A RESOLUTIPN OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM! GRANTING CONDITIONAL USE PERMIT
NO. 1866 .
WHEREAS, t~ City Planning Commission of the City of
Anaheim did receive .n application for a conditional use permit
from CARL CISSELL ~d WILLIAM M. AND BETTY JO CLOW to permit a
36-unit Planned Uni~ Development with a waiver of minimum build-
ing site area per uQit on the following described property:
The North 98 f~et of the South 314.74 feet, measured
from the cente~line of the Street, of the West 282
feet, measured 1from the centerline of the Street, of
Lot 9 of Orangdwood Tract, as per map recorded in
Book 7, page 4a of Miscellaneous Maps, records of
Orange County, !California; and The East 377.00 feet
of the South 3~4.82 feet of Lot 9 of the Orangewood
Tract as per M~ recorded in Book 7 page 42 of Mis-
cellaneous Maps and the East 165.00 feet of the
Southerly 220.QO feet of Lot 10 of the Orangewood
Tract as per M~p recorded in Book 7 page 42 of Mis-
cellaneous Mapa; and The South 22.0 feet of the West
165 feet of thet East 495 feet of Lot 10 of Orange-
wood Tract, as ishown on a map recorded in book 7,
page 42 of MisQellaneous Maps, records of Orange
County, Califorlniaj and

WHEREAS, the City Planning Commission did hold a public
hearing upon said application at the City Hall in the City of
Anaheim, notices of which public hearing were duly given as re-
quired by law and th~ provisions of Title 18, Chapter 18.03 of the
Anaheim Municipal Co~e, and
~, WHEREAS, s.id Commission, after due inspection, investi-
gation and studies m.de by itself and in its behalf and after due
consideration of all'evidence and reports offered at said hearing,
did adopt its Resolu~ion No. f~l~-161:), granting
Conditional Use permjt No. --1 , and
MIEREAS, t~ereafter, within the time prescribed by law,
an interested party ~r the City Council, on its own motion, caused
the review of said P~anning Commission action at a duly noticed
public hearing, and
WHEREAS, at the time and place fixed for said public
hearing, the City Co~ncil did duly hold and conduct such hearing
and did give all per,ons interested therein an opportunity to be
heard and did receiv. evidence and reports, and
WHEREAS, =e City Council finds, after careful consider-
ation of the recomme.dations of the City Planning Commission and
all evidence and re ,rts offered at said hearing, that:
1. The propostd use is properly one for which a conditional
use permit is author. zed by the Anaheim Municipal Code.
2. The propos.d use will not adversely affect the adjoining
land uses and the gr~wth and development of the area in which it
is proposed to be lo~ated.
3. The size a:d shape of the site proposed for the use is
adequate to allow th full development of the proposed use in a
manner not detriment_I to the particular,area nor to the peace,
health, safety and g.neral welfare.
4. The traffi~ generated by the proposed use will not im-
pose an undue burden: upon the streets and highways designed and
i~roved to carry th. traffic in the area.

5. The grantiI9 of the conditional use permit under the
conditions imposed w 11 not be detrimental to the peace, health,
safety and general w lfare of the citizens of the City of Anaheim.
NOW, THERE'ORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commission
granting satd conditional use permit be, and the same is
hereby, ~ an~ that Conditional Use Permit No. lRhh be,
and the ~ere~y, granted permitting a 36-unit Planned Unit
Development on the atoredescribed property with a waiver of the
following section of the Anaheim Municipal Code:

Said Conditional Us~ Permit No. 1866 is granted subJect to the
following condition$:
1. That this ,Conditional Use Permit is granted subject to
the completion of R,classification No. 78-79-6, now pending.
2. That the ~wners of sUbJect property -shall pay the traf-
fic signal assessmeJ/lt fee (C<i>uncil Policy No. 21.4) amounting to
$36.00 per each newtdwelling unit prior to the issuance of a build-
ing permit.
3. That subj~ct property shall be developed substantially in
accordance with plaIjls and specifications on file with the City of
Anaheim marked Exhiijit Nos. 1 through 4.
4. Prior to ~he issuance of a building permit, covenants,
conditions and rest*ictionsshall be submitted to and approved by
the City Attoraey's!Qffice, that said CC&R's shalloinclude a pro-
vision for the perm~nent maintenance of the landscaped area adja-
cent to Simmons Avetl1uej and, further, that the CC&R's shall be
recorded in the office of the Orange County Recorder.
BE IT FUR1'HER RESOLVED that the City Council hereby
reserves the right ~o revoke such Conditional Use Permit for
good cause or failUJre of said owners, their heirs, successors
or assigns to comply with the Anaheim Municipal Code and regula-
tions and the conditions therein.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 5th day of September,
1978.
