RESOLUTION NO. 80R-167
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AN AMENDMENT OF CONDI-
TIONS IN CONDITIONAL USE PERMIT CASE NO. 1923,
AMENDING RESOLUTION NO. 79R-597 AND REPEALING
RESOLUTIONS NO. 79R-706 AND 79R-707.
WHEREAS, the City Council of the City of Anaheim hereto-
fore adopted Resolution No. 79R-597 approving Conditional Use Permit
No. 1923, subject to certain conditions specified therein; and
WHEREAS, said conditions of approval have heretofore been
amended by Resolutions No. 79R-706 and 79R-707; and
WHEREAS, the permittee has now requested an additional
amendment of said conditions of approval; and
WHEREAS, the City Council held a duly noticed public
hearing on April 15, 1980, at which hearing the City Council did
receive and consider evidence, both oral and documentary, relating
to said request; and
WHEREAS, the City Council hereby finds and determines
that the public interest and welfare require the amendment of said
conditions of approval in the manner hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the conditions of approval heretofore imposed
in Conditional Use Permit Case No. 1923 be, and the same are hereby,
amended by the amendment of said conditions of approval as set forth
in Resolution No. 79R-597 to read as follows:
"1. That the owners of subject property shall pay the traffic
signal assessment fee (Ordinance No. 3896) difference between indus-
trial and commercial use at $150.00 per 1,000 square feet or fraction
thereof prior to the issuance of a building permit.
2. That the proposed business shall comply with all signing
requirements of the ML (Industrial, Limited) Zone.
3. That subject property shall be developed substantially in
accordance with plans and specifications on file with the City of
Anaheim marked Exhibit ~os. 1 through 3.
4. That Condition Nos. 2 and 3, above-mentioned, shall be
complied with prior to final building and zoning inspections.
5. That said business shall not be open prior to 10:00 a.m.
of any day."

BE IT FURTHER RESOLVED that, except as expressly amended
herein, Resolution No. 79R-597 shall remain in full force and effect.
BE IT FURTHER RESOLVED that Resolutions No. 79R-706 and
79R-707 be, and the same are hereby, repealed.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 15th day of April, 1980.
