RESOLUTION NO. 83R-237

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING CONDITIONAL USE PERMIT
NO. 1564.
WHEREAS, Conditional Use Permit No. 1564 to permit an
outdoor recreational center on ML zoned property located at the
southwest corner of Carpenter Avenue and Shepherd Street was
granted by the City Council on October 14, 1975, pursuant to
Resolution No. 75R-534; and
WHEREAS, on March 16, 1982, following a public hearing
to review revised plans, the City Council approved Resolution No.
82R-148 amending Conditional Use Permit No. 1564 to include the
proposed construction of a roller slide, subject to the conditions
that an attendant shall be stationed at the top of the slide at
all times during operation to regulate the use and control the
number of patrons using the facility; and that a qualified
lifeguard shall be in attendance at the pool deck at all times
during operation and shall render aid in case of an accident or
injury; and
WHEREAS, the petitioner has heretofore requested
approval of an additional amendment to Conditional Use Permit No.
1564 to permit an outdoor soccer field in conjunction with the
existing recreational facility; and
WHEREAS, the City Planning Commission has heretofore
recommended approval of said additional use; and
WHEREAS, the City Planning Commission did hold a public
hearing upon said application at the City Hall in the City of
Anaheim, notices of which public hearing were duly given as
required by law and the provisions of Title 18, Chapter 18.03 of
the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to be
heard and did receive evidence and reports; and

WHEREAS, the City Council finds, after careful
consideration of the recommendation of the City Planning
Commission and all evidence and reports offered at said hearing,
that:
1. The proposed use is properly one for which a conditional
use permit is authorized by the Anaheim Municipal Code.
2. The proposed use will not adversely affect the adjoining
land uses and the growth and development of the area in which it
is proposed to be located.
3. The size and shape of the site proposed for the use is
adequate to allow the full development of the proposed use in a
manner not detrimental to the particular area nor to the peace,
health, safety and general welfare.
4. The traffic generated by the proposed use will not
impose an undue burden upon the streets and highways designed and
improved to carry the traffic in the area.
5. The amendment to said conditional use permit under the
conditions imposed will not be detrimental to the peace, health,
safety and general welfare of the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Conditional Use Permit No. l564 as
heretofore approved by Resolution No. 75R-534 and subsequently
amended by Resolution No. 82R-l48 be, and the same is hereby,
further amended to permit and authorize the use of an outdoor
soccer field in conjunction with the heretofore approved uses,
subject to the following conditions:
1. That subject property shall be developed substantially
in accordance with plans and specifications on file with the City
of Anaheim marked Exhibit Nos. 1 and 2, including the provision
for a total of l3l parking spaces.
2. That prior to final building and zoning inspection,
Condition No.1, above-mentioned, shall be complied with.
3. That the additional use of an outdoor soccer field in
conjunction with an existing recreational facility is granted for
a period of one year to expire on May 1, 1984.
4. That the additional use authorized by this resolution
shall be subject to review by the City Council, both generally
and with specific regard to the parking situation, during the
month of September, 1983, or at any other time during the
hereinabove authorized term of said use pursuant to Sections
18.03.091 and l8.03.092 of the Anaheim Municipal Code.

BE IT FURTHER RESOLVED that the City Council does hereby
find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the
conditions hereinabove set forth. Should any such conditions, or
any part thereof, be declared invalid or unenforceable by the
final judgment of any court of competent jurisdiction, then this
Resolution, and any approvals herein contained, shall be deemed
null and void.
