A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE CHIEF OF
POLICE TO PARTICIPATE, ON BEHALF OF THE
CITY OF ANAHEIM, IN A COUNTY-WIDE GRANT
APPLICATION WITH THE U.S. DEPARTMENT OF
JUSTICE, BUREAU OF JUSTICE ASSISTANCE, FOR
ITS JUSTICE ASSISTANCE GRANT (JAG)
PROGRAM, AUTHORIZING THE CHIEF TO EXECUTE
ALL REQUIRED GRANT DOCUMENTS, AND, IF
AWARDED, ACCEPTING SUCH GRANT AND
CONTRIBUTING FORTY-ONE PERCENT THEREOF
TO THE COUNTY OF ORANGE FOR USE IN ITS
PROACT PROGRAM, AND AMENDING THE BUDGET
FOR THE FISCAL YEAR IN WHICH THE GRANT
FUNDS ARE RECEIVED ACCORDINGLY
WHEREAS, the United States Department of Justice, Bureau of Justice
Assistance, has heretofore invited public agencies, including the County of Orange,
to submit applications for the new Justice Assistance Grant (JAG) Program which
makes funds available for the purchase of equipment, technology and other
materials directly related to basic law enforcement functions (the "Grant"); and
WHEREAS, the City of Anaheim desires to participate in the County-wide
application to be submitted by the County of Orange for said Grant in the amount
of Eight Hundred Forty-Nine Thousand Nine Hundred Eighty-Six Dollars
($849,986.00), of which the City will be entitled to receive approximately One
Hundred Fifty-Two Thousand Four Hundred Twenty-Three Dollars ($152,423.00);
and
WHEREAS, the City is familiar with the terms, conditions and limitations of
any such Grant; and
WHEREAS, the City is willing and able to conform to each of the terms,
conditions and limitations imposed upon any such Grant; and
WHEREAS, the City desires to accept its share of any such Grantwhich may
be awarded to the County and other participating agencies and donate forty-one
percent (41 %) of its award to the County of Orange for use in its PROACT Program;
and
WHEREAS, the City Council desires to amend the annual budget of the City
to reflect and incorporate any portion of such Grant so awarded to the City in the
appropriate City program.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim as follows:
1. The Chief of Police of the City of Anaheim is hereby authorized, on
behalf of the City of Anaheim, to participate in a County-wide grant application to
the United States Department of Justice, Bureau of Justice Assistance, for
participation in Justice Assistance Grant Program, and to execute on behalf of the
City all required Grant documents, including any extensions and amendments
thereof.
2. The City Council of the City of Anaheim hereby agrees to, and by this
resolution, does accept any portion of such Grant so awarded to the City of
Anaheim, including any additional funding added to the original grant contract as a
result of a contract amendment, without further action of the City Council being
required therefor.
3. The City Council of the City of Anaheim hereby agrees to, and by this
resolution, does contribute forty-one percent of any Grant award to the County of
Orange for use in its PROACT Program.
4. The City of Anaheim hereby agrees to comply with each and all of the
terms, conditions and limitations imposed by the grantor upon said Grant, and the
Chief of Police is hereby authorized and directed to execute any agreements,
assurances, or other documents as may be necessary in connection with the
acceptance of said Grant as may be required by the grantor, if such Grant is
awarded to the County and other participating agencies.
5. Contingent upon the award of said Grant and the receipt of Grant
funds, the annual budget of the City of Anaheim for the fiscal year in which the
Grant funds are received is hereby amended to reflect and incorporate any portion
of such Grant award in Program No. 219-309-3021.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 29th Day of March ,
2005, by the following roll call vote:
