RESOLUTION NO. 83R-217
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING CONDITIONS OF APPROVAL OF
CONDITIONAL USE PERMIT NO. 2405 AS SET FORTH
IN RESOLUTION NO. 83R-ll3, NUNC PRO TUNC.
WHEREAS, the City Council heretofore adopted its
Resolution No. 83R-ll3 granting Conditional Use Permit No. 2405 on
March 22, 1983; and
WHEREAS, said resolution contained ten express condi-
tions upon which said conditional use permit was granted; and
WHEREAS, through clerical error, certain of said condi-
tions as set forth on said resolution failed to correctly reflect
the action aqd intention of the City Council in granting said con-
ditional use permit.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Conditional Use Permit No. 2405 as set
forth in Resolution No. 83R-113 be, and the same is hereby,
amended by amending and restating, in their entirety, nunc pro
tunc, the conditions of approval as set forth therein to read as
follows:
"1. That all engineering requirements of the City of
Anaheim, along Lincoln Avenue including preparation of improvement
plans and installation of all improvements such as curbs and gut-
ters, sidewalks, street grading and paving, drainage facilities,
or other appurtenant work shall be complied with as required by
the City Engineer and in accordance with specifications on file in
the Office of the City Engineer; that street lighting facilities
along Lincoln Avenue shall be installed as required by the Office
of Utilities General Manager, and in accordance with specifica-
tions on file in the Office of Utilities General Manager; and/or
that security in the form of a bond, certificate of deposit, let-
ter of credit or cash, in an amount and form satisfactory to the
City of Anaheim shall be posted with the City to guarantee the
satisfactory installation of the above-mentioned improvements.
Said security shall be posted with the City prior to approval of
improvement plans. The above-required improvements shall be in-
stalled prior to commencing the activity authorized by this zoning
action.
2. That trash storage areas shall be provided in accordance
with approved plans on file with the Office of the Executive
Director of Public Works.
3. That the owner(s) of subject property shall pay the
traffic signal assessment fee (Ordinance No. 3896), in an amount
as determined by the City Council, for commercial buildings.
4. That appropriate water assessment fees as determined by
the Office of Utilities General Manager shall be paid to the City
of Anaheim.
5. That subject property shall be developed substantially
in accordance with plans and specifications on file with the City
of Anaheim marked Exhibit No. 1 (Revision No.1) .
6. That all proposed vehicular parking areas shall be
improved with asphalt paving, wheel stops, and striping to City
specifications and standards.
7. That the existing structure shall be brought up to the
minimum standards of the City of Anaheim, including the Uniform
Building, Plumbing, Electrical, Housing, Mechanical and Fire Codes
as adopted by the City of Anaheim.
8. That Condition Nos. 2, 6 and 7, above-mentioned, shall
be completed prior to the commencement of the activity authorized
by this conditional use permit.
~. That Condition Nos. l, 3 and 4 above shall be complied
with on or before June 30 , 1988, or prior to the issu-
ance of a building qr occupancy permit for any new use of the
property, whichever occurs first.
10. That the owner(s) of the property shall execute and
record a cQvenant upon the property, in a form approved by the
City Attorney's Office, agreeing to the obligations set forth in
Condition No. 9 above prior to the commencement of the activity
authorized by this conditional use permit."
BE IT FURTHER RESOLVED that, except as expressly set
forth herein, Resolution No. 83R-l13 shall remain in full force
and effect.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 31st day of May, 1983.
