all utilities and Itransportation, including power, fuel
and water, and pe~forming all work necessary to construct
and complete in a ;good and workmanlike manner, in strict
accordance with t~e specifications, plans and drawings
therefor on file ~n the Office of the City Engineer or
City Clerk of the 'City of Anaheim, the following public
improvement, to wtt:

of Anaheim, consi ing of the removal of P.C.C. and

of said public improv+ment on file in the Office of the City

WHEREAS, said inotice inviting sealed proposals for said
public' improvement diq provide that sealed proposals would be
received by the City qf Anaheim at the Office of the City Clerk
of the City of Anahei~ up to the hour of 2:00 o'clock P.M. on
the 27th day of Jul' ,1978 ,for the furnishing
of all plant, labor, erV1.ces, materiaISand equipment, all
.....-... utilities and transpo tation, including power, fuel and water,
and performing all wo~k necessary to construct and complete in
a good and workmanlik~ manner, the public improvement herein-
above more particular]y mentioned and described, and which
notice did state and 4ec1are that pursuant to the provisions
of Section 1770 of th~ Labor Code, the City Council of the City
of Apaheim had ascert~ined the prevailing rate of wages in the
loca,lity in which thi~ type of labor is to be performed for
each craft or type of1workman or mechanic needed to execute the
contract, and which w~ge scale is on file in the Offices of the
City Clerk and City E~gineer; and
WHEREAS, the qity Clerk of the City of Anaheim did
receiive the following isealed proposals prior to 2: 00 0' clock
P.M. on the 27th da)f of Ju1v ,l978 ,in
response to the notic~ aforesaid inviting sealed proposals,

AND WHEREAS, ~he City Engineer did thereupon examine
and tabulate said seated proposals and did report to the City
Council the result of.. his examination and tabulation; and

of the City Clerk o~ the City of Anaheim, the public improvement
hereinabove mention~d and described, together with the appurten-
ances thereto, and ~s specified in the notice inviting sealed
proposals, and that said proposal of said above-named bidder
should be accepted ~nd a contract awarded to said bidder in
accordance therewit~; and
WHEREAS, th~ City Council finds that the above-mentioned
sealed proposal is ~he lowest responsible proposal received and
that the person, fi~ or corporation submitting said proposal
is a responsible pe~son, firm or corporation and that the pro-
posal submitted is the best suited and fitted for the public
improvement to be cpnstructed.
NOW, THEREFbRE, BE IT RESOLVED by the City Council of
the City of Anahei~ that the sealed proposal submitted by said
contractor for the !furnishing of all plant, labor, services,
materials and equip~ent, all utilities and transportation,
including power, f~l and water, and performing all work
necessary to construct and complete, in a good and workmanlike
manner, in strict ~cordance with the specifications, plans and
drawings therefor OP file in the Office of the City Clerk of the
City of Anaheim~nd the notice invitinp; sealed proposals, the
public works and i~rovement hereinabove more particularly men-
tioned and describ~, together with the appurtenances thereto,
be, and the same is: hereby,. accepted, and that a contract for the
construction and cQmpletion of said public improvement be, and
the same is hereby, awarded to the said above-named bidder.

AND BE IT FURTHER RESOLVED that the successful bidLer
or bidders upon eaqh contract awarded as hereinabove set forth,
shall be, and they :are hereby required to execute a contract in
the required form .Jith the City of Anaheim upon the terms and
conditions specifiejd in the notice inviting sealed proposals and
the proposal submitted by said successful bidder or bidders ann
in accordance with the plans and specifications for said pUl;lic
improvement hereinabove described, and in accordance with the
terms, conditions ~d provisions of this resolution, and that
said successful bidder or bidders to whom each contract is awarded
shall be required to furnish a surety bond in an amount equal to
one hundred per cent (IOO%) of the contract price for all labor,
materials and equipment to be furnished and performed, as set
forth in the sealed proposal sub~itted by said bidder for the
construction of said public improvement, together with the appur-
tenances thereto or such portion thereof as is covered by said
contract, as security for the faithful performance of said contract,
and a separate surety bond in an amount equal to one hundred per
cent (IOO%) of the construction cost of said public improvement
covered by said contract, as security for the payment of all
persons performing labor and furnishing material for said project.

AND BE IT FURTHER RESOLVED that said successful hidder
or bidders be, and ~ey are hereby, required to furnished to the
City of Anaheim in ~ompanies satisfactory to the City of Ana~eim,
public liability, pnoperty damage, compensation, and other insur-
ance in the amounts .and for the purposes set forth and specified
in the notice invit~ng sealed proposals, and subject to the
approval of the City Attorney as to form and sufficiency.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, authorized
and directed to mak~, execute and enter into, for and on behalf
of the City of Anah~m, a written contract with said successful
bidder or bidders f~ the furnishing of all plant, labor, mater-
ials, and equipment !Bind performing all work, as hereinabove more
particularly describ~, for the construction, installation and
completion of said p~lic improvement hereinahove described upon
the terms and condit~ons as specified in the notice inviting
sealed proposals, the detailed design, plans, profiles, drawings
and general specifications and detailed specifications and draw-
ings, and all addenda thereto, and all modifications incorporated
therein prior to the date of the opening of bids, on file in the
Office of the City C~erk of the City of Anaheim and in strict
accordance with the terms, conditions and provisions of this reso-
lution, and in accorBance with all of the contract documents herein
specified.
THE FOREGOING RESOLUTION is approved and adopted bv the
City Council of the City of Anaheim this 8th day of AURust ,
