RESOLUTION NO. 86R- 350
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING
RATES, RULES AND REGULATIONS FOR THE SALE AND DISTRIBUTION OF WATER
AS ADOPTED BY RESOLUTION NO. 72R-600 AND AMENDED BY RESOLUTION NOS.
73R-255, 73R-387, 73R-532, 74R-433, 75R-315, 75R-469, 75R-479,
76R-378, 78R-4l8, 78R-4l9, 78R-459, 79R-643, 80R-304, 8lR-124,
81R-402, 82R-355, 83R-33l, 84R-246 and 86R-118.
WHEREAS, the City of Anaheim maintains a water distribution system
for the furnishing of water to residents and inhabitants of the City of
Anaheim and has adopted Water Rates, Rules and Regulations for the sale and
distribution of water; and
WHEREAS, it is the policy of the City Council that Anaheim's Water
Utility shall be self-supporting from charges made by the City for water
furnished to consumers and for services rendered in connection therewith; and
WHEREAS, the Public Utilities Board held a public hearing on June 19
and July 17, 1986 and evidence was presented in connection with the proposed
revisions of water rates and fees; and
WHEREAS, the Public Utilities Board considered the California
Environmental Quality Act and made the following findings:
1. The largest single expenditure category during the test period of July
1, 1986 through June 30, 1987 is water supply at an estimated
$8,066,000.
2. Other operating expenses and capital expenditures estimated to cost
$7,772,000 are due to labor cost increases and higher material costs.
3. Debt service requirements and an increase in reserve amounts estimated
to cost $2,254,000 are required to meet financial reserves and
requirements.
4. The transfer to the general fund in an amount estimated to be $694,000
is authorized by the City Charter and constitutes an Intra-City
transfer.
5. The increase in working capital of $303,000 is required to meet the
utilities cash requirements.
6. The fee increases for temporary service, service connections, meter
installations, inspection services, plan check services, and primary
distribution main extensions are due to labor cost increases and
higher material costs.
7. The matters covered in 1 through 6 above come within Section 21080 (b)
(8) of the Public Resources Code of the State of California thus the
establishment of these rates are exempt form the California
Environmental Quality Act.

WHEREAS, a Notice of Hearing was published as follows:
1. On June 3, 10 and July 7, notice of the public hearing on water rates
was published in the Anaheim Bulletin and proof thereof is on file
with the Secretary of the Public Utilities Board.
2. On June 3, 10 and July 7, notice of the public hearing on water rates
was published in the Santa Ana Register and proof thereof is on file
with the Secretary of the Public Utilities Board.
3. On June 3, 10 and July 7, notice of public hearing on water rates was
published in the Orange County Edition of the Los Angeles Times and
proof thereof is on file with the Secretary of the Public Utilities
Board.
WHEREAS, the Public Utilities Board has considered the proposal of
the Public Utilities Department and has considered the evidence presented at
the public hearing; and
WHEREAS, the Public Utilities Board has made the following findings
with respect to the need for an increase in the water rates and fees:
1. The Water System revenue requirement of the Anaheim Public Utilities
Department will be established, as set forth below, on the basis of
projections for a Test Period consisting of the twelve months July 1,
1986 through June 30, 1987.
2. A reasonable estimate of the revenue requirement for water supply
costs for the test period is $8,066,000 as shown in Exhibit MAB-l.
3. A reasonable estimate of the revenue requirement for other operating
expenses for the test period is $5,524,000 as shown in Exhibit MAB-l.
4. A reasonable estimate of the revenue requirement for capital
expenditures for the test period is $2,248,000.
5. A reasonable estimate of the revenue requirement for debt service and
reserve increases for the test period is $2,254,000.
6. A reasonable estimate of the revenue requirement for transfer to the
General Fund for the test period is $694,000 as shown in Exhibit NAB-I.
7. A reasonable estimate of the revenue requirement for working capital
increase to meet the utilitites cash requirements is $303,000 as shown
in Exhibit MAB-l.
8. A reasonable estimate of the revenue requirement offsets due to other
water revenues and interest income for the test period is $813,000 as
shown in Exhibit MAB-l.

10. It is appropriate to perform a cost-of-service study in order to
determine the allocated revenue requirement for the test period for
the following customer classes: Single-Family Residential;
Multi-Family Residential; Residential Outside City;
Commercial/Industrial; Municipal; Irrigation; and Private Firelines.
11. The customer class revenue requirements as determined on the basis of
a cost-of-service analysis are shown in Exhibit BGT-2 and are
appropriate. The estimated total allocated annualized revenue
requirement of $18,276,000 as set forth below is appropriate.

