RESOLUTION NO. 78R- 796
A RESOLUTION OF' THE CITY COUNCIL OF THE CITY OF ANAHEIM,
CALIFORNIA, DE~NG THE RESULT OF THE CANVASS OF
ELECTION RETU OF SPECIAL MUNICIPAL ELECTION HELD IN
SAID CITY ON N ER 7, 1978.
The City Counc~l of the City of Anaheim, California, DOES HEREBY
RESOLVE, DETERMINE AND O~ER as follows:
Section 1. Th~t a special municipal election was duly called
and regularly held in sa:ijd city on the 7th day of November, 1978, at which
election there were sub~tted to the qualified voters of said city the
following propositions, t!o wit:
PROPOSITION "B'1

Shall seCtiOns 500, 507, 508 and 511 of the Charter of
the City of An eim be amended to increase the number of City
Council member from five to seven, and make other numerical
changes consis. ent therewith, effective with the general
municipal elec.ion to be held in April, 19807
PROPOSITION "C'

Shall Sec~ion 504 of the Charter of the City of Anaheim
be amended to trovide for the annual election of the Mayor by
the City Counc 1 at the first regular meeting of the City Council
after the seco"d Tuesday in April of each year commencing in
April, 19807
PROPOSITION liD!'

Shall Section 515 of the Charter of the City of Anaheim be
amended to pertm.t the prosecution of certain designated Anaheim
Municipal Code! violations as infractions rather than misdemeanors?
PROPOSITION liE"

Shall Secition 703 of the Charter of the City of Anaheim be
amended to reqUire the City Attorney to perform legal functions
and duties inqidental to the execution of other powers and duties
as prescribed by the Charter; to surrender all books, papers, files
and documents pertaining to the City's business to the successor
City Attorney;! and authorize the City Council to control all legal
business and e$mploy other attorneys as may be required to perform
the City busi~ess?

PROPOSITION "F"

Shall Sec4ions 1202 and l203 of the Charter of the City
of Anaheim be 4mended to (I) require the City Manager to
submit the pro~osed annual budget to the City Council at
least sixty da~s prior to the beginning of each fiscal year,
and (2) requir4 the City Council to hold a public hearing on
the proposed b4dget at least forty-five days prior to the
adoption of th~ annual budget?
PROPOSI TION "G'~

Shall Sec4ion 1211 of the Charter of the City ,of Anaheim
be amended to 41) permit public works projects ,of less than
Fifty Thousand I Dollars in cost to be performed by City employees
without pub1ic!bidding where the City Council determines that
such work can ije performed better or more economically by City
forces than by I private contract, and (2) permit the City Council
to establish aiprocedure by ordinance for the procurement of
materials, supflies and equipment to be used in public works
projects?
PROPOSITION ' "H'~
Shall Section 1222 be added to the Charter of the City of
Anaheim to req,ire any sale or conveyance of municipal property
of a value in txcessof Fifty Thousand Dollars to be publicly
advertised and: sold only to the highes t bidder unless the City
Council finds, 'by at least a two-thirds vote of its members,
that waiver of the bidding procedures is in the best interests
of the City?
Section 2. Th.t the returns of said election have been duly and
regularly canvassed by t~e Registrar of Voters as provided by law, and all
absentee ballots, if any_ returned have been canvassed as provided by law.
Section 3. Th* total votes cast at said election for and against
said propositions and up~n said propositions are all as shown on the Certif-
icate of Registrar of voters to Result of the Canvass of the General Election
Returns, attached hereto 'as "Exhibit A."
Section 4. Th.t the votes of less than fifty percent of all the
voters voting at said el+ction upon Proposition "B" and Proposition "c" were
cast in favor of the adottion of said Proposition liB II and Proposition"C", and
said Proposition "B" andisaid Proposition "c" are hereby declared to have
failed to carry at said tlection.

Section 5. Th4lt the votes of more than fifty percent of all the
voters voting at said e1~ction upon Proposition "D", Proposition "E",
Proposition "F", Proposi~ion "G" and Proposition "H"were cast in favor of
the adoption of said protositions, and said propositions are hereby declared
to have carried at said tlection.

Section 6. Th~t the City Clerk of this City is hereby directed
to enter this resolution! in full in the minutes of this City Council, which
entry shall constitute the City Clerk's statement of the result of the
election.
THE FOREGOING RESOLUTION is approved and signed by me this 12 th
day of December, 1978.
