RESOLUTION NO. 80 R- 106
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM CALLING AND GIVING NOTICE OF THE HOLDING
OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN
SAID CITY ON TUESDAY, THE 3RD DAY OF JUNE, 1980,
FOR THE SUBMISSION TO THE QUALIFIED VOTERS OF
SAID CITY THE QUESTION OF THE RECALL OF CERTAIN
OFFICERS OF SAID CITY AND THE QUESTION OF FILLING
THE VACANCY OR VACANCIES IF THE RECALL PREVAILS
AS REQUIRED BY THE CHARTER OF THE CITY OF ANAHEIM
AND THE LAWS OF THE STATE OF CALIFORNIA.
WHEREAS, under the provisions of the Charter of
the City of Anaheim and the laws of the State of California,
recall petitions were filed demanding the recall of Council
Members Miriam Kaywood and E. Llewellyn Overholt, Jr.; and
WHEREAS, said petitions were signed by more than
15% of the qualified voters of the City of Anaheim; and
WHEREAS, the question of filling the vacancy or
vacancies by appointment or by special election if the recall
prevails shall also appear on the recall ballot.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ANAHEIM DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That pursuant to the requirements of
the City of Anaheim and the laws of the State of California,
there shall be and is hereby called and ordered, held in the
City of Anaheim, County of Orange, State of California, on
Tuesday, the 3rd day of June, 1980, a Special Municipal
Election of the qualified electors of said City, for the pur-
pose of submitting the question of the recall of Council
Members Miriam Kaywood and E. Llewellyn Overholt, Jr., and
the question of filling the vacancy or vacancies by appoint-
ment or by special election if the recall prevails.
SECTION 2. That on the ballots to be used at said
Municipal Election, in addition to any other matters required
by law, there shall be printed substantially the following:
INSTRUCTIONS TO VOTERS: To vote on any measure
relating to the recall of any officer, stamp a
cross (+) in the voting square after the word
"Yes" or after the word "No". To vote on the
measure relating to the filling of the vacancy
or vacancies if the recall prevails, stamp a
cross (+) in the voting square after the words
"By Appointment" or after the words "By Special
Election".

All distinguishing marks or erasures are
forbidden and make the ballot void.
If you wrongly stamp, tear or deface this
ballot, return it to the precinct board
member and obtain another.
On absent voter ballots mark a cross (+)

In addition, on the ballots to be used at said Special Election

BY SPECIAL ELECTION
SECTION 3. A cross (+) placed in the voting square
after the word "Yes" in the manner hereinbefore provided
shall be counted in favor of the recall of the officer. A
cross (+) placed in the voting square after the word "No" in
the manner hereinbefore provided shall be counted against the
recall of the officer. A cross (+) placed in the voting
square after the words "By Appointment" in the manner as here-
inbefore provided shall be counted for filling the vacancy or
vacancies by appointment and a cross (+) placed in the voting
square after the words "By Special Election" in the manner as
hereinbefore provided shall be counted for filling the
vacancy or vacancies by special election.

SECTION 4. The City Clerk of the City of Anaheim
is hereby authorized, instructed and directed to procure
and furnish any and all official ballots, notices, printed
matter and all supplies, equipment and paraphernalia that may
be necessary in order to properly and lawfully conduct said
election.
SECTION 5. That the polls for said election shall
be open at 7:00 A.M. of the day of said election and shall
remain open continuously from said time until 8:00 P.M. of
the same day, when said polls shall be closed, except as
provided in Section 14301 of the Elections Code of the State
of California.
SECTION 6. That in all particulars not recited in
this Resolution, said election shall be held and conducted as
provided by law for holding special elections in said City.
SECTION 7. That notice of the time and place of
holding said election is hereby given and the City Clerk is
hereby authorized, instructed and directed to give further or
additional notice of said election in time, form and manner
as required by law.
SECTION 8. That the City Clerk shall certify to the
passage and adoption of this Resolution; shall enter the same
in the book of original Resolutions of said City; and shall
make a minute of the passage and adoption thereof in the
records of the proceedings of the City Council of said City,
in the minutes of the meeting at which same is passed and
adopted.
SECTION 9. That this Resolution shall take effect
immed ia tely.
THE FOREGOING RESOLUTION is approved and adopted
by the City Council of the City of Anaheim this 11th day of
March, 1980.