12. Section l22l of the City Charter provides that utility rates charged
to a class of consumers shall be uniform within the class and shall be
based on cost of service for the class.
13. On the basis of the preceding finding, the class revenues under the
proposed rates as shown in Exhibit BGT-1 are reasonable and
appropriate:

14. It is appropriate to establish a Water Capital Replacement Fund which
will be funded by revenues from the sale of water.
15. It is appropriate in the initial years to partially fund the Water
Capital Replacement Fund with proceeds from the sale of short-term
Revenue Anticipation Notes.
16. A reasonable estimate for installing service laterals and meter boxes
is shown in Exhibit ELM-I.
17. A reasonable estimate for installing meters is shown in Exhibit ELM-I.
18. A reasonable estimate of acreage fees is shown in exhibit ELM-I.
WHEREAS, based on the findings hereinabove made, the Public
Utilities Board of the City of Anaheim recommends to the City Council that the
Council adopt the findings of the Public Utilities Board with respect to the
matters contained herein and adopt the water rates and fees shown in Exhibit
BGT-6 and Exhibit ELM-5.
WHEREAS, the City Council has considered the evidence and concurs
with the findings of the Public Utilities Board as set forth hereinabove.
NOW, THEREFORE BE IT RESOLVED that the findings of the Public
Utilities Board be, and they are hereby, adopted by the City Council of the
City of Anaheim.
NOW, THEREFORE BE IT FURTHER RESOLVED that based on the findings
hereinabove made and adopted, the budget for fiscal year 1996-97 should be
modified as follows:

horsepower and KWH consumption for each well pump and the La Palma and
Linda Vista Booster pumps for the fiscal year just completed. This

the Operations Division and shall be adjusted for any electrical energy
displaced by use of natural gas or diesel fuel.

C. HIGH ELEVATION PUMPING COSTS
The high elevation pumping costs shall include all the energy costs of
all pumps required to serve the high elevation area only. The
electrical costs will be based on recorded data for the most recent
l2-month period or, after expansion of the high elevation pumping
system has stabilized, may be based on the most recent fiscal year, if
appropriate. The electric rate used will be that rate which will be in
effect whenever the high elevation pumping surcharge amount is changed.
D. AMOUNT OF HIGH ELEVATION ADJUSTMENT
1) The pumping surcharge cost per A.F. is computed by first dividing
the total high elevation pumping costs by the A.F. of water pumped
in the high elevation area as indicated by the following example
for July 1, 1980:
$101,358 divided by 2,140 A.F. = $47.36 per A.F.
The A.F. of water pumped is estimated from the lOa's of cubic feet
sold in the high elevation area.

increased cost of water shall be rounded to the nearest mill per 100
cubic feet and added to the commodity charge for each rate block of
each water schedule rate charge.
The 22 percent Special Facilities Surcharge defined in Rule No. 15,

Spacer Connections:
For tract developments requiring two inches or smaller meters, spacer
connections may be provided for the purpose of eliminating damage to
permanent meters during the grading of parkways, and for pressure testing
of plumbing. The rate shall be 53.80 per month for a single-family unit
and an additional charge of $0.75 will be made for each unit in excess of
one.
SPECIAL CONDITIONS
A. Rates A and B of this schedule are subject to Schedules W-CA, W-PS and
rules and regulations of the Utility.
B. For Rate A of this schedule, the permit holders are required to submit
meter readings of the temporary meters on a monthly basis on forms
provided by the Utility. If the forms are not returned within 10 days
from the date sent and it becomes necessary that a Utility inspector
obtain meter readings at the job site, an additional $15.50 fee will be
applied.

Temporary Service: Service for enterprises or activities which are
temporary in character, or where it is known in advance that
service will be of limited duration. Service, which in the
opinion of the Utility, is for operations of a speculative
character or the permanency of which has not been
established, also is considered temporary service.
Tract or Subdivision: An area which may be identified by filed sub-
division plans or as an area in which a group of dwellings
may be constructed about the same time, either by a large
scale builder or by several builders working on a
coordinated basis.
General Manager: General Manager, Public Utilities Department, City
of Anaheim.
Utility: The City of Anaheim - Public Utilities Department
Utility's Operating Convenience: The term refers to the utilization,
under certain circumstances, of facilities or practices not
ordinarily employed which contribute to the over-all
efficiency of the Utility's operations; it does not refer to
customer convenience nor to the use of facilities or
adoption of practices required to comply with applicable
laws, ordinances, rules or regulations, or similar
requirements of public authorities.
East Santa Ana Canyon Area: That portion of land which is subject to
terminal reservoir storage fees and transmission main fees
as provided for in Rule l5-C of the Water Rates, Rules and
Regulations.

