A RESOIfUTION OF THE CITY COUNCIL OF THE CITY
OF AN~IM GRANTING VARIANCE NO. 2143.
WHERE~, the City Planning Commission of the City of
Anaheim did rece' e a petition for zoning variance from Albert
S. Toussau, 6672 ichfield Rd., Anaheim, owner and Apollo Develop-
ment, agent, of ~rtain real property situated in the City of
Anaheim, County qt Orange, State of California, described as
follows:

quarter of ~e Northwest quarter of Section 24, Town-
ship 4 South! Range 10 West, in the Rancho San Juan
Cajon de San~a Ana, as shown on a Map thereof recorded
in Book 51, page 10 of Miscellaneous Maps, records of
said County, lying Westerly of the fOllowing described

Beginning at a point in the Northerly line of said North-
east quarterf distant Easterly thereon 343.00 feet from

AND WH~AS, the City Planning Commission did hold
a public hearing lat the City Hall in the City of Anaheim upon
said petition on becember 29, 1969, notice of which said public
hearing was duly Siven as required by law and the provisions
of Title 18, Chapiter 18.76 of the Anaheim Municipal Code; and
WHEREAS!, said City Planning Commission, after due
inspection, inves~igation and studies made by itself and in
its behalf, and a!ter due consideration of all evidence and
reports offered at said hearing, did adopt Resolution No.
PC69-258, approvi~g Variance No. 2143, subject to the conditions
therein set fortht and
WHEREAS.. thereafter, within twenty-two (22) days from
the date of the a~option of said resolution, the City Council
did elect, upon its own motion, to review the action taken by
the City Planning.Conmission in approving said variance and
did set a public ijearing thereon to be held on the 20th day
of January, 1970, at 1:30otclock P.M. in the City Hall in the
City of Anaheim ~d notice of such public hearing was duly given
as required by la~ and the Provisions of Title 18, Chapter 18.76
of the Anaheim Mwiicipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its ~ehalf, and after due consideration of all the
evidence and repo~ts offered at said hearing, the City Council
does find and detelrmine that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved, or to the intended use of the property
that do hot apply generally to the property or
class of use in the same vicinity and zone.
2. That su,* a variance is necessary for the preser-
vation ~d enjoyment of a substantial property
right po$sessed by other property in the same
vicinity and zone and denied to the property in
question.
3. That the. granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THE~FORE, BE IT RESOLVED by the City Council of
the City of AnaheiIQ that a conditional zoning variance be, and
the same is hereby !granted permitting the establishment of a
220-unit apartment Complex upon the property hereinbefore des-
cribed with waivers of the following Anaheim Municipal Code
requirements and subject to the conditions hereinafter set forth:
1. Maximum ~rmitted number of main buildings per site,
Section 18.28.020(1); and
2. Minimum d~stance between bUildings, Section
l8.28.050(7-a) .

That this varianc~ is granted subject to the following conditions:
1. That th~s Variance is granted subject to the completion
of Recl~ssification No. 69-70-29, now pending.
2. That s~ject property shall be developed substantially
in accotdance with plans and specifications on file
with th~ City of Anaheim, marked Exhibits Nos. 1,
2, 3 , 4 , 5, and 6.
The City. Council hereby reserves the right to revoke
such variance per~t for good cause or failure of said owner,
his heirs, succes!ors or assigns to comply with the Anaheim
Municipal Code an regula tions and the condi tions herein. Said
variance is grant d for the term prescribed by the Anaheim Municipal
Code unless othedlise specified herein. .
THE FO~GOING RESOLUTION is approved and signed by
