A RESOLUT~ON OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT THE
ZONING MAE REFERRED TO IN TITLE 18 OF THE
ANAHEIM M~ICIPAL CODE SHOULD BE AMENDED AND
THAT THE dOUNDARIES OF CERTAIN ZONES SHOULD
BE CHANGED.
WHEREAS, ~Qe City Planning Commission of the City of
Anaheim did hold a ri4blic he~ring in Reclassification Proceedings
No. 84-85-1 to cons~der an a~endment to the Zoning Map referred to
in Title 18 of the ~aheim Municipal Code, and to consider a change
in the boundaries of the zone or zones hereinafter mentioned and
described and, at said hearing, did receive evidence and reports
from persons interested therein and from its staff: and
WHEREAS, w~thin a period of forty (40) days following
said hearing, the P14nning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at said h$4ring and granted the proposed amendment: and
WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review of said Planning Commission action: and
WHEREAS, at the time and place fixed for said public
hearing, the City CQuncil did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to be
heard and did receive evidence and reports, and did consider the
same: and
WHEREAS, the City Council does find and determine that
the Zoning Map refer~ed to in Title 18 of the Anaheim Municipal
Code should be amended and that the property hereinafter described
should be excluded from the zone or zones in which it is now
situated and incorporated in the zone and zones as hereinafter set
forth.
NOW, THERBfORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the City Council does hereby declare and
indicate its intention to amend the Zoning Map of the City of
Anaheim and to rezone and reclassify the following described
property, situated in the City of Anaheim, County of Orange, State
of California, to wit:

HELEN AND LYNCIt"S ADDITION TO ANAHEIM, AS SHOWN ON A
MAP THEREOF REqQRDED IN BOOK 442, PAGE 156 OF DEEDS,
RECORDS OF LOS~GELES COUNTY,
into the II ML II INDUS'1t~IAL, LIMITED ZONE of the City of Anaheim,
subject to the folld~ing conditions:
1. That prior .to issuance of a building permit, the
appropriate traffic signal assessment fee shall be paid
to the City of Anaheim in an amount as determined by the
City Council for neW industrial buildings.
2. That drainage of subject property shall be disposed of in
a manner $atisfactory to the City Engineer.
3. That subj$~t property shall be served by underground
utilities.
4. That trash storage areas shall be provided in accordance
with apprqved plan$ on file with the Street Maintenance
and Sanit~tion Division.
5. That all 4riveways shall be designed to accommodate ten
(10) foot radius c~rb returns as required by the City
Traffic E~~ineer.
6. That in tb~ event subject property is to be divided for
the purpo.~ of sale, lease, or financing, a parcel map to
record the approve~ division of subject property shall be
submitted to and a~proved by the City of Anaheim and then
be recorded in the Office of the Orange County Recorder.
7. That prior to commencement of structural framing, fire
hydrants .hall be installed and charged as required and
determine4 to be necessary by the Chief of the Fire
Department.
8.
That prior to issuance of a building permit, appropriate
water assessment fees shall be paid to the City of
Anaheim, in an amount as determined by the Office of the
Utilities General Manager.

9. That fire sprinklers shall be installed in all applicable
structures as required by the City Fire Marshall.

10. That the proposal shall comply with all signing
requirements of the ML Zone unless a variance allowing
waivers is approved by the Planning Commission or City
Council.

11. That the ~ner of subject property shall submit a letter
requesting Itermina~ion of Conditional Use Permit No. 1252
to the Pl~rlning Department.
12. That prioI"to the introduction of an ordinance rezoning
subject prQperty, dondition No. 11, above-mentioned,
shall be oQmpleted. The provisions or rights granted by
this resolution shall become null and void by action of
the Plann~ng Commission unless said conditions are
complied with within one year from the date of this
resolution, or such further time as the Planning
Commission may grant.
13. That prior to the commencement of the activity authorized
under this resolution, or prior to the time that a
building germit is issued, or within a period of one year
from the date of this resolution, whichever occurs first,
Condition Nos. 1 and 8, above-mentioned, shall be
complied with. Extensions for further time to complete
said conditions may be granted in accordance with Section
l8.03.090.q;>f the Anaheim Municipal Code.
14. That prior to final building and zoning inspections,
Condition Nos. 2, 3, 4, 5 and 9, above-mentioned, shall
be compli.d with.
BE IT FURTUER RESOLVED that the City .Co~cil of the City
of Anahei. does hereby find and determine that 'the adQption of this
Resolution is expr&~aly predicated upon applicant's compliance with
each and all of the conditions hereinabove set forth. Should any
condition or any part thereof, be declared invalid or unenforceable
by the final judgmeftt of any court of competent jurisdiction, then
this ResQlution, aRb any approvals herein contained, shall be
deemed null and voili!.