APPLICATION FOR SERVICE
A. APPLICATION FOR SERVICE
Each applicant for utility service may be required to sign an application
on a form provided by the Utility and, upon request, will be required to
furnish the following information:
1. Name of applicant.
2. Date and place of application.
3. Location of premises to be served.
4. Date applicant will be ready for service.
5. Whether the premises have been heretofore supplied.
6. Purpose for which service is to be used.
7. Customer's mailing address.
8. Whether applicant is owner or tenant of, or agent for, the premises.
9. Rate schedule desired if optional rate is available.
10. Information to establish credit of applicant.
11. Such other information as the Utility may reasonably requ~re.
The above information may be supplied by the applicant either in
writing or by telephone if the applicant's signature is not required.
An application for water service shall be required for each
individual connection to the public water system. A single application
for water service may include more than one connection to the public water
system when all connections are made at the same relative time as part of
a single development under single ownership. The owner of a single
development which is constructed in phases shall complete at least one
application per phase of development.
The application is a request for service and does not in itself bind
the Utility to serve except under its filed tariff schedules, nor does it
bind the customer to take service for a longer period than the minimum
requirements of the rate schedule.
B. INDIVIDUAL LIABILITY FOR JOINT SERVICE
Two or more persons who join in one application or contract for serv~ce
shall be jointly and severally liable thereunder and shall be billed by
means of a single periodic bill mailed to the person designated on the
application to receive the bill.
C. CHANGE IN CUSTOMER'S EQUIPMENT OR OPERATIONS
Customers shall give the Utility written notice of the extent and nature
of any material change in the size or character of the plumbing, equipment
or operations for which the Utility is supplying service before making any
such change.

TEMPORARY SERVICE
A. CONDITIONS OF SERVICE
The City shall, if no undue hardship to its existing customers will result
therefrom, furnish temporary service for construction work, circuses,
Christmas tree lots, bazaars, fairs, plumbing pressure testing, or other
similar uses, that because of their nature will not be used steadily or
permanently. All such services shall be subject to the following
conditions:
1. Application for temporary service with appropriate deposit shall be
made to the Utility. The deposits for temporary service shall be
refunded after charges for permits, water consumption, loss or damage
of meter and fittings, and installation and removal charges have been
deducted at the termination of service.
2. Temporary service connections may be terminated at any time, and will
be made at the discretion of the Utility.
3. Charges for loss or damage to meter and fittings will be based upon
current prices.
4.
Temporary services shall generally be taken from existing outlets

4. Primary Distribution Mains
a. Primary Distribution Mains which supply water to all areas of the
system shall be paid for by acreage fees assessed on all
properties in the system except those properties excluded in (1)
above. The fees will be based upon gross acreage served by
domestic water service and/or fire protection, and will be due
prior to signature approval of the final water improvement plans
by the Water Engineering Manager. This does not apply to
application for temporary or irrigation service. The water main
extension fees shall be $2,120.00 per acre.
This above fees will be calculated to the nearest one hundredth
(.01) acre.
Public-owned facilities such as freeways, flood control channels,
and water spreading basins may not be required to pay the water
main extension fees if water service for these properties is not
required. If a portion of these facilities require water service,
the water main extension fees shall be paid on that portion
requiring service.
b. When a Primary Distribution ma~n must be extended to a new
subdivision or development, the Utility will extend the main up to
five hundred (500) feet. If an extension greater than 500 feet is.
required, the developer will pay for the extension that is in
excess of 500 feet, in addition to the normal water main extension
fees. The developer's portion of the cost shall be reimbursed to
him without interest as acreage fees are collected from others
connecting to the extended main within a refund area de~ignated by
the Utility at the time the advance is made. The reimbursement
agreement shall be in effect for a period of ten (10) years. In
no case shall the reimbursement exceed the developer's cost of the
extension.

If the Utility requires a main larger than that required to serve
a new development, the developer will only pay the cost of the
size required to serve his property (minimum of 8-inch for
residential, lO-inch for commercial, and l2-inch for industrial).
c. Normal practice of the Utility is to extend all Primary
Distribution Mains. In unusual circumstances, the applicant for
water service, who requires Primary Distribution Mains, may be
permitted, if qualified in the judgment of the Utility, to
construct and install the mains himself, or arrange for their
installation pursuant to competitive bidding procedures initiated
by him and limited to contractors who possess a current California
Contractor's License permitting them to do this type of
construction work.
The cost, including the cost of inspection and superV1S1on by the
Utility, shall be paid directly by the applicant. The applicant
shall provide the Utility with a statement of actual construction
cost in reasonable detail. The installation shall be in
accordance with the plans and specifications prepared by the
Utility.
For purposes of making any reimbursement to applicant or crediting
applicant with payment of water fees the cost of the main
extension made by applicant shall be deemed to be the lesser of
(1) the actual cost or (2) the utilities per foot cost of water
ma1ns used in determining the water main extension fees.
d. A map dated June 21, 1984 showing the Primary Distribution Mains
is included with the Rules and Regulations.

