A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 69-70-1 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the lC}rh day of t).l1gJ1~t- ,19hC} as the time, and the City Council Chambers 1n the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County The Northerly 250 ft., together with a non-exclusive easement for the ingress and egress of Fire Department equipment on the southerly 20 ft. of the Northerly 270 ft. of the following described property: That portion of Lot 35 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as said lot is shown on a map of survey by William Hamel, a copy of which is shown in book 3, pages 163 and 164 of "Los Angeles County Haps," in the Office of the County Recorder of said Orange County, and that portion of the Southeast 1/4 of the Southwest 1/4 of Section 9, Township 4 South, Range 10 West, as shown on a map re- corded in Book 51, page 10, Miscellaneous Maps, records of said Orange County, described as follows: Beginning at a 4 x 4 redwood stake on the South line of said Section 9, distant thereon Easterly 44.68 chains from the Southwest corner of said section; thence North 846.20 feet to the South line of Anaheim Homestead Tract, as per map thereof recorded in Book 26, page 10, Miscel- laneous Records of Los Angeles County, California; thence West along said South line of said Anaheim Homestead Tract, 616.02 feet; thence South 851.59 feet to the South line of said section; thence East 618.82 feet to the point of beginning. EXCEPTING THEREFROM all that portion lying Southerly of the following described line: Commencing at a 4 x 4 redwood stake on the South line of said Section 9, a distance of 2948.88 feet East of the Southwest corner of said section; thence North 10 06' 10" West 184.40 feet to the true point of beginning; thence North 860 48' 50" West 101.67 feet; thence North 590 50' 23" West 77.64 feet; thence North 500 32' 27" West 100.00 feet to the point of tangency of this course with a curve concave Southwesterly, having a radius of 2028.00 feet; thence Northwesterly along said curve, through a central angle of 120 43' 14" an arc distance of 450.25 feet to a point in the Westerly line of the real property conveyed to G. A. Koontz, et aI, by deed recorded in Book 480, page 217 of Deeds, records of said Orange County, distant along said Westerly line North 00 44' 21" ~vest 77.81 feet from the Northeasterly line of the land described in a deed to the State of California, recorded January 14, 1943 in Book 1175, pages 382, Official Records. be excluded from R-A, AGRICULTURAL ZONE, and incorporated in R-3, MULTIPLE-F~lILY RESIDENTIAL ZONE, subject to the fol- lowing conditions: 1. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front .f=,...,..,...,.~ _, ___ r.-r.!." _'1_ . 3. That a Parcel Map to record the approved division of subject property be submitted to the City of Anaheim for approval and then be recorded in the Office of the Orange County Recorder. 4. That the sidewalks and driveways shall be installed along Pearl street and driveways shall be installed along Wilshire Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 5. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works. 6. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 7. That a 6-foot masonry wall shall be constructed along the north property line. 8. That this development shall be served by under- ground utilities. 9. That any air-conditioning facilities proposed shall be properly shielded from view, and the sound shall be buffered from adjacent residential homes. 10. That the owner of subject property shall pay to the City of Anaheim the sum of $75.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 11. T~at Conditions Nos. 1 and 2, above-mentioned shall be complied with within a period of 180 days from the date hereof, or such further time as the City Council may grant. 12. That Conditions Nos. 3, 4, 5, 6, 7, 8 and 9, above-mentioned shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
