RESOLUTION NO. 69R- 619
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE ~~YO~ AND CITY CLEP~ TO EXECUTE AN
AGREEMENT WITH RAYMOND G. SPEHAR, ESTELLE
K. SPEHAR AND ~~RCIA. ANN HALLIGAN, AND
ACCEPTING A GR&~T DEED AND AN EASEMENT
DEED TO CERTAIN PARCELS OF REAL PROPERTY.
WHEREAS, Ra)~ond G. Spehar, Estelle K. Spehar and
Marcia Ann Halligan own property located at the southeast
corner of the intersection of Esperanza Road and Imperial
Highway in the City of Anaheim, and
I~EREAS, said individuals hereinafter referred to
as "owners" desire to develop said parcel of property; and
vlliEREAS, City owns water rights and a right of sur-
face entry for the purpose of drilling water wells and ex-
tracting said water from the underground basin on said parcel
of property; and
WHEREAS, the parties hereto desire to exchange cer-
tain rights so that the owners can develop their property and
City can better drill, oyerate and maintain water wells to
support its water system; and
vmEP~AS, the City Council of the City of Anaheim
finds that it is for the benefit and best interest of the City
of Anaheim to exchange said interest in real property.

of the City of Anaheim that it approve~the terms and condi-
tions of the agreement beh7een the City of Anaheim and Raymond
G. Spehar, Estelle K. Spehar and Marcia Ann Halligan, dated
on the 25th dav of November , 1969.
BE IT FURTHER RESOLVED that the Mavor and City
Clerk are hereby authorized to execute said agreement on behalf
of the City of Anaheim.
BE IT FURTHER RESOLVED that the City of Anaheim
hereby accepts a conveyance of fee simple absolute title in
the following described parcel of land~
All that certain real property situated in the City of
Anaheim, County of Orange, State of California, described
as:
That portion of allotments in Decree of Partition of the
Rancho Canon de Santa Ana in the County of Orange, State
of California, rendered in Case No. 1978 of the 17th
Judicial District Court of California, a certified copy
of which was recorded February 8, 1874, in Book 28, page
158 of Deeds in the office of the County Recorder of Los
An~eles County, California, described as follows~

Beginning at the northeasterly corner of the land described
in the deed to the State of California recorded October lO,
1956 in Book 3693, pages 374 of Official Records; thence
along the easterly and southerly lines of said land the
following courses; South 50 37' 27" West 322.42 feet and
North 880 37' 00" West 15.00 feet to a point in the easterly
line of the land described in the deed to the State of
California, recorded October 14, 1952 in Book 2395, page
522 of Official Records; thence South 10 23' 00" West 420.00
feet along last mentioned easterly line; thence South 880
37' 00" East 690.00 feet; thence South 10 23' 00" rJest
352.03 feet to a point in a non-tangent curve concave north-
erly, a radial line through a point bears South 120 32' OS"
West and having a radius of 1400.00 feet; thence southeast-

line, a radial line through said point bears South 50 37'

BE IT FURTHER RESOLVED that the City of Anaheim here-
by accept the conveyance of an easement for utility purposes

PARCEL ONE: A.n easement for public utility purposes over,
under and across that portion of allotments in Decree of
Partition of the Rancho Canon de Santa Ana in the County of
Orange, State of California, rendered in Case No. 1978 of
the 17th Judicial District Court of California, a certified
copy of which was recorded February 8, 1874 in Book 28,
page 158 of Deeds, in the office of the County Recorder of
Los Angeles County, California, lying l2 feet Westerly of
the fallowing described line; Comm~ncing at the nor~h~asterly
corner of the land described in the deed to the State of
California, recorded October 30, 1956 in Book 3693, page
374 of Official Records; thence along the southerly line of
a strip of land 100.00 feet wide, as described in a deed to
the Riverside, Santa Ana and Los Angeles Railway Company,
recorded July 7: 1886 in Book 164, page 508 of Deeds, records
of said Los Angeles County, the following courses: North 880
31' 4111 East 787.52 feet to the beginning of a tangent curve
concave northerly and having a radius of 5779.65 feet; thence

beginning, said true point of beginning hereinafter referred

cribed in the deed to Orange County Flood Control District
recorded February 6, 1939 in Book 980, page 303 of Official
Records of Orange County, California, the above mentioned
point of intersection is for the purpose of this description
the point of terminus of the line herein described.
PARCEL TWO: An easement for public utility purposes over,
under and acrQss that portion of allotments in Decree of
Partition of the Rancho Canon de Santa Ana in the County of
Orange, State of California, rendered in Case No. 1978 of
the 17th Judicial District Court of California, a certified
copy of which was recorded February 8, 1874 in Book 28, page
158 of Deeds in the office of the County Recorder of Los
Angeles County, California, lying 12 feet Southerly of the
following described centerline:
Beginning at Point A as designated in Parcel One above
described, said point of beginning being at the beginning
of a curve concave northwesterly and having a radius of
5,779.65 feet; thence Easterly and Northeasterly along
said curve an arc distance of 450 feet to the point of
terminus of the line herein described.
BE IT FU~THER RESOLVED that the Mayor and City Clerk
are hereby authori~ed to execute on behalf of the City a Quit-
claim Deed to the City's right of surface entry over the following
described parcel of property:

Beginnig at the Northeasterly corner of the land described
in the deed to the State of California recorded October 30,
1956, in Book 3693, page 374 of Official Records of Orange
County, California; thence along the easterly line of the
land conveyed to the State of California, the following
courses and distances: South 50 37' 27" West 322.42 feet,
North 880 37' 00" West 15.00 feet, to a point in the
easterly line of the land described in the deed to the State
of California recorded October 14, 1952, in Book 2395, page
522 of Official Records of said Orange County, California;
thence following along the easterly line of said land of
the State of California, South 010 23' 00" West 664.09 feet,

corner of the land described as Young and Blanchard, hereby
grant to Dominguez in a boundary line agreement and grant
deed recorded in Book 6983, page 893 of Official Records

described in a deed to Orange County Flood Control District
recorded Feb~uary 6, 1939, in Book 980, page 303 of Official
Records of said Orange County, California; thence following
along the northerly line of the land of said Orange County
Flood Control District the fQllowing courses and distances:
North 770 24' 08" East 950.35 feet, North 710 58' 03" East
1,373.18 feet to the beginning of a tangent curve concave
northwesterly and having a radius of 1,600.00 feet; thence
northeasterly along a portion of said curve through a
central angle of 180 53' 03" an arc distance of 527.35 feet;
to a point in the easterly line of the land described in a
deed to Young recorded in Book 3206, page 194, records of
Orange County, California; thence leaving the northerly
line of the above described curve, along the last mentioned
easterly line, North 010 30' 56fl East 918.56 feet; and
North 000 28'56" East 81.03 feet to a point in a non-
tangent curve concave Northwesterly having a radius of
5,779.65 feet, a radial line drawn through said point bears
South 200 30' 23" East, said curve being also the southerly
line of the strip of land, 100.00 feet wide, as conveyed
to the Riverside, Santa Ana and Los Angeles Railway Company
by deed recorded July 7, 1886 in Book 164, page 508 of
Deeds, records of Los Angeles County, California, said
100.00 foot strip being now vested in the Atchison, Topeka
and Santa Fe Railway Company, a corporation; thence south-
westerly along said curve and said south line, through a
central angle of 190 02' 04", an arc length of 1920.08 feet;
thence continuing along said south line, South 880 31' 41"
West 787.52 feet, to the point of beginning.
