A RESOLU~ION OF THE CITY COUNCIL OF THE CITY
OF ANAHE~M AWARDING A CONTRACT FOR THE HARBOR
CENTER P~RKING LOT W/S HARBOR BOULEVARD, S/O
BROADWAY~ IN THE CITY OF ANAHEIM, ACCOUNT
NO. 89-3Q2-6327.
WHEREAS, !the City Council of the City of Anaheim did
cause to be publis~ed in a newspaper of general circulation,
printed, published land circulated in the City of Anaheim, to wit:
The Anaheim Bullet~n, on the 10th and 17th days of March, 1983, a
notice inviting se~led proposals for furnishing the following:
All plant, la~or, services, materials and equipment,
and all utili~ies and transportation, including power,
fuel and wate~, and performing all work necessary to
construct and 'complete in a good and workmanlike
manner, in st~ict accordance with the specifications,
plans and draWings therefor on file in the Office of
the City Engirleer or City Clerk of the City of Anaheim,
the following ~public improvement, to wit:
Harbor Center iParking Lot, W/s Harbor Boulevard, S/o
Broadway, in ~he City of Anaheim, consisting of the
construction qf asphalt concrete pavement, PCC side-
walk, curb, g4tter and drainage improvements and
concrete bloc~ wall, steel and wood fence; the
installation of landscape planting, irrigation system,
and lighting ~mprovements; the removal of asphalt
concrete pavement, PCC sidewalk, curb, gutter, block
wall foundatidn, utility boxes, C.L. fencing; and all
appurtenant wdrk in accordance with the plans and
delineated in the specifications on file in the office
of the City Engineer, Account No. 89-362-6327; and
in accordance with the design, plans, profiles and specifications
of said public impDovement on file in the Office of the City Clerk
of the City of AnaHeim; and

WHEREAS, said notice inviting sealed proposals for said
public improvement did provide that sealed proposals would be
received by the City of Anaheim at the Office of the City Clerk of
the City of Anaheim up to the hour of 2:00 o'clock P.M. on the
7th day of April, 1983, for the furnishing of all plant, labor,
services, material$ and equipment, all utilities and
transportation, inQluding power, fuel and water, and performing all
work necessary to qonstruct and complete in a good and workmanlike
manner, the public improvement hereinabove more particularly
mentioned and described, and which notice did state and declare
that pursuant to the provisions of Section 1770 of the Labor Code,
the City Council of the City of Anaheim had ascertained the
prevailing rate of wages in the locality in which this type of
labor is to be perDormed for each craft or type of workman or
mechanic needed to execute the contract, and which wage scale is on
file in the officea of the City Clerk and City Engineer; and
WHEREAS, the City Clerk of the City of Anaheim did
receive the follow~ng sealed proposals prior to 2:00 o'clock P.M.
on the 7th day of ~pril, 1983, in response to the notice aforesaid
inviting sealed prqposals, to wit:

AND WHER~AS, the City Engineer did thereupon examine and
tabulate said seal~d proposals and did report to the City Council
the result of his ~xamination and tabulation; and
WHEREAS, .the City Council finds that the sealed proposal
submitted by GRIFFETH COMPANY, 2020 Yale, Santa Ana, California
92704, is the lowe~t responsible proposal submitted for the
furnishing of all Hlant, labor, services, materials and equipment,
all utilities and transportation, including power, fuel and water
and performing all work necessary to construct and complete in a
good and workmanli~e manner, in strict accordance with the
specifications, plans and drawings therefor on file in the Office
of the City Clerk qf the City of Anaheim, the public improvement
hereinabove mentio~ed and described, together with the
appurtenances thereto, and as specified in the notice inviting
sealed proposals, qnd that said proposal of said above-named bidder
should be accepted and a contract awarded to said bidder in
accordance therewith; and

WHEREAS, the City Council finds that the above-mentioned
sealed proposal is the lowest responsible proposal received and
that the person, firm or corporation submitting said proposal is a
responsible person, firm or corporation and that the proposal
submitted is the best suited and fitted for the public improvement
to be constructed.

NOW, THE~EFORE, BE IT RESOLVED by the City Council of the
City of Anaheim th~t the sealed proposal submitted by said
contractor for the 'furnishing of all plant, labor, services,
materials and equi~ment, all utilities and transportation,
including power, f4el and water, and performing all work necessary
to construct and cQmplete, in a good and workmanlike manner, in
strict accordance ~ith the specifications, plans and drawings
therefor on file i~ the Office of the City Clerk of the City of
Anaheim and the notice inviting sealed proposals, the public works
and improvement he~einabove more particularly mentioned and
described, together with the appurtenances thereto, be, and the
same is hereby, acqepted, and that a contract for the construction
and completion of ~aid public improvement be, and the same is
hereby, awarded to the said above-named bidder.
AND BE I~ FURTHER RESOLVED that the successful bidder or
bidders upon each ~ontract awarded as hereinabove set forth, shall
be, and they are h~reby required to execute a contract in the
required form with It he City of Anaheim upon the terms and
conditions specifi~d in the notice inviting sealed proposals and
the proposal submi~ted by said successful bidder or bidders and in
accordance with th~ plans and specifications for said public
improvement herein~bove described, and in accordance with the
terms, conditions ~nd provisions of this resolution, and that said
successful bidder Qr bidders to whom each contract is awarded shall
be required to fur~ish a surety bond in an amount equal to one
hundred percent (I~O%) of the contract price for all labor,
materials and equi8ment to be furnished and performed, as set forth
in the sealed propqsal submitted by said bidder for the
construction of saVd public improvement, together with the
appurtenances ther~to or such portion thereof as is covered by said
contract, as secur~ty for the faithful performance of said
contract, and a separate surety bond in an amount equal to one
hundred percent (I~O%) of the construction cost of said public
improvement covered by said contract, as security for the payment
of all persons performing labor and furnishing material for said
project.
AND BE IT FURTHER RESOLVED that said successful bidder or
bidders be, and the~ are hereby, required to furnish to the City of
Anaheim in compani~s satisfactory to the City of Anaheim, public
liability, properti damage, compensation, and other insurance in
the amounts and for the purposes set forth and specified in the
notice inviting se~led proposals, and subject to the approval of
the City Attorney ~s to form and SUfficiency.

AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City ~f Anaheim be, and they are hereby, authorized
and directed to mak~, execute and enter into, for and on behalf of
the City of Anaheim, a written contract with said successful bidder
or bidders for the furnishing of all plant, labor, materials, and
equipment and perfqrming all work, as hereinabove more particularly
described, for the construction, installation and completion of
said public improvement hereinabove described upon the terms and

conditions as specified in the notice inviting sealed proposals,
the detailed design, plans, profiles, drawings and general
specifications and detailed specifications and drawings, and all
addenda thereto, a~d all modifications incorporated therein prior
to the date of the 'opening of bids, on file in the Office of the
City Clerk of the dity of Anaheim and in strict accordance with the
terms, conditions ~nd provisions of this resolution, and in
accordance with all of the contract documents herein specified.
THE FOREQOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 26th day of April, 1983.
