80R-213 RESOLUTION NO. 80R-213 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM SUPPORTING H.R. 6466 TO AMEND THE CLEAN AIR ACT RELATING TO ANNUAL MANDATORY VEHICLE INSPECTION AND MAINTENANCE. WHEREAS, the Federal Environmental Protection Agency has interpreted the Clean Air Act of 1977 to require an annual mandatory vehicle inspection and maintenance program in California; and WHEREAS, federal sanctions are currently in effect in California, denying construction permits for new industrial facili- ties emitting 100 tons of pollutants annually; and WHEREAS, the Environmental Protection Agency has announced it will invoke further sanctions in California by withholding waste water construction funds and federal highway funds; and WHEREAS, no conclusive evidence has been offered demon- strating that an annual mandatory vehicle inspection and maintenance program would be cost-effective in achieving ambient air quality standards; and WHEREAS, the United States Congress is currently consider- ing a measure which would return authority to the states to determine whether a state desires to include within its air quality plan a program of mandatory annual vehicle inspection and maintenance; and WHEREAS, H.R. 6466 by Congressmen Satterfield, Dannemeyer, and others is currently before the Interstate and Foreign Commerce Subcommittee on Health and Environment in the House of Representatives; and WHEREAS, enactment of H.R. 6466 would provide the California Legislature with additional time within which to properly evaluate the cost-effectiveness of a mandatory vehicle inspection and mainten- ance program. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Anaheim urges the early enactment of H.R. 6466 to ensure that California's motorists will not be subjected to an annual man- datory inspection and maintenance program that is not cost-effective nor necessary to assure improvement of the state's air quality; and BE IT FURTHER RESOLVED, that enactment of H.R. 6466 will improve California's economy avoiding imposition of additional sanc- tions in California, and eliminating sanctions which are currently imposed; and -1- BE IT fURTHER RESOLVED that copies of this resolution be provided to the House Interstate and Foreign Commerce Committee, to Congressmen David E. Satterfield, William E. Dannemeyer, and to State Senator John Briggs, and Assemblyman Ross Johnson. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 13th day of May, 1980.
