RESOLUTION NO. 78R-562
A RESOLU'l' ()N OF THE CITY COUNCIL OF THE CITY
OFANAHEI FINDING AND DETERMINING THAT TITLE
18 OF THE ANAHEIM MuNICIPAL CODE RELATING TO
ZONING SH OLD BE AMENDED AND THAT THE BOUND-
ARIES OF ERTAIN ZONES SHOULD BE CHANGED.
WHEREAS, ~pe City flanning Commission of the City of
Anaheim did hold a tublic he.ring in Reclassification Proceedings
No. 78-~~ eto consider an amendment to Title 18 of the
Anaheim n cipal Ce relating to zoning, and to consider a
change in the bound ries of the zone or zones hereinafter men-
tioned and describe, . and, at said hearing, did receive evidence
and reports from pe sons interested therein and from its staff,
and
WHEREAS, ft" thin a period of forty (40) days fOllowing
said hearing, the Panning Cbmmissiondid duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at said h aring and ~ant1n9.: the proposed amendment1
and L
WHEREAS, ~hereafter, within the time prescribed by law,
an intere.ted partYL, or the City Council, on its own motion, caused
the review of said r'lanning Commission action1 and
WHEREAS, e:t the time and place fixed for said public
be, aring. the City C . ncil did duly hold and conduct such hearing
and did give all pe .sons interested therein an opportunity to be
beard and did recei evidence and reports, and did consider the
same, and !
. WHEREAS, ~' .he City Council does find and determine that' .
the amendment to Tile 18 of the Anaheim Municipal Code should be
adopted and that th property hereinafter described should be .

NOW, THEtf1FORE, BE IT RESOLVED by the City Council of
the City of AnaheiIq that Title 18 of the Anaheim Municipal Code
be, and the same i$ hereby, amended and that the following de-
scribed property, slituated in the City of Anaheim, County of
Orange, State of ca!1ifornia, to wit:

the following con~tions:
1. T~t theowner(s) of subject property shall
irrevocably offer to deed to the City of Anaheim a strip of
land 60 feet in w · th from the centerline of the street along
Katella Avenue, eluding a 25 foot radius property line return
at WalnutStreet'Jfor street widening purposes.
2. ~' t the vehicular access rights, except at
approved access pints to Katella Avenue shall be dedicated to
the City of Anahe,: .
3. T 't street. lighting facilities along Walnut
Street shall be stalled prior to the final building and
zoning inspectio unless otherwise approved by the' Director
of Public Utilits, and in accordance with standard specifica-
tions on file in he Offic,e of the Director of Public Utilities;
and/or that a bo , certif1cateof deposit, letter of credit, or
cash, in an amou and form satisfactory to the City of Anaheim
shall be posted th the City to guarantee the installation of
the above-mentiod requirements prior to occupancy.
4. ~'t theowner(s) of subjectproper.ty shall pay
to the City of eim the sum of three and one~half dollars
($3.50) per front foot along Katella Avenue for street lighting
purposes.
5. T~'tthe owner(s) of subject property shall pay
to the City of ',e1m the sum of ninety-five cents ($.95) per
front foot alOng, atella Avenue and Walnut Street for tree
planting purpose .
6. ~.t sidewalks shall be installed along Katella
Avenue and Walnu , street as required by the City Engineer and
in accordance wi .stand&.Z'd plans and specifications on file
in the Office of he City Engineer; said sidewalk installation
shall not be req red until such time as Katella Avenue is
widened. '

15. Pr~or to the introduction of an ordinance rezoning
subject property, i Condition Nos. 1, 2, 3, 4, 5 and 14, ,above-
ment10ned,shall ecompleted. The provisions or right.s granted
by this resolutio shall become null and void by act10n of the
Planning Commissi n unless said conditionsarecomplied~with
within one .year f om the date hereof, or such further time as
the Planning Comm,ss10n may grant.

16. Th..t Condit1on Nos. 6, 7, 8,9, 12 and 13, above-
mentioned, shall 1>e complied with prior to final building and
zoning inspection$. '
BE IT nTHER RE$OLVED that the City Attorney be,
and he is hereby uthorizeCI and direc'ted to prepare and
submit to the C1t Council an ordinance amending Title 18 of
the Anaheim Munic pal Code to accomplishtheohJects herein
found and determi.ed to be necessary and proper.
THE FORtGOING RESOLUTION is approved and adopted
