A RESOLUTI~N OF THE CITY COUNCIL OF THE CITY
OF ANAHEIMIAWARDING A CONTRACT FOR THE
REHABILITAfION OF WELLS NOS. 106 AND 128 AND
DEMOLITION OF WELL NO. 108 AND WELL AT
MARSHALL P RK, IN THE CITY OF ANAHEIM,
ACCOUNT NO . 53-619-6329-92375 for Well #106,
53-619-632 -02384 for Well #128,
53-619-632 -02398 for Well #108 and
51-619-632 -02404 for Well at Marshall Park.
WHEREAS, t~e City Council of the City of Anaheim did
cause to be publishe in a newspaper of general circulation,
published and circul ted in the City of Anaheim, to wit: The
Anaheim Bulletin, oni the 18th and 25th days of October, 1984, a
notice inviting seal~d proposals for furnishing the following:
All plant, labo~, services, materials and equipment,
and all utilitibs and transportation, including power,
fuel and water,iand performing all work necessary to
construct and cbmplete in a good and workmanlike
manner, in stri~t accordance with the specifications,
plans and drawihgs therefor on file in the Office of
the City Engine~r or City Clerk of the City of Anaheim,
the following ppblic improvement, to wit:
Rehabilitation bonsisting of Well Nos. 128 and 108 and
demolition of ~ll No. 108 and Well at Marshall Park in
the City of Ana~eim, including the construction of a
control buildin~, replacement of pumps and motors,
construction of! control switchgear, and installation of
SCADA systems; and demolition of two other wells
including remo~l of pumps and motors, site
~estoration, a~ removal of chemical injection
equipment accor~ing to the plans and specifications on
file inthe Offi~e of the City Engineer Account Nos.

in accordance with ~e design, plans, profiles and specifications
of said public impr~ement on file in the Office of the City Clerk
of the City of Anah~im; and

WHEREAS, s.id notice inviting sealed proposals for said
public improvement d~d provide that sealed proposals would be
received by the CitYJof Anaheim at the Office of the City Clerk of
the City of Anaheim *p to the hour of 2:00 o'clock P.M. on the 15th
day of November, 198~, for the furnishing of all plant, labor,
services, materials .nd equipment, all utilities and
transportation, incl~ding power, fuel and water, and performing all
work necessary to cotstruct and complete in a good and workmanlike
manner, the public i provement hereinabove more particularly
mentioned and descri ed, and which notice did state and declare
that pursuant to the!provisions of Section 1770 of the Labor Code,
the City Council of the City of Anaheim had ascertained the
prevailing rate of w~ges in the locality in which this type of
labor is to be perfotmed for each craft or type of workman or
mechanic needed to e ecute the contract, and which wage scale is on
file in the offices ~f the City Clerk and City Engineer; and
WHEREAS, t~e City Clerk of the City of Anaheim did
receive the followin9 sealed proposals prior to 2:00 o'clock
on the 15th day of N~vember, 1984, in response to the notice
aforesaid inviting s,aled proposals, to wit:

AND WHEREA~, the City Engineer did thereupon examine and
tabulate said sealedlproposals and did report to the City Council
the result of his ex~mination and tabulation; and

WHEREAS, t~e City Council finds that the sealed proposal
submitted by PACIFIC/MACHINERY CORPORATION, P.O. Box 176, Pomona,
California 91769, islthe lowest responsible proposal submitted for
the furnishing of al~ plant, labor, services, materials and
equipment, all utili~ies and transportation, including power, fuel
and water and perfor~ing all work necessary to construct and
complete in a good and workmanlike manner, in strict accordance
with the specificatipns, plans and drawings therefor on file in the
Office of the City C~erk of the City of Anaheim, the public
improvement hereinabpve mentioned and described, together with the
appurtenances thereto, and as specified in the notice inviting
sealed proposals, and that said proposal of said above-named bidder
should be accepted and a contract awarded to said bidder in
accordance therewith~ and

WHEREAS, t~e City Council finds that the above-mentioned
sealed proposal is t~e lowest responsible proposal received and
that the person, fir, or corporation submitting said proposal is a
responsible person, tirm or corporation and that the proposal
submitted is the best suited and fitted for the public improvement
to be constructed.
NOW, THEREtORE, BE IT RESOLVED by the City Council of the
City of Anaheim that! the sealed proposal submitted by said
contractor for the f~rnishing of all plant, labor, services,
materials and equipm~nt, all utilities and transportation,
including power, fue~ and water, and performing all work necessary
to construct and comPlete, in a good and workmanlike manner, in
strict accordance wi~h the specifications, plans and drawings
therefor on file in ~he Office of the City Clerk of the City of
Anaheim and the noti~e inviting sealed proposals, the public works
and improvement here~nabove more particularly mentioned and
described, together ~ith the appurtenances thereto, be, and the
same is hereby, accepted, and that a contract for the construction
and completion of sa~d public improvement be, and the same is
hereby, awarded to t~e said above-named bidder.
AND BE IT fURTHER RESOLVED that the successful bidder or
bidders upon each cottract awarded as hereinabove set forth, shall
be, and they are her by required to execute a contract in the
required form with t e City of Anaheim upon the terms and
conditions specified! in the notice inviting sealed proposals and
the proposal submitt~d by said successful bidder or bidders and in
accordance with the ~lans and specifications for said public
improvement hereinabpve described, and in accordance with the
terms, conditions an~ provisions of this resolution, and that said
successful bidder or bidders to whom each contract is awarded shall
be required to furni~h a surety bond in an amount equal to one
hundred percent (100') of the contract price for all labor,
materials and equipm~nt to be furnished and performed, as set forth
in the sealed propos~l submitted by said bidder for the
construction of said: public improvement, together with the
appurtenances theretp or such portion thereof as is covered by said
contract, as securit~ for the faithful performance of said
contract, and a sepa~ate surety bond in an amount equal to one
hundred percent (100~) of the construction cost of said public
improvement covered by said contract, as security for the payment
of all persons perfdrming labor and furnishing material for said
project.

AND BE IT rURTHER RESOLVED that said successful bidder or
bidders be, and they are hereby, required to furnish to the City of
Anaheim in companies, satisfactory to the City of Anaheim, public
liability, property ~amage, compensation, and~other insurance in
the amounts and for the purposes set forth and specified in the
notice inviting seal~d proposals, and subject to the approval of
the City Attorney as;to form and sUfficiency.
AND BE IT fURTHER RESOLVED that the Mayor and the City
Clerk of the City ofiAnaheim be, and they are hereby, authorized
and directed to make, execute and enter into, for and on behalf of
the City of Anaheim, a written contract with said successful bidder
or bidders for the f~rnishing of all plant, labor, materials, and
equipment and perfor,ing all work, as hereinabove more particularly
described, for the c~nstruction, installation and completion of
said public improvem,nt hereinabove described upon the terms and
conditions as specif~ed in the notice inviting sealed proposals,
the detailed design,:plans, profiles, drawings and general
specifications and d~tailed specifications and drawings, and all
addenda thereto, and all modifications incorporated therein prior
to the date of the opening of bids, on file in the Office of the
City Clerk of the City of Anaheim and in strict accordance with the
terms, conditions an41provisions of this resolution, and in
accordance with all ~f the contract documents herein specified.
THE FOREGOJNG RESOLUTION is approved and adopted ,by the
City Council of the City of Anaheim this 11th day of December, 1984.
