A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAiI~IM URGI)lG THAT THE STATE HISTORIC
RESOURt~S COMMI$SION BE REQUIRED TO GIVE
ADEQUAtE NOTICE, OF COMMISSION PROCEEDINGS TO
LOCAL ~OVERNMENTAL AGENCIES AND TO FORMULATE
SPECIFIC GUIDELtNES FOR STRUCTURES TO BE
RECOMMENDED FOR INCLUSION ON THE NATIONAL
REGISTtR OF HISTORIC PLACES.
WHEREA$. the St$.te Historic Resources Connniss1on is
authorized to ret!ew and tecommend inclusion of structures on
the National Red$ter of lIistoric Places and to hold publ1.c
hearings to consider indiYidual structures and districts; and
WHEREAS, said C<I>nnnission has procee,ded to reconnnend
certain structurEt$ for inelusion on the National Register
without giving a4.quate n~tice of said public hearlngsto either
property owners or local governmental agencies; and
WHEREAS, said n<l>tice, when given, has not permitted
sufficient time :1n which to seek independent analysis of
structures and d1$tricts nominated for inclusion; and
WHEREAS, said notice, when given, has not included
the Application t()r IncluSion of Structures on the National
Register of HistQJfic Places, thus making proper response to
said notice diff~~ult; and
WHEREAa, said Connnission proceeds on the basis of
guidelines which are so vague as to be none xi sten.t for the pur-
pose of evaluating individual structures or buildings;' and
WHEREAS, said guidelines of theConnnission do not
precisely define what historic or architectural significance
means; and

WHEREAS, the policies adopted by the Commission on
July 7, 1978, welfe ignoreq and not used in the 'proceedings
involving the City of Anaheim; and
WHEREAS, said Connnission is acting at cross-purposes
with State Policy on low ~nd moderate income housing and the
revitalization of deterioI'ated areas; and
WHEREAS, said Connnission has proceeded to recommend
certain structur~s for inqlusion after public hearings at which
no competent evidence has been presented justifying such
designation; and

WHEREAS, said Commission has procee.ded in an arbitrary
and capricious manner without regard to ev1.dence presented
concerning individual structures or the poten.tial adverse effect
of inclusion upon local economic and governmental designations;
and
WHEREAS, said Commission provides no guarantee that
funds are availabl~for the proper preservation of structures
recommended for inclusion on the National Register of Historic
Places; and
WHEREAS,. said Commission has failed to prepare or
consider any environmental impact of a reconnnendation for
inclusion of a sttucture or district, as required by the
California Envirol'ltnental QUality Act; and
WHEREAS, the Commission has failed to prepare findings
of fact to just1f,. inclusict>n of structures on the Regist'er; and
WHEREAS, the recq>rd does not contain evidence to
support :such incl....$ion, and on the basis of all of the above,
the AnaheiIn Redev~lopmentCommission rejected theConnnission's
3 to 2 findingsot its September 1, 1978, Hearing in Los Angeles.
NOW, THBlREFORE, BE IT RESOLVED as follows:
1. That the Sta,.te Historic Resources, Commission be
urged to: declare ItGratoriUIts on District and Multiple Resources
applicat.1ons retrQa,.ctiveto JUly 7, 1978, the date of the
Commission' sadop~d POlicy, and include the City of Anahe'im
because of the many irregularities in the applicat.1on and in the
Hearing procedurea.
2. That the State Hist'oric Resources Connnission be
required to gi veCidequate notice of not less than sixty (60)
days of its consideration of any structure nominated for inclu-
sion on the National Register, including copy of application,
to the local govemmental entity in which said structure is
located and obtain prior approval of said local governmental
entity. for inclusion of said structures on the National Register.

3. That the Commission prepare written findings of
fact, based upon competent :evidence contained in the record,to
support theConnnisB:ion's determination to include any structure.
4. That the Commission prepare and adopt specific
gUidelines by which to measure individual nominations for
inclusion, including guidelines that precisely define what
historic and architectural significance means.
5. ThattheConuniss1on verify the authority of the
person or persons Making an application on behalf of a group or
organization.

6. That the Conunission guarantee that funds will be
available for the proper preservation of structuresreconnnended
for inclusion on the National Register of Historic Places.

BE IT FU):1THER RE~OLVED that the City Clerk of the City
of Anaheim is her~by directed to forward copies 'of this
Resolution to the State Hi$toric Resources Conunission, the State
Historic Preservation Officer, the Office of the Governor, the
State Department of Parks and the National Park Services,
Department of Int~rior.
THE FOJU;GOING RE~OLUTION is approved and adopted by
the City Councilor the City of Anaheim this 17th day of
October , 1978.
