization is for the detachment of the hereinafter des-
cribed uninhabited territory from the City of Fullerton and
the annexation of said territory into the boundaries of the
City of Anaheim.
3. That said municipal reorganization be, and the
same is hereby, designated as "Reorganization No. 68" and the
boundaries of said affected territory are as follows:
That certain parcel of land located in the City of
Fullerton, County of Orange, State of California, more parti-
cularly described as follows:

Beginning at an angle point in the existing boundary
line of the City of Anaheim, said angle point being the inter-
section of the centerline of Raleigh Street with said existing
boundary line of the City of Anaheim; thence Northerly along
said existing boundary line of the City of Anaheim per "Miles
Rancho Annexation", 35.00 feet; thence S 800 06' 00" E, 196.14
feet to a point in the existing boundary line of the City of
Anaheim as established by "South Spadra Annexation" thence
along said existing boundary line of the City of Anaheim per
"South Spadra Annexation", per "Miles Rancho Annexation", in a
Westerly direction to the point of beginning.
The above described parcel of land contain .063
acres, more or less.
A map showing the aforesaid boundaries and designated
"Reorganization No. 68" is submitted concurrently with and
accompanies this Resolution.
4. That the reasons for the proposed municipal re-
organization is to integrate development of said affected
territory with the development of adjacent property within the
City of Anaheim.
5. That the City of Anaheim is hereby designated as
the chief petitioner with regard to this application and the
mailing address of said petitioner is as follows:

6. That the City of Anaheim does hereby request that
proceedings be taken and commenced for a municipal reorgani-
zation in connection with the hereinabove described territory
pursuant to the provisions of said Municipal Organization Act
of 1977.
7. That the tax revenues subject to negotiations
accruing to the City of Fullerton for that territory within
the jurisdiction of the City of Fullerton shall be allocated
in total to the City of Anaheim in accordance with the
historical allocation of such funds within the City of
Anaheim, as determined by the County Auditor.
BE IT FURTHER RESOLVED that a plan for providing
services within the affected territory of said municipal re-
organization is submitted to the Local Agency Formation
Commission with this resolution pursuant to the requirement of
Section 35102 of the Government Code.
BE IT FURTHER RESOLVED that the City Clerk is hereby
directed to file a certified copy of this resolution with the
Executive Officer of the Local Agency Formation Commission.

BE IT FURTHER RESOLVED that the City Council hereby
approves a negative declaration for the aforesaid project pur-
suant to the provisions of the California Environmental
Quality Act upon finding that the City Council has considered
the proposed negative declaration together with any comments
received during the public review process and further finding
on the basis of the initial study and any comments received
that there is no substantial evidence that the project will
have a significant effect upon the environment.
THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this 25th day of October, 1983.
