RESOLUTION NO. 83R-53
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING AN EASEMENT FOR ELECTRICAL
PURPOSES LOCATED ON THE WEST SIDE OF BEACH
BOULEVARD, NORTH OF STONYBROOK DRIVE. (82-1A).
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by law;
and
WHEREAS, on the 15th day of February, 1983, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation; and
WHEREAS, the City Council does find, from the evidence
submitted, that the street, highway or public service easement
hereinafter specifically described is unnecessary for present or
prospective public purposes including nonmotorized transportation
facilities.
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not
reserved and excepted by this resolution, the City Council hereby
determines that the public convenience and necessity requires that
no easements be reserved for such facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of that certain
easement for electrical purposes, more specifically described as
follows:
That certain easement as granted by Nicholas
Melchionna and Florence Melchionna to the Southern
California Edison Company for electrical utility
purposes to construct, use, maintain, alter, add
to, repair, replace and/or remove, in and over
that real property situated in the City of
Anaheim, County of Orange, State of California as
recorded in Book 6232, page 259 in the Office of
the County Recorder of said Orange County, an
electric line, consisting of poles, necessary guys
and anchors, cross-arms, wires, and other fixtures
and appliances, for conveying electric energy to
be used for light, heat, power, telephone, and/or
other purposes over the real property described as
follows:
A strip of land 6 feet in width lying within a
portion of Section 14, Township 4 South, Range 11
West, the southerly line of said strip being
described as follows:
Beginning at a point in the westerly line of Beach
Boulevard, as now established, distant northerly
1640 feet from the northerly line of Ball Road, as
now established, thence westerly and parallel with
said northerly line of Ball Road, a distance of
300 feet.
NOTE: Above described easement was acquired by
the City of Anaheim as successors to Southern
California Edison Company.
BE IT FURTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of
Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to ;be recorded in the Office of the Recorder of
the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 15th day of February,
1983.
