84R-009 RESOLUTION NO. 84R -9
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PORTION OF BAXTER STREET
BETWEEN THE CARBON CREEK CHANNEL AND VIA BURTON.
(81 -30A)
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by law;
and
WHEREAS, on the 10th day of January, 1984, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation; and
WHEREAS, the City Council does find, from the evidence
submitted, that the street, highway or public service easement
hereinafter specifically described is unnecessary for present or
prospective public purposes including nonmotorized transportation
facilities.
WHEREAS, the City Council does determine that the
public convenience and necessity require the reservation and
exception of the easement(s) and right(s) of way hereinafter
specifically described.
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not
reserved and excepted by this resolution, the City Council hereby
determines that the public convenience and necessity requires that
no easements be reserved for such facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of that portion
of Baxter Street, north of Via Burton, more specifically described
as follows:
That certain easement tor road and public utility purposes over,
under and across Parcel Two as described in a deed recorded
July 26, 1974 in Book 11205, pages 1868 through 1871, Official
Records of Orange County, located in the City of Anaheim, County
of Orange, State of California, lying within a portion of Parcel
One as shown on a map filed in Book 36, page 7 of Parcel Maps, in
the Office of the County Recorder of said Orange County, described
as follows:
PARCEL TWO: Beginning at a point in a line parallel with and
20.00 feet easterly measured at right angles to the centerline
of Baxter Street N 00 10' 47" E, 30.00 feet and S 89° 05' 58" E,
20.00 feet from the centerline intersection of Via Burton Street
and said Baxter Street, thence N 00° 10' 47" E, 497.57 feet along
said parallel line to a point on the arc of a non - tangent curve
concave westerly and having a radius of 50.00 feet, a radial line
bearing N 23° 45' 28" E passes through said point; thence Southerly,
Southeasterly and Southwesterly along said curve through a central
angle of 103° 17' 31" an arc distance of 90.14 feet to the beginning
of a reverse curve concave easterly and having a radius of 50.0P
feet; thence Southwesterly and Southerly along said curve through
a central angle of 36° 52' 12" an arc distance of 32.18 feet to a
point on a tangent line parallel with and 50.00 feet easterly
measured at right angles to the centerline of said Baxter Street;
thence S 00° 10' 47" W, 367.18 feet along said parallel line to the
beginning of a tangent curve concave northeasterly and having a
radius 25 feet; thence Southerly, Southeasterly and Easterly
along said curve through a central angle of 89° 16' 45" an arc
distance of 38.96 feet to a point on a tangent line; thence
N 89° 05' 58" W, 34.69 feet to the point of beginning.
RESERVING THEREFROM unto the City of Anaheim a public utility
easement for the installation and maintenance of underground and
overhead electric wires, cables, and related electrical facilities
over, under, along and across said Parcel Two, together with all
reasonable rights of ingress and egress.
ALSO RESERVING THEREFROM unto the Pacific Telephone and Telegraph
Company a public utility easement to construct, place, operate,
inspect, maintain, repair, replace and remove such aerial and
underground telephone, telegraph and communication structures, as
the Company may from time to time require, consisting of poles,
anchors, wires, cables, conduits, manholes, markers and necessary
fixtures and appurtenances over said Parcel Two together with all
reasonable rights of ingress and egress. Said reservation to said
Telephone and Telegraph Company is subject to and subordinate to the
rights of the City of Anaheim as reserved above.

BE IT FURTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of
Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the Office of the Recorder of
the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 10th day of January,
1984.