5. Secondary Distribution System
The secondary Distribution System will be paid for and installed by
the owners or developers of the property that the system serves.
The Secondary Distribution System shall be subject to all the terms
and conditions contained in the Water Utility's Rates, Rules and
Regulations. The Secondary Distribution System shall be designed and
constructed in strict conformance with the Water Engineering
Division's STANDARD SPECIFICATIONS FOR THE CONSTRUCTION OF DOMESTIC
WATER SYSTEMS, latest revision, and shall be subject to inspection by
the Water Utility's designated representative, during construction.
a. Prior to signature approval of the Secondary Distribution System
plans by the Water Engineering Manager, the owner shall submit to
the City an irrevocable offer for rights-of-way dedication as may
be deemed necessary by the Water Utility for op'eration and
maintenance of the Secondary Distribution System, together with a
current title report showing the legal owners of the property
offering the dedication to the City.
b. Where a Secondary Distribution System must be extended to a new
subdivision or development, the system shall be paid for and
installed by the developer of the property to which the system is
extended. If, under this rule, a developer is required to extend
a system, which will later serve additional property, the Utility
shall collect and return to the developer the proportionate cost
of the system serving the additional property, if and when such
property is developed.
c. The Utility may extend portions of the Secondary Distribution
System prior to development at its cost provided these extensions
are considered to be in the best interests of the Utility. The
costs for any such extensions shall be reimbursed to the Utility
by the owners or developers of the property served by these
extensions when these properties are developed, or application for
water service is made.

d. Where half streets are developed, the developer of the half street
shall be required to pay for and install any portion of the
Secondary Distribution System that is required by the Utility.
The proportionate share of the main's cost shall be collected by
the Utility from the owner or developer of the remaining side of
the half street when it is developed. This fee shall be
reimbursed to the original developer.
6. Main Enlargements
When the Utility's existing distribution systems will not meet the
water demands of customer or developer, the customer or developer
shall be required to pay all costs associated with main replacements
and related system improvements necessary to meet water demands,
including required fire-flows as established by the City of Anaheim's
Fire Department.
7. Rights-Of-Way
All rights of way required by the Water Utility for operation and
maintenance of the secondary water system, which are not a part of the
recorded tract or parcel map shall be due prior to signature approval
of the Water System Improvement plans by the Water Engineering
Manager. All rights-of-way shall be offered to the City of Anaheim in.
a form acceptable to the City's Real Property Section, City Engineer's
Office, and shall consist of an irrevocable offer, a legal description
of the parcel, a plot plan and a current title report showing the
legal owner of the property offering the dedication to the City.
8. Fees
The Water Utility shall charge a fee for all labor required by Utility
personnel in support of plan checking, right-of-way acquisition,
inspection and field valve programs which are directly related to the
plan review, construction and acquisition of the Secondary System.
Plan check fees shall be due concurrently with the initial submittal
of plans to the Water Utility for review.

Fees for Utility Labor are hereby established as follows:
a. Plan Check Fee: Four Hundred Dollars ($400.00) plus Forty Cents
($0.40) per linear foot of pipe in excess of five hundred (500')
feet.
b. Construction Inspection Fee: Four Hundred Dollars ($400.00) plus
Forty Cents ($0.40) per linear foot of pipe in excess of five
hundred (500') feet.
c. Field Valve Program Fee: One Hundred and Fifty Dollars ($150.00)
plus Thirty Cents ($0.30) per linear foot of pipe in excess of

d. Right-of-Way Processing Fee: Three Hundred Dollars ($300.00) per
document submitted to the City as an easement for public utility
purposes.
e. Standard Specifications for Construction of Domestic Water
Systems. A fee of Ten Dollars ($10.00) will be charged by the
Water Engineering Division, Public Utility Department for each
copy of the Water Engineering Division's Standard Specification
for Construction of Domestic Water Systems.

