RESOLUTION NO. 69R- .522
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE EXECUTION OF AN AGREEMENT BETWEEN THE
CITY OF ANAHEIM AND THE COUNTY OF ORANGE,
WITH REFERENCE TO ROADWAY IMPROVEMENTS ON
BROOKHURST STREET WITHIN THE RIGHTS-OF-WAY
OF THE SOUTHERN CALIFORNIA EDISON COMPANY
AND OF THE SOUTHERN PACIFIC RAILROAD.
WHEREAS, the City of Anaheim is proposing to construct
roadway improvements on Brookhurst Street within the rights-of-
way of the Southern California Edison Company and of the Southern
Pacific Railroad; and
WHEREAS, portions of the proposed improvement are in
the County of Orange; and
WHEREAS, the County and the City consider it in the
best interests of economics and public safety to combine the
improvement in their respective jurisdictions into one project;
and
WHEREAS, the City has offered to design, contract and
inspect said County portions of the project; and
WHEREAS, the County of Orange has tendered to the
City a form of agreement to be made and entered into between the
parties providing for the construction of the County's portion
of said project in conjunction with the City's construction work;
and
WHEREAS, the City Council finds that the terms and
conditions of said agreement are fair and reasonable and that
said agreement should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement tendered to the City to
be made and entered into by and between the City of Anaheim and
the County of Orange, providing for the combined construction of
the City's and County's portions of the roadway improvements on
Brookhurst Street within the rights-of-way of the Southern Cali-
fornia Edison Company and of the Southern Pacific Railroad, upon
the following terms and conditions:
I. City shall:
A. Be designated as Project Engineer, Contracting
and Construction Agent for the parties to do
and perform all things necessary in order to
design and construct the proposed improvement
of Brookhurst Street within the rights-of-way
of the Southern California Edison Company and
of the Southern Pacific Railroad, and to execute

B. During the period of construction, have juris-
diction over the construction area, including
that portion of the project within County area.
C. Acquire the necessary easements to construct
all roadway improvements, and certify to County
that said easements have been acquired prior
to advertising for contract bids.
II. County shall:
A. Approve the plans and specifications as they
pertain to construction and maintenance features
for County portions of project.
B. At all times during the progress of construc-
tion of said project, have access to the work
thereon for the purpose of inspection thereof,
and should County deem any remedial measures
to be necessary County shall notify City thereof.
C. Finance all easements and construction costs
for work done within the County.
III. The total estimated cost for the County portion is
presently $3,200.00, which sum includes an estimate
of the engineering and overhead costs for the County
portion, but does not include easements acquisition
costs.
IV. County's share of the construction cost shall be de-
termined on the amount of work done on said portion
of roadway lying within its boundaries, as these boun-
daries exist at the time of advertising the project.
In this agreement "roadway" shall be defined to in-
clude, in addition to work within, on and in the travel
and parking lanes, the proper construction of com-
pacted fill, slopes, sidewalk, curbs and gutters,
and all necessary and appurtenant work as shown on
the contract plans.
V. Upon completion of construction of said portion of
roadway, the City shall submit full, true and correct
copies of documents, certificates and itemized bills
to said County and County shall reimburse City within
thirty (30) days upon submission of such costs. Such
bills shall be based on the actual quantities of con-
struction and the unit prices bid for the contract
and shall also contain a charge for engineering and
inspection, in the same proportion to the total en-
gineering and inspection costs as the proportion of
contract cost for the portion within County is to
the total contract cost, plus a charge for overhead
on the engineering and inspection performed by City,
and exclusive of administrative overhead.
