A RESOLU~ION OF THE CITY COUNCIL OF THE CITY
OF ANAHE~M GRANTING CONDITIONAL USE PERMIT
NO. 2397.
WHEREAS, ,the Ci ty Planning Commission of the Ci ty of
Anaheim did receiv~ an application for a conditional use permit
from CONTINENTAL P~CIFIC ENTERPRISES, INC., owner, to permit a
hospital and medic~l office complex on certain real property
located in the Cit~ of Anaheim, County of Orange, State of
California, descri~ed as:
PARCELS 1, 2, .3 AND 4, AS PER MAP FILED IN BOOK 120,
PAGES 25 AND ~6 OF PARCEL MAPS IN THE OFFICE OF THE
COUNTY RECORDaR OF SAID COUNTY; and
WHEREAS, ,the City Planning Commission did hold a public
hearing upon said ~pplication at the City Hall in the City of
Anaheim, notices o~ which public hearing were duly given as
required by law an~ the provisions of Title 18, Chapter 18.03 of
the Anaheim Municigal Code; and
WHEREAS, ,said Commission, after due inspection,
investigation and ~tudies made by itself and in its behalf and
after due consider~tion of all evidence and reports offered at
said hearing, did ~dopt its Resolution No. PC82-2l9, granting
Conditional Use Pe~mit No. 2397; and
WHEREAS, thereafter, within the time prescribed by law,
an interested part~ or the City Council, on its own motion,
caused the review qf said Planning Commission action at a duly
noticed public hearing; and
WHEREAS, at the time and place fixed for said public
hearing, the City qouncil did duly hold and conduct such hearing
and did give all p~rsons interested therein an opportunity to be
heard and did rece~ve evidence and reports; and
WHEREAS, the City Council finds, after careful consi-
deration of the redommendations of the City Planning Commission
and all evidence a~d reports offered at said hearing, that:
1. The propqsed use is properly one for which a conditional
use permit is authdrized by the Anaheim Municipal Code.

2. The propqsed use will not adversely affect the adjoin-
ing land uses and ~he growth and development of the area in which
it is proposed to be located.
3. The size and shape of the site proposed for the use is
adequate to allow the full development of the proposed use in a
manner not detrime~tal to the particular area nor to the peace,
health, safety and general welfare.

4. The traffic generated by the proposed use will not
impose an undue burden upon the streets and highways designed and
improved to carry the traffic in the area.

5. The gran~ing of the conditional use permit under the
conditions imposed !will not be detrimental to the peace, health,
safety and general !welfare of the citizens of the City of Anaheim.
NOW, THE~EFORE, BE IT RESOLVED by the City Council of
the City of Anahei~ that the action of the City Planning
Commission grantin~ said conditional use permit be, and the same
is hereby, affirmed and that Conditional Use Permit No. 2397 be,
and the same is he~eby, granted permitting a hospital and medical
office complex on ~he hereinabove described real property, subject
to the following conditions:
1. That priqr to commencement of the use herein approved or
issuance of a buil~ing permit whichever occurs first, the
developer, as owned of the adjacent 2.2 acre parcel (Parcel 4),
shall execute and r~cord a covenant as to Parcel 4, in a form
approved by the Ci~y Attorney's office, agreeing that, prior to
the application fori, or issuance of, any building permits for any
commercial develop~ent on said Parcel 4, the owner of said Parcel
4 shall obtain appr~val from the Planning Commission or City
Council of said commercial development with its associated
vehicular traffic i~pacts, both individual and cumulative.
2. That pri~r to the issuance of building permits, and in
addition to payment of regular traffic signal assessment fees, the
developer shall pay for a traffic signal inner-connection in an
amount of not less than $40,680.
3. That prio!r to final building and zoning inspections, the
developer shall construct a deceleration lane on Nohl Ranch Road,

200 feet long and 1~ feet wide with tire busters at the southern
throat, and that copstruction shall be done in a manner to
preclude left-turns from west bound traffic on Nohl Ranch Road.
4. That the incline of the service vehicle road shall not
exceed 2% per 40 fe~t from the back of the side walk on Anaheim
Hills Road, and tha~ the visibility clearance from both driveways
on Anaheim Hills Ro~d shall be provided for a distance of 120 feet
northerly and 80 feet southerly, 7 feet back from the sidewalk or
crosswalk.
5. That prio!r to final building and zoning inspections, the
handicapped parking spaces shall be provided conforming to the
latest California and Federal Code, with said spaces to be a
minimum of 12 feet wide with not less than 8 feet 2 inches height
clearance, and with 4-foot ramps along the side having access to
the building without wheel chairs transversing or entering the
travel lanes.

6. That trash storage areas shall be provided in accordance
with approved plans on file with the Office of the Executive
Director of Public Works.

7. That fir~ hydrants shall be installed and charged as
required and determined to be necessary by the Chief of the Fire
Department prior tq commencement of structural framing.
8. That subj~ct property shall be served by underground
utilities.
9. That drailnage of subject property shall be disposed of
in a manner satisf~ctory to the City Engineer.
10. That the ~wner(s) of subject property shall pay the
traffic signal asselssment fee (Ordinance No. 3896), in an amount
as determined by t~e City Council, for commercial buildings prior
to the issuance of a building permit.
II. That appr~priate water assessment fees as determined by
the Office of Utili~ies General Manager shall be paid to the City
of Anaheim prior td the issuance of a building permit.
12. That the location and design of all vehicular ingress
and egress driveway~ shall be subject to the review and approval
of the City Traffic~ Engineer prior to the issuance of building
permits.
13. That a pe~estrian access plan shall be submitted by the
developer to the Ci~y Traffic Engineer for review and approval
prior to the issuanpe of building permits.
14. That the design and development of any public street
improvements shall pe subject to review and approval of the City
Engineer prior to the issuance of building permits.
IS. That the pwner(s) of subject property shall obtain from
the City vehicular ~ccess rights to Nohl Ranch Road.
16. That subj~ct property shall be developed substantially
in accordance with plans and specifications on file with the City
of Anaheim marked E~hibit Nos. 1 through ID.

17. That Cond~tion No. 15, above-mentioned, shall be
complied with prior to the commencement of the activity authorized
under this resolutipn, or prior to the time that the building
permit is issued, or within a period of one year from date hereof,
whichever occurs fi~st, or such further time as the Planning
Commission may grant.
18. That Cond~tion Nos. 4, 6, 8, 9, and 16, above-mentioned,
shall be complied with prior to final building and zoning
inspections.

19. Prior to issuance of any building permits for the
project, the developer shall submit satisfactory evidence to the
City that any required certificate of need has been issued for the
hospital.

BE IT FU~THER RESOLVED that the City Council does hereby
find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the
conditions hereinabove set forth. Should any such conditions, or
any part thereof, be declared invalid or unenforceable by the
final judgment of ~ny court of competent jurisdiction, then this
Resolution, and ani approvals herein contained, shall be deemed
null and void.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 25th day of January, 1983.