A GENERAL
1. For all services, other than those where the developer is installing
the main, the Utility shall furnish and install the service
connection and meter box, after applications is made and all
applicable fees are paid.
SERVICE CONNECTIONS, METERS, AND CUSTOMER"S FACILITIES
2. In new subdivisions, and in other cases where the developer installs
the mains, the developer shall furnish and install the service
connection and meter box, and the Utility shall furnish and install
the meter.
3. The service connection, meter, and meter box will generally be
installed at a convenient location between the curb or edge of
pavement and the property line. If it is considered impractical to
install the facilities in this location, they may be installed upon
the customer's premises, in which case a casement will be required.
4. The service connection will generally determine the point of delivery
of water service to the customer.
B. SERVICE CONNECTION AND WATER METER INSTALLATION CHARGES
1. For service connections and water meter installations under (3) and
(4) below, all materials shall be furnished and installed by the
Water Division.
2. For service connections and water meter installations under (5) and
(6) below, the service connection and meter box shall be furnished
and installed by the developer in accordance with Water Division
specifications. The meter shall be furnished and installed by the
Water Division. It is intended that (5) and (6) below apply to new
subdivisions and other developments where the developer is installing
the in-tract water distribution facilities.

c. All installations in the Public right-of-way will require a
Public Right-of-Way Excavation and Construction Permit as issued
by the City of Anaheim's Engineering Department, together with
appropriate fees, deposits and insurances.
9. Increase in existing service and/or meter size.
In the event a customer is required or requests a larger service,
connection and/or meter for his property, the fees as stated in
Sections 3 and 5 above will apply. The credit value for salvaging
the meter and box will be used for the cutting and plugging of the
old service lateral.
C. CUSTOMER RESPONSIBILITY
The customer, as a condition precedent to receiving serV1ce shall:
1. Furnish and lay the necessary piping to make the connection to the
place of consumption.
2. Provide a main valve on the p1p1ng between the service connection and
the point of customer use, as per Building Department Standards.
3. Provide a bacteria clearance certificate for services 3 inch and
larger.
D. OWNERSHIP AND ABSENCE OF RENTAL OBLIGATION WHERE FACILITIES ARE ON
PREMISES OF CUSTOMER
1. The service pipe, curb stop, meter, and meter box located wholly or
partially upon a customer's premises are the property of the Utility.
2. No rent or other charge will be paid by the Utility where the
Utility-owned service facilities are located on a customer's premises.
E. ACCESS TO PREMISES OF CUSTOMER
1. The Utility shall at all reasonable hours have access to meter,
service connections and other property owned by it which may be
located on customer's premises for purposes of installation,

meter reading, maintenance, operation or removal of the property
at the time services is to be terminated. The customer's syste~
should be open for inspection at all reasonable times to
authorized representatives of the Utility.
2. Any inspection work or recommendations made by the Utility or
its agents in connection with plumbing or appliances or any use
of water on the customer's premises, either as a result of a
complaint or otherwise, will be made without charge.
F. CROSS CONNECTIONS
1. Protective Regulation
No physical connection between the potable water supply system
of the Utility and that of any other water supply will be
permitted except in compliance with the regulations of the State
Department of Public Health contained in Title 17 of the
California Administrative Code under "Regulations Relating to
Cross-Connections. "
2. Special Protective Devices Required
The Utility will require the installation of approved reduced
pressure principle type backflow protection devices under any of.
the following conditions:
a. Where a fresh water supply which has not been approved by
the State Department of Public Health is already available
from a well, spring, reservoir or other source. (If the
customer agrees to abandon this other supply and agrees to
remove all pumps and piping necessary for the utilization
of this supply, the installation of reduced pressure
principle type backflow protective devices will not be
required.)
b. Where salt water, or water otherwise polluted, is available
for industrial or fire protection purposes at the same
prem~ses.

4. Should a customer elect to have a public fire hydrant relocated,
the following conditions shall prevail:
a. A detail plan showing the proposed location of the fire
hydrant shall be submitted to the Utility for its review
and approval.
b. Customer shall pay appropriate plan check and inspection
fees as provided for in Section B.B.b., Rule No. 16 of
these Rates, Rules and Regulations.
c. All costs associated with the relocation of the fire
hydrant shall be paid by the customer.
d. The fire hydrant may be relocated by a Contractor provided
he is licensed to do this type of work and provided that
the work is performed in compliance with appropriate
permits and licenses as may be required by the City.
5. Public fire hydrants installed as a part of a main extension by
a customer shall be paid for by the customer and be subject to
reimbursement as outlined in RULE NO. 15, "Main Extensions."

BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that the
amended Water Rates, Rules and Regulations be made effective for service
rendered on and after August 1, 1986.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 29th day of July 1986.
