OF ANAH M AWARD~NG A CONTRACT FOR THE
RIVERD ' PARK P~CNIC SHELTER, IN THE CITY OF
ANAHEIM~ 'ACCOUNT NO. 16-822-7105-22080.
WHEREAS~ ,the City Council of the City of Anaheim did
cause to be pub1i~~ed in a ,newspaper of general circulation,
published and cir~~lated in the City of Anaheim, to wit: The
Anaheim Bulletin, i$n the 13th and 20th days of September, 1984, a
notice inviting s.~led pro~osals for furnishing the following:
All plant, l4~or, services, materials and equipment,
and all utilfties and transportation, including power,
fuel and wat+t, and performing all work necessary to
construct an~ complete in a good and workmanlike
manner, in st~ict acc$rdance with the specifications,
plans and dr.~ings therefor on file in the Office of
the City Engineer or City Clerk of the City of Anaheim,
the followint public improvement, to wit:
Providing an4 installing a picnic shelter at Riverdale
Park (north .~de of Riverdale and west of Lakeview), in
the City of !naheim, complete with concrete block
pilaster, co.crete in$ta1lation and construct wood
structure. 111 work $hall be done in accordance with
the plans an. specifications for this project on file
in the offic, of the City Engineer, Account No.
16-822-7105-~~080,
in accordance wit~ the design, plans, profiles and specifications
of said public im~,~ovement on file in the Office of the City Clerk
of the City of An,beim: and

WHEREAS, said notice inviting sealed proposals for said
public improvement did provide that sealed proposals would be
received by the C~ty of Anaheim at the Office of the City Clerk of
the City of AnaheJ~ up to the hour of 2:00 o'clock P.M. on the 27th
day of September,., 1984, for the furnishing of all plant, labor,
services, materiala and equipment, all utilities and
transportation, including power, fuel and water, and performing all
work necessary to construct and complete in a good and workmanlike
manner, the public improvement hereinabove more particularly
mentioned and described, and which notice did state and declare
that pursuant to tpe provisions of Section 1770 of the Labor Code,
the City Council ~f the City of Anaheim had ascertained the
prevailing rate of wages in the locality in which this type of
labor is to be peJ;'iformed for each craft or type of workman or
mechanic needed tp execute the contract, and which wage scale is on
file in the offic~s of the City Clerk and City Engineer: and

AND WHE'~S, the City Engineer did thereupon examine and
tabulate said seaf~d propo$als and did report to the City Council
the result of hisrexamination and tabulation: and
WHEREAS~ithe Citr Council finds that the sealed proposal
submitted by Warv!'Construq:tion, Inc., 15931 "C" Chemical Lane,
Huntington Beach, ,California 92649, is the lowest responsible
proposal submitte4for the furnishing of all plant, labor,
services, materiat, and eq~ipment, all utilities and
transportation, i;t1uding ~ower, fuel and water and performing all
work necessary to~onstruct and complete in a good and workmanlike
manner, in strict~ccordan~e with the specifications, plans and
drawings therefor~n file in the Office of the City Clerk of the
City of Anaheim, tbe public improvement hereinabove mentioned and
described, togeth+t with the appurtenances thereto, and as
specified in the $~tice inviting sealed proposals, and that said
proposal of said .~ove-named bidder should be accepted and a
contract awarded to said bidder in accordance therewith: and
WHEREAS, the City Council finds that the above-mentioned
sealed proposal i. the lowest responsible proposal received and
that the person, firm or corporation submitting said proposal is a
responsible perso~i firm or corporation and that the proposal
submitted is the ~est suited and fitted for the public improvement
to be constructed.

NOW, TH*~EFORE, BE IT RESOLVED by the City Council of the
City of Anaheim t~.t the sealed proposal submitted by said
contractor for th+ furnishing of all plant, labor, services,
materials and equ~pment, all utilities and transportation,
including power, f~el and water, and perfo~ming all work necessary
to construct and q$mplete, in a good and workmanlike manner, in
strict accordance with the specifications, plans and drawings
therefor on file i~ the Office of the City Clerk of the City of
Anaheim and the n~tice inviting sealed proposals, the public works

bidders upon eachi~ontract awarded as hereinabove set forth, shall
be, and they are ~~reby required to execute a contract in the
required form wit.'the City of Anaheim upon the terms and
conditions SpeCif!....,~..d in th.,. notice inviting sealed proposals and
the proposal subm tted by said successful bidder or bidders and in
accordance with t ~ plans and specifications for said public
improvement herei .bove de$cribed, and in accordance with the
terms, conditions_nd provisions of this resolution, and that said
successful bidder,~r bidders to whom each contract is awarded shall
be required to fu**ish a s~rety bond in an amount equal to one
hundred percent (t~O%) of the contract price for all labor,
materials and equ~pment to , be furnished and performed, as set forth
in the sealed pro~~sal sUb$itted by said bidder for the
construction of s~id publie improvement, together with the
appurtenances theteto or s~ch portion thereof as is covered by said
contract, as secu*~ty for the faithful performance of said
contract, and a s.parate surety bond in an amount equal to one
hundred percent (~~O%) of the construction cost of said public
improvement cover+~ by said contract, as security for the payment
of all persons pet forming labor and furnishing material for said
project.
AND BE tt FURTHEa RESOLVED that said successful bidder
bidders be, and t~.y are h.reby, required to furnish to the City
Anaheim in compan~~s satis1actory to the City of Anaheim, public
liability, proper~t damage~ compensation, and other insurance in
the amounts and f~t the pu~poses set forth and specified in the
notice inviting s..led proposals, and subject to the approval of
the City Attorney.s to form and sufficiency.

and directed to m4*e, execute and enter into, for and on behalf of
the City of Anahet" a written contract with said successful bidder
or bidders for th.furnishing of all plant, labor, materials, and
equipment and pertQrming all work, as hereinabove more particularly
described, for th~construction, installation and completion of
said public impro~,ment hereinabove described upon the terms and
conditions as speqified in the notice inviting sealed proposals,
the detailed desi~m, plans, profiles, drawings and general
specifications and detailed specifications and drawings, and all
addenda thereto, amd all mGdifications incorporated therein prior
to the date of the opening of bids, on file in the Office of the
City Clerk of the City of Anaheim and in strict accordance with the
terms, conditions and provisions of this resolution, and in
accordance with all of the contract documents herein specified.
