the City of Anaheim that a conditional zoning variance be, and the
same is hereby, granted permitting a 27-unit affordable apartment
complex on the property hereinbefore described with waivers of the
following sections of the Anaheim Municipal Code:

That said variance be granted subject to the following conditions:
1. That prior to commencement of structural framing, fire
hydrants shall be installed and charged as required and determined
to be necessary by the Chief of the Fire Department.
2. That fire sprinklers shall be installed as required by
the City Fire Marshal.
3. That the owner of subject property shall pay to the City
of Anaheim a fee for street lighting along Cypress Street in an
amount as determined by the City Council.
4. That the owner of subject property shall pay to the City
of Anaheim a fee for tree planting purposes along Cypress Street in
an amount as determined by the City Council.
5. That prior to issuance of a building permit, primary
water main fees shall be paid to the City of Anaheim, in an amount
as determined by the Office of the Utilities General Manager.
6. That the driveway shall be constructed to accommodate ten
(10) foot radius curb returns as required by the City Traffic
Engineer.
7. That subject property shall be served by underground
utilities.
8. That this Variance is granted subject to the adoption of
the Zoning Ordinance in connection with Reclassification No.
85-86-21, now pending.
9. That prior to issuance of a building permit, appropriate
park and recreation in-lieu fees shall be paid to the City of
Anaheim in an amount as determined by the City Council.
10. That prior to issuance of a building permit, the
appropriate traffic signal assessment fee shall be paid to the City
of Anaheim in an amount as determined by the City Council for each
new dwelling unit.

11. That prior to issuance of a building permit, the
developer shall prepare plans and specifications for the closure of
Cypress Street between Evelyn Drive and Coffman Street, said
closure to include modified cul-de-sacs at both ends of Cypress
Street. Said plans and specifications shall be submitted to the
City Engineer for approval and a bond shall be posted with the City
of Anaheim to guarantee the installation of said improvements prior
to final building and zoning inspections.
12. That the owner(s) of subject property shall obtain
vehicular ingress and egress to the property. Said ingress and
egress may consist of a covenant for an access easement across the
property immediately north of subject property. Said ingress and
egress shall be designed in a manner satisfactory to the City
Traffic Engineer. If a covenant is obtained, it shall be in a form
satisfactory to the City Attorney and shall be recorded in the
Orange County Recorder's Office. Proof thereof shall be furnished
to the Planning Department.
13. That drainage of subject property shall be disposed of in
a manner satisfactory to the City Engineer.
14. That in the event subject property is to be divided for
the purpose so sale, lease, or financing, a parcel map to record
the approved division of subject property shall be submitted to and
approved by the City of Anaheim and then be recorded in the Office
of the Orange County Recorder.
15. That trash storage areas shall be provided and maintained
in accordance with approved plans on file with the Street
Maintenance and Sanitation Division.
16. That all air conditioning facilities and other roof and
ground mounted equipment sha11 be properly shielded from view.
17. That subject property ;sha11 be developed substantially
in accordance with plans and specifications on file with the City
of Anaheim marked Revision No.1 of Exhibit Nos. 1 through 5.
18. That prior to issuance of a building permit, or within a
period of one year from the date of this resolution, whichever
occurs first, Condition Nos. 3, 4, 5, 8, 9, 10, 11, 12 and 14,
above mentioned, sha11 be complied with. Extensions for further
time to complete said conditions may be granted in accordance with
Section lS.03.090 of the Anaheim Municipal Code.
19. That prior to final building and zoning inspections,
Condition Nos. 2, 6, 7, 11, 13, 15, 16 and 17, above-mentioned,
shall be complied with.
BE IT FURTHER RESOLVED that the City Council of the City
of Anaheim does hereby find and determine that adoption of this
Resolution is expressly predicated upon applicant's compliance with

each and all of the conditions hereinabove set forth. Should any
such condition, or any part thereof, be declared invalid or
unenforceable by the final judgment of any court of competent
jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed nu11 and void.
