RESOLUTIO~l~F THE CITY COUNCIL OF THE CITY OF
ANAHEIM G~TING VARIANCE NO. 3407.

WHEREAS, a~ter a request for variance by CINDERELLA
MOTEL, owner, was re~eived' a public hearing before the Planning
Commission of the Ci y of Anaheim was held upon due and proper
notice, a result of hich Variance No. 3407 was granted covering
the following descri ed property:

E 10 WEST, SAN BERNARDINO BASE AND
ITY OF ANAHEIM, COUNTY OF ORANGE,
IFORNIA.
EXCEPTING tHEREFROM THE NORTH 200 FEET.
ALSO EXCEPtING THEREFROM THE SOUTH 250 FEET; and
WHEREAS, tjereafter, within the time prescribed by law,
an interested party r the City Council, on its own motion, caused
the review of said Panning Commission ~ction at a public hearing
noticed and held as rescribed by law and, as a result thereof, the
City Council does he eby make the following findings:
1. The varianpe will not cause an increase in traffic
congestion in the im~ediate vicinity nor adversely affect the
adjoining land uses;: and
2. The grantitg of the variance under the conditions imposed
will not be detrimen al to the peace, health, safety or general
welfare of the citiz:ns of the City of Anaheim.
NOW, THEREfORE, BE IT RESOLVED by the City Council of the
City of Anaheim that! a conditional zoning variance be, and the same
is hereby, granted p~rmitting expansion of a motel on the property
hereinbefore describ,d with waivers of the following sections of
the Anaheim Municipal Code:

AND 18.48.0 6.050

That said variance b~ granted subject to the following conditions:
1. That prior[to issuance of a building permit, the
appropriatii traffic signal assessment fee shall be paid
to the Cit of Anaheim in an amount as determined by the
City Counc'l for new commercial buildings.
That damag~d and/or hazardous sidewalks shall be removed
and/or recpnstructed along Harbor Boulevard as required
by the City Engineer and in accordance with standard
plans and ~pecifications on file in the Office of the
City Engin~er.
That drain~ge of subject property shall be disposed of in
a manner s~tisfactory to the City Engineer.
4. That subjept property shall be served by underground

with approVed plans on file with the Street Maintenance
and Sanitation Division.

That if at,a future date the City Traffic Engineer
determines I that the proposed parking is inadequate to
serve subj,ct use, the central landscaped area
immediatelt east of the swimming pool shall be converted
to parkingispaces. The number of spaces to be provided
shall be dttermined by a parking demand study paid for by
the petiti ner and reviewed and approved by the City
Traffic En~ineer.
That all a~r conditioning facilities shall be properly
shielded ftom view.
That the Pf'oposal shall comply with all signing
requiremen s of the CR Zone, unless a variance allowing
sign waive s is approved by the Planning Commission or
City Counc.1.
That subje~t property shall be developed substantially in
accordanceiwith plans and specifications on file with the
City of An*heim marked Exhibit Nos. 1 through l2.

12. That the o~ner of subject property shall submit a letter
requesting'termination of Variance No. 879.

13. That prior to the commencement of the activity authorized
under this resolution, or prior to the time that a
building Pfrmit is issued, or within a period of one year
from the d te of thiS. resolution, whichever occurs first,
Condition os. 1 and 12, above-mentioned, shall be
complied w tho Extensions for further time to complete
'said condi ion~ may ~ granted in accordance with Section
18.03.090 ~f the Anaheim Municipal Code.
That prior! to final building and zoning inspections,
Condition $os. 2, 3, 4, 5, 6, 9 and 11, above-mentioned,
shall be c~mplied with.
BE IT FURTiER RESOLVED that the City Council of the City
of Anaheim does here y find and determine that adoption of this
Res. olution is expresly predicated upon applicant I s compliance with
each and all of the onditions hereinabove set forth. Should any
sucb cohdition, or a~'part thereof, be declared invalid or
unenforceable by thei'final ju4gment of any court of competent
jurisdiction, then t is Resolution, and any approvals herein
contained, shall be eemed null and void.

THE FOREGOJNG RESOLUTION is approved and adopted by the
City Council of the ~lty of Anaheim this 11th day of September,
1984.
