A RESOL~ON OF THE CITY COtmCIL OF THE CITY
OF ANAHE FINDING AND DETERMINING THAT TITLE
18 OF TH ANAHEIM MUNICIPAL CODE RELATING TO
ZONING S ULD BE AMENDED AND THAT THE BOUND-
ARIES OF . ERTAIN ZONES SHOULD BE CHANGED.
WHEREAS, Ithe City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Proceedings
No.__ i to consider an amendment to Title 18 of the
Anahe m un c1pa de relating to zoning, and to consider a
change in the boun ries of the zone or zones hereinafter men-
tioned and describ and, at said hearing, did receive evidence
and reports from p rsons interested therein and from its staff1
and
WHEREAS, Mithin a period of forty (40) days fOllowing
said hearing, the ~lanning Commission did duly adopt a resolution
containing a reper of its findings, a summary of the evidence
presented at said earing and annrovini the proposed amendment1
and . .
WHEREAS, ithereafter, within the time prescribed by law,
an interested partJ or the City Council, on its own motion, caused
the review of said~lplanning Commission action1 and
WHEREAS'i"at the time and place fixed for said public
hearing, the City uncil did duly hold and conduct such hearing
and did give all p rsons interested therein an opportunity to be
heard and did rece've evidence and reports, and did consider the
same 1 and .

WHEREAS, ithe City Council does find and determine that .
the amendment to T~tle 18 of the Anaheim Municipal Code should be
adopted and that t e property hereinafter described should be .
excluded from the one or zones in which it is now situated and
incorporated in th~ zone or zones as hereinafter set forth.
NOW, THE$:FORE, BE IT RESOLVED by the City Council of
the City of Anahei~ that Title 18 of the Anaheim Municipal Code
be, and the same i~ hereby, amended and that the fOllowing de-
scribed property, $ituated in the City of Anaheim, County of
Orange, State of C~lifornia, to wit:

wise approved by th~ Director of Public Utilities, and in accord-
ance with standard $pecifications on file in the Office of the
Director of Public Vtilitiesj and/or that a bond, certificate of
deposit, letter of ~redit, or cash, in an amount and form satis-
factory to the City'of Anaheim shall be posted with the City to
guarantee the instailation of the above-mentioned requirements
prior to occupancy.
3. That the ~wner(s) of subject property shall pay to the
City of Anaheim the; sum of 95 cents per front foot along Simmons
Avenue and Haster S~reet for tree planting purposes.
4. That tras1). storage areas shall be provided in accordance
with approved plans Ion file with the Office of the Director of
Pub lic Works.

5. That fireihydrants shall be installed and charged as
required and determ~ned to be necessary by the Chief of the Fire
Department prior to icommencementof structural framing.
6. That a si~ (6) foot high masonry wall shall be construc-
ted along the portidns of the east property line adjacent to the
RS-7200 zoned lots, land along the portions of the south and west
property lines whicH abut the RS-A-43,OOOzoned parcels located
at the northeast co~ner of Simmons Avenue and Haster Street.

7. That appnopriate water assessment fees as determined
by the Director of 'Public Utilities shall be paid to the City of
Anaheim prior to tlie issuance of a building permit.
8. That subject property shall be served by underground
utilities.

9. That dra~nage of subject property shall be disposed of
in a manner satisf~otory to the City E~gineer.
10. That the !owner(s) of subjeot property shall pay to the
City of An,' aheim t,h~, appropriate park and recreation i,n-lieu fe,es
as determined to b appropriate by the City Council, said fees
to be paid at the :tme the building permit is issued.

11. That a moldified cul-de-sac shall be provided at the
terminus of MountajJn View Avenue subject to the approval of the
City Engineer. .
12. That all private streets shall be developed in accord-
ance with the City Iof Anaheim's standards for private streets.
13. If P, ermanjentstreet name signs have not been installed,
temporary street nB.P1e signs shall be installed prior to any occu-
pancy.
14. That the bwner (s) of subject property. shall pay the
traffic signal ass$smentfee (Council Policy No. 214) amounting
to $36.00 per each hew dwelling unit prior to the issuance of a
building permit. '
15. Prior to:be introduotion of an ordinance rezoning
subject property, C~nditions No.1, 2 and 3, above-mentioned,
shall be oompleted.! The provisions or rights granted by this
resolution shall be~ome null and void by action of the Planning
Commission unless s~d conditions are complied with within one
year from the date hereof, or such further time as the Planning
Commission may gran~. '
16. ThatCond~tions NO.1, 3, 5, 6, 8 and 9, above-mentioned,
shall be complied w!1th prior to final building and zoning inspec-
tions.

BE IT FUR~f{ER RESOLVED that the City Attorney be,and
he is hereby,authott1.zed and directed to prepare and submit to
the City Counoil ani ordinance amending Title 18 of the Anaheim
Municipal Code to a~complish the objects herein found and deter-
mined to be necessat-y and proper.
