RESOLUTION NO. 69R-587
A P~SOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO. 2128.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from
CHARLES ROCKWELL, OWNER; MILLER. FINANCIAL CORPORATION, AGENT,
of certain real property situated in the City of Anaheim, County
of Orange, State of California, described as follows:
Lot 7 in Block 8 of The Golden State Tract, as shown on a
maD recorded in book 4, pages 66 and 67 of Miscellaneous
Maps, records of said Orange County.
EXCEPTING THEREFROM an undivided one-half of all minerals,
oil, gas, asphaltlli~ and other hydrocarbon substances in or
under said land, but without right of surface entry, as
reserved in the deed from Harry Sham and wife to Clarence
F. Miller and wife, recorded March 18, 1954 in book 2690,
page 442, Official Records.
EXCEPTING THEREFROM that portion of Lot 7, in Block 8 of
the Golden State Tract, in the City of Anaheim, County of
Orange, as shown on a map recorded in book 4, page 66 and
67 of Miscellaneous Maps, in the office of the County
Recorder of said County, included within the following
described lines:
Beginning at the intersection of the center line of Anaheim
Road, 40.00 feet wide, as shown on said map, with the center-
line of Blue Gum Street, 40.00 feet wide, shown as an
unnamed street adjoining said Block 8 on the East on said
map; thence along said centerline of Blue Gum Street, North
150 581 16" West 85.00 feet; thence South 740 01' 4411 West
30.00 feet; thence South 210 09' 44" West 43.92 feet; thence
South 770 00' 23" West 604.40 feet to the Westerly line of
said Lot 7; thence along said Westerly line, and the South-
erly prolongation thereof, South 150 581 21" East, 81.57
feet to said centerline of Anaheim Road; thence alonq said
centerline of Anaheim :~?.oad, North 740 001 46'; East, 660.10
feet to the point of beginning as condemned by the State of
California by final decree of Condemnation recorded March 26,
1963 in book 6482, page 376, Official Records.
P~SO EXCEPTING THEREFROM those portions thereof included
within said Anaheim Road and said Blue Gum Street.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim on
September 22, 1969, notice of which said public hearing was
duly given as required by law and the provisions of Title 18,
Chapter 18.76 of the lmaheim ~.1unicipal Code; and
WHEREAS, said City Planning Commission after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all pvi~~n~o ~M~ _~_~_~_
WHEREAS, thereafter within twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action taken by
the City Planning Commission in denying said variance and did
set a public hearing thereon to be held on the 21st day of
October, 1969, at 1:30 o'clock P.M. in the City Hall in the City of
Anaheim, and notice of such public hearing was duly given as
required by law and the provisions of Title 18, Chapter 18.76
of the Anaheim Hunicipal Code; and
"mEP~AS, the Citv Council does find that:
1. There is no substantial property right possessed
by other property in the same vicinity and zone
and denied the subject property.
2. It appears that the subject property can be
adequatelv developed and used under the present
zone.
NOI'V, THEREFOEE, BE IT RESOLVED bv the Ci tv Council of
the City of Anaheim that the action of the" City Planning Com-
mission denying Variance No. 2128 be, and the same is hereby
sustained, that the petition for a variance permitting waivers
of the following Anaheim Municipal Code requirements or limita-
tions:
(a) Maximum distance between units and vehicular
accessway (Section 18.28.050(9-a).
(b) Maximum distance between carDorts and units
(Section l8.28.050(lO-c).
(c) Minimum distance between buildings (Section 18.28.
050 (7-a) .
(d) Maximum number of main buildings on a site
(Section 18.32.020(1).
to establish a 2-story, 240 unit apartment complex on the
property hereinbefore described, be, and the same is hereby
denied.
THE FOP~GOING RESOLUTION is approved and signed by me
