RESOLUTION NO. 69R-483
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2100r IN PART.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from DAVID S.
COLLINS, 1077 W. Ball Road, Anaheim, Owner, and RONALD A. KAROS,
Agent, of certain real property situated in the City of Anaheim,
County of Orange, State of California, described as follows:
The Northerly 250 ft., together with a non-exclusive easement
for the ingress and egress of Fire Department equipment on the
Southerly 20 ft. of the Northerly 270 ft. of the following
described property:
That portion of Lot 35 of Anaheim Extension, in the City of
Anaheim, County of Orange, State of California, as said lot is
shown on a map of survey by William Hamel, a copy of which is
shown in book 3, page 163 and 164 of "Los Angeles County Maps Ii ,
in the office of the County Recorder of said Orange County,
and that portion of the Southeast 1/4 of the Southwest 1/4 of
Section 9, Township 4 South, Range 10 West, as shown on a map
recorded in book 51, page 10, Miscellaneous Maps, records of
said Orange County, described as follows:
Beginning at a 4 X 4 redwood stake on the South line of said
Section 9, distant thereon Easterly 44.68 chains from the
Southwest corner of said section; thence North 846.20 feet to
the South line of Anaheim Homestead Tract, as per map thereof
recorded in book 26, page 10, Miscellaneous Records of Los
Angeles County, California; thence West along said South line
of said Anaheim Homestead Tract, 616.02 feet; thence South
851.59 feet to the South line of said section; thence East
618.82 feet to the point of beginning.
EXCEPTING THEREFROM all that portion lying Southerly of the
following described line:
Commencing at a 4 X 4 redwood stake on the SOUtll line of said
Section 9, a distance of 2948.88 feet East of the Southwest
corner of said section; thence North 10 06' 1011 West 184.40
feet to the true point of beginning; thence North 860 48' 50"
West 101.67 feet, thence North 590 50' 23" West 77.64 feet;
thence North 500 32' 27" West 100.00 feet to the point of
tangency of this course with a curve concave Southwesterly,
having a radius of 2028.00 feet; thence Northwesterly along
said curve, through a central angle of 120 43' 14" an arc
distance of 450.25 feet to a point in the Westerly line of the
real..property conveyed to G.A. Koontz, et aI, by deed recorded
in book 480, page 217 of Deeds, records of said Orange County,
distant along said Westerly line North 00 44' 21" West 77.81
feet from the Northeasterly line of the land described in a
deed to the State of California, recorded January 14, 1943 in
book 1175, page 382, Official Records.

WrlEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. 69-155... . ,

therein set forth ; and

WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action taken by
the City Planning Commission in ~p~ovi~9_in part_ said variance and

was duly given as required by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:

There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.

That such a variance is necessary for the preser-
vation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.
3.
That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4.
That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
of Anaheim that a conditional zoning variance be, and
is hereby granted permitting the establishment of a
apartment complex with waivers of the following Munici-

tllat the variance be granted subject to the following conditions:
1. That this variance is granted subject to the
completion of Reclassification No. 69-70-1.
2. That the owner of subject property shall provide
and improve a peripheral 20-foot wide vehicular
ingress and egress easement along and south of
the south property lines of subject parcel.
3. That subject property shall be developed sub-
stantially in accordance witll specifications
on file with the City of Anaheim, marked Exhibit
Nos. 1, 2, 3 and 4, and required revisions thereto
to be approved by the Development Services Depart-
ment Staff.
4. That lighting in the northerly alley on subject
property shall be directed away from the R-O
residences to the north.
5. That the wall along the northerly line of subject
property be constructed no higher than eight feet
above the grade of the adjacent property.
