RESOLUTION NO. 80R-177
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM, CALIFORNIA, ORDERING, CALLING,
PROVIDING FOR AND GIVING NOTICE OF A SPECIAL
MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON
JUNE 3, 1980, FOR THE PURPOSE OF SUBMITTING
TO THE QUALIFIED ELECTORS OF SAID CITY, A
MEASURE RELATING TO RENTAL HOUSING DEVELOPf.iENT
FOR ELDERLY, HANDICAPPED AND LOW OR MODERATE
INCOME PERSONS AND CONSOLIDATING SAID ELEC-
TION WITH THE STATEWIDE PRIMARY ELECTION TO
BE HELD ON SAID DATE.
WHEREAS, pursuant to the authority of Section 1302 of the
Charter of the City of Anaheim and Section 23302 of the Elections
Code of the State of California, the City Council of the City of
Anaheim desires to submit a certain hereinafter specified meaSute
to the electors of the City of Anaheim relating to rental housing
for elderly, handicapped, and low or moderate income persons; and
WHEREAS, the City Council desires to submit said measure
to the electors at a special municipal election to be consolidated
with the statewide primary election to be held in said City on
June 3, 1980.
NOW, THEREFORE, the City Council of the City of Anaheim,
California, does hereby resolve, declare, determine and order as
follows:
SECTION 1. That pursuant to Section 1302 of the Charter
of the City of Anaheim and Section 23302 of the Elections Code of
the State of California, it is hereby ordered that the hereinafter
specified measure be submitted to the electors at a special muni-
cipal election to be held in the City of Anaheim on June 3, 1980.
SECTION 2. That the aforesaid measure hereby submitted
to the electors of the City of Anaheim shall appear upon the ballots
for said special municipal election in the following form:

Shall rental housing developments, as contemplated
by Article 34 of the California Constitution, for
elderly, handicapped, low or moderate income
persons be developed, constructed, financed or ac-
quired in the unincorporated area of the County of
Orange and in participating cities, subject to
the following conditions:
No county or city general fund monies shall be
expended for such housing.
No project shall be authorized by authority of
this measur~ in the unincorporated area of the YES
county unless notice of any such proposed project
is first submitted to each member of the Board of
Supervisors for approval and, at the same time,
notice is given to the public.
Notice to the public shall be legal notice in the
newspaper having the greatest circulation within
the affected area where the property is located
and by posting the property in at least three (3)
conspicuous places.
Notice shall be submitted to each member of the
Board and to the public before any funding appli-
cation to a non-County entity is made for project
approval or funding. After submittal to the
Board members, any Board member shall have thirty
(30) days to place the matter on the Board agenda
.for the purpose of initiating a public hearing on
the proposed project. If the matter is so placed,
the project shall not be deemed approved until
the Board, after such public hearing, approves, or
conditionally approves, the project. If no action
is taken by a member of the Board during the
thirty (30) day period, the application, including
the project applied for, shall be considered
approved.
Any project proposed to be located in incorpora-
ted areas of the County shall be submitted to
the appropriate City Council members for action
in the s~~e manner as hereinabove described.
NO
Housing built or rehabilitated pursuant to this
measure shall not exceed 5% of the total dwell-
ing units within the unincorporated area of the
County of Orange or, for participating cities,
within the city.
A city is a participating city if the city council
adopted a resolution requesting participation in
this measure and submitted it to the Registrar of
Voters on or before March 21, 1980.

SECTION 3. That the polls for said election shall be
opened at seven o'clock A.M. of the day of said election and
shall remain open continuously from said time until eight o'clock
P.M. of the same day, when said polls shall be closed, except as
provided in Section 14301 of the Elections Code of the State of
California.
SECTION 4. That the special election hereby called
for the date hereinbefore specified shall be, and is hereby,
ordered consolidated with the statewide primary election to be
held on said date, and within said City the precincts, polling
places and officers of election for the special municipal elec-
tion hereby called shall be the same as those provided for said
statewide primary election. The Board of Supervisors of Orange
County is hereby requested to order the consolidation of the
special municipal election hereby called with said statewide
primary election, and the Registrar of Voters of the County of
Orange is hereby authorized to canvass the returns of said muni-
cipal elections, and said elections shall be held in all respects
as if there were only one election, and only one form of ballot.
Said Registrar of Voters shall certify the results of the canvass
of the returns of said special municipal election to the City
Council of said City which shall thereafter declare the results
thereof. The measure submitted by this resolution shall be desig-
nated on the ballot by a letter printed on the left margin of
the square containing the description of the measure, as pro-
vided in Section 10219 of the Elections Code.
SECTION 5. That notice of the time and place of holding
said election is hereby given and the City Clerk is hereby auth-
orized, instructed and directed to give such further or additional
notice of said election in time, form and manner as required by
law.
SECTION 6. That the City Clerk shall certify to the
passage and adoption of this Resolution; shall enter the same in
the book of orginial Resolutions of said City; and shall make a
minute of the passage and adoption thereof in the records of the
proceedings of the City Council of said City, in the minutes of
the meeting at which the same is passed and adopted.
SECTION 7. That this Resolution shall take effect
immediately.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 22nd day of April, 1980.
