A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM MAKING CERTAIN FINDINGS AND
DETERMINATIONS WITH RESPECT TO THE CONSTRUCTION
AND INSTALLATION OF TRAFFIC SIGNAL INTERCONNECT
CABLE AND APPROVING AND AUTHORIZING THE EXECU-
TION OF AN AGREEMENT THEREFOR WITH STORER CABLE
T.V.
WHEREAS, the City has granted a franchise to Storer
for the installation of a cable television system in the City
of Anaheim; and
WHEREAS, it is necessary for Storer Cable T.V. to
excavate certain properties throughout the City for the
installation of its cable television system; and
WHEREAS, it is necessary for the City to install
traffic signal interconnect cable in certain areas of the
City; and
WHEREAS, it is feasible to install the traffic signal
interconnect cable in the same excavation as Storer presently
is installing its cable television system; and
WHEREAS, there is a need for speed and economy of
installation of the traffic signal interconnect cable; and
WHEREAS, the City of Anaheim is satisfied that only
Storer can meet the need of the City for speed of construction,
lower cost, and minimum disruption to traffic flow and the
greater safety needs of the citizens of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council
as follows:
Section 1. The City Council of the City of Anaheim
finds and determines that the need exists for the installation
of traffic signal interconnect cable in the City of Anaheim.
Section 2. The City Council of City of Anaheim finds
and determines that:
1. The normal public bidding process required for
this Agreement would be useless because no other company
already has excavation in process at no cost to City
which will accept the traffic signal interconnect cable
installation needed by the City.

2. The use of the competitive bidding process
would work an incongruity and would not effect the
final result, produce no advantage, and would be
undesirable and practically impossible and result in a
waste of taxpayers' money in the City of Anaheim.
3. The use of Storer's excavation for this
project will meet the needs of the City for speed of
construction, lower cost, traffic flow and public
safety.
4. Based upon these facts, the City proposes to
enter into a contract with Storer Cable T.V. for the
installation of the City's traffic signal interconnect
cable.
BE IT FURTHER RESOLVED that a form of Agreement,
the terms and conditions of which are acceptable to the City
has been this day submitted, and is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City
Clerk are authorized to execute said Agreement for and on
behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this 15th day of
July, 1980.
