A RESOLUTIfOF THE CITY COUNCIL OF THE CITY OF
ANAHEIM FI LY ACCEPTING THE COMPLETION AND
THE FURNIS ING OF ALL LABOR, SERVICES, AND
EQUIPMENT CUT AND REMOVE RUBBISH, REFUSE AND
DIRT UPON~ PARCEL OR PARCELS OF REAL PROP-
ERTY OR PUBLIC STREET, IN THE CITY OF
ANAHEIM, A. DIRECTED BY THE CHIEF OF THE FIRE
DEPARTMENT,I ACCOUNT NO. 01-202-6320.
WHEREAS, tie City Council of the City of Anaheim did
cause to be publish in a newspaper of general circulation,
published and circu ated in the City of Anaheim, to wit: The
Anaheim Bulletin, oq the 31st day of March and the 7th day of
April, 1983 , invit~ng sealed proposals for furnishing the
following:
All labor, serv~ces and equipment to cut and remove all
rank growth and Iweeds and remove rubbish, refuse and dirt
upon any parcel lor parcels of real property or any public
street in the C~ty of Anaheim, as directed by the Chief
of the Fire Dep~rtment, Account No. 01-202-6320,
which said notice s~ecified that sealed proposals as specified in
said notice would b~ received up until 2:00 o'clock P.M. on the
14th day of April, ~983; and
WHEREAS, on the 14th day of April, 1983, at the hour of
2:00 o'clock P.M., ~he City Clerk and the Chief of the Fire
Department of the ctty of Anaheim did open in public in the City
Council Chamber in ~he Anaheim Civic Center said sealed proposals
received up to that time for the furnishing of all labor,
services, and equip~ent to cut and remove said rank growth and
weeds and remove ru~bish, refuse and dirt, and the Chief of the
Fire Department did:tabulate the result of said sealed proposals
and did make a repott to the City Council at its next regular
meeting; and

WHEREAS, t~e City Council of the City of Anaheim did, at
its next regular me.ting held on the 26th day of April, 19B3,
consider the sealed proposals submitted for furnishing the labor,
services and equipm+nt and performing the work hereinabove more
particularly descri>>ed and set forth, and did thereupon find and
determine that the $ealed proposal submitted by EDWIN WEBBER,
INC., 8472 Rembrandt Drive, Huntington Beach, California 92647,
was the lowest resp~nsible proposal submitted therefor, and
thereupon accepted ,aid bid and did award a contract to said
contractor for furn~shing all labor, services and equipment and
performing all work necessary to complete said public improvement
in a good and workm_nlike manner, which said contract was duly
made and entered into on the 27th day of June, 1983; and

WHEREAS, sCljid EDWIN WEBBER, INC. has furnished all labor,
services and equipm~t and has performed all work as specified in
the contract and co~tract documents duly made and entered into
with him the City of! Anaheim, and the Chief of the Fire Department
has duly certified tb the completion of said work in accordance
with said contract dbcuments; and
WHEREAS, t~ City Council finds that said contractor has
completed said publi~ improvement hereinabove more particularly
described in accordahce with the provisions of the contract and
the contract documen~s, and that notice of completion should be
filed and payment of the balance due said contractor authorized in
accordance with the contract documents.
NOW, THEREFPRE, BE IT RESOLVED by the City Council. of the
City of Anaheim that! all labor, services, and equipment a~d the
performance of all wbrk necessary to, in a good and workmanlike
manner, in strict acpordance with the contract and contract
documents, the cuttihg and removal of said rank growth and weeds
and removal of rubbish, refuse and dirt hereinabove referred to,
in the City of Anahe~m, by said contractor be, and the same are
hereby, accepted subcect, nevertheless, to all the terms,
conditions and pIovi~ions of said contract and contract documents,
and said work to be ~aid him thirty-five (35) days after final
acceptance and the filing of notice of completion of said work as
excepting only s~ch sum or sums as may lawfully be withheld in
accordance with the ~rovisions of said contract and contract
documents. That acc,ptance by the contractor of said payment
shall operate and sh~ll be a release to the City of Anaheim, its
officers, agents and'employees from all claims and .liabilities due
the contractor for a~ything done or furnished or withheld or for
anything relating to' the work or any act or neglect of the City,
its officers, agents and employees, excepting only claims against
the City for amounts withheld by the City at the time of such
payment.
AND BE IT FtRTHER RESOLVED that the Mayor be, and he is
hereby, authorized tQ execute and file a notice of completion of
said work as require4 by law.
THE FOREGOI$G RESOLUTION is approved and adopted by the
City Council of the ~ity of Anaheim this 24th day of July, 1984.
