of said public improv ent on file in the Office of the City Clerk

WHEREAS, sa'd notice inviting sealed proposals for said
public improvement di provide that sealed proposals would be
received by the City f Anaheim at the Office of the City Clerk of
the City of Anaheim u to the hour of 2:00 o'clock P.M. on the 6th
day of December, 1984, for the furnishing of all plant, labor,
services, materials a equipment, all utilities and
transportation, inclu ing power, fuel and water, and performing all
work necessary to con truct and complete in a good and workmanlike
manner, the public i]rovement hereinabove more particularly
mentioned and describ , and which notice did state and declare
that pursuant to the rovisions of Section 1770 of the Labor Code,
the City Council of t e City of Anaheim had ascertained the
prevailing rate of wa~es in the locality in which this type of
labor is to be perfor ed for each craft or type of workman or
mechanic needed to ex cute the contract, and which wage scale is on
file in the offices o. the City Clerk and City Engineer~ and

WHEREAS, th City Council finds that the sealed proposal
submitted by LEONARD UTH AND SONS, INC., 709 E. Sycamore Street,
Anaheim, California 9 805, is the lowest responsible proposal
submitted for the fur ishing of all plant, labor, services,
materials and equipme t, all utilities and transportation,
including power, fuel and water and performing all work necessary
to construct and comp ete in a good and workmanlike manner, in
strict accordance wit the specifications, plans and drawings
therefor on file in t~e Office of the City Clerk of the City of
Anaheim, the public i provement hereinabove mentioned and
described, together w'th the appurtenances thereto, and as
specified in the noti e inviting sealed proposals, and that said
proposal of said abo~-named bidder should be accepted and a
contract awarded to s~id bidder in accordance therewith~ and
WHEREAS, t~ City Council finds that the above-mentioned
sealed proposal is t1 lowest responsible proposal received and
that the person, fir or corporation submitting said proposal is a
responsible person, Jrm or corporation and that the proposal
submitted is the bes~ suited and fitted for the public improvement
to be constructed.
NOW, THERE~RE, BE IT RESOLVED by the City Council of the
City of Anaheim that Ithe sealed proposal submitted by said
contractor for the f~rnishing of all plant, labor, services,
~ materials and equipm t, all utilities and transportation,
including power, fue and water, and performing all work necessary
to construct and com lete, in a good and workmanlike manner, in
strict accordance wi the specifications, plans and drawings
therefor on file in e Office of the City Clerk of the City of
Anaheim and the noti e inviting sealed proposals, the public works
and improvement here'nabove more particularly mentioned and

uescribed, together W!th the appurtenances thereto, be, and the
same is hereby, accep ed, and that a contract for the construction
and completion of sai public improvement be, and the same is
hereby, awarded to th! said above-named bidder.
AND BE IT F RTHER RESOLVED that the successful bidder or
bidders upon each con ract awarded as hereinabove set forth, shall
be, and they are here y required to execute a contract in the
required form with th City of Anaheim upon the terms and
conditions specified n the notice inviting sealed proposals and
the proposal submitte by said successful bidder or bidders and in
accordance with the pans and specifications for said public
improvement hereinabo e described, and in accordance with the
terms, conditions and provisions of this resolution, and that said
successful bidder or idders to whom each contract is awarded shall
be required to furnis a surety bond in an amount equal to one
hundred percent (100% of the contract price for all labor,
materials and equipme t to be furnished and performed, as set forth
in the sealed proposa submitted by said bidder for the
construction of said ublic improvement, together with the
appurtenances theretojor such portion thereof as is covered by said
contract, as securityifor the faithful performance of said
contract, and a separ!te surety bond in an amount equal to one
hundred percent (100% of the construction cost of said public
improvement covered b said contract, as security for the payment
of all persons perfor ing labor and furnishing material for said
project. .
AND BE IT F RTHER RESOLVED that said successful bidder or
bidders be, and they re hereby, required to furnish to the City of
Anaheim in companies atisfactory to the City of Anaheim, public
liability, property d mage, compensation, and other insurance in
the amounts and for t e purposes set forth and specified in the
notice inviting seale proposals, and subject to the approval of
the City Attorney as 0 form and sufficiency.
AND BE IT F~THER RESOLVED that the Mayor and the City
Clerk of the City of . aheim be, and they are hereby, authorized
and directed to make, execute and enter into, for and on behalf of
the City of Anaheim, t written contract with said successful bidder
or bidders for the fu nishing of all plant, labor, materials, and
equipment and perform ng all work, as hereinabove more particularly
described, for the co struction, installation and completion of
said public improveme t hereinabove described upon the terms and
conditions as specifi d in the notice inviting sealed proposals,
the detailed design, lans, profiles, drawings and general
specifications and de ailed specifications and drawings, and all
addenda thereto, and 11 modifications incorporated therein prior
to the date of the op ning of bids, on file in the Office of the
City Clerk of the Cit of Anaheim and in strict accordance with the
terms, conditions and provisions of this resolution, and in
accordance with all of the contract documents herein specified.
