A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM SUSPENDING COLLECTION OF THE
SERVICE ESTABLISHMENT CHARGE COLLECTED
PURSUANT TO RULE 3 OF BOTH THE ELECTRIC AND
WATER RATES, RULES AND REGULATIONS, RULE 23
OF THE ELECTRIC RATES, RULES AND
REGULATIONS AND RULE 21 OF THE WATER RATES,
RULES AND REGULATIONS FROM APRII. 15'~
THROUGH JULY 29, 2005 TO SUPPORT THE BUSINESS
LICENSE HOLIDAY
WHEREAS, Rule 3 of both the Electric and Water Rates, Rules and
Regulations identify a service establishment charge for any service or services
established at an individual service address; and
WHEREAS, Rule 23 of the Electric Rates, Rules and Regulations and
Rule 21 of the Water Rates, Rules and Regulations set the amount of this
charge; and
WHEREAS, the City of Anaheim has demonstrated its support for
new businesses in the City of Anaheim by adoption of Ordinance No. 5958 on
March 8, 2005, establishing a Business License Holiday for a period of 100
days from April 15th through July 29th of 2005; and
WHEREAS, the Anaheim Public Utilities Department would like to
support the upcoming Business License Holiday by suspending collection of
the Service Establishment Charge for electric and water services to all new
businesses that request service with Anaheim during the 100-day period; and
WHEREAS, the Anaheim Municipal Code authorizes the City Council
to approve reasonable Rates, Rules and Regulations governing electric and
water service and fees for providing those services; and
WHEREAS, City Council of the City of Anaheim wishes to take such
actions necessary to support the Business License Holiday by suspending
collection of the Service Establishment Charges for eligible businesses for the
period of April 15 through July 29, 2005; and
WHEREAS, the City Council wishes to reinstate the collection of the
Service Establishment Charge for all customers effective July 30, 2005; and
WHEREAS, the City Council of the City of Anaheim wishes to take
such actions as are necessary to authorize these temporary revisions to the
Electric and Water Rates, Rules and Regulations; and

WHEREAS, the City Council further finds and determines that
approval of these revisions to the text of the Electric and Water Rates, Rules
and Regulations is exempt from the California Environmental Quality Act
pursuant to Section 21080 (b) (8) of the California Public Resources Code.
NOW, THEREFORE IT BE RESOLVED, by the City Council of the
City of Anaheim as follows:
1. Collection of the Service Establishment Charge collected
pursuant to Rule 3 of the both the Electric and Water Rates, Rules and
Regulations, Rule 23 of the Electric Rates, Rules and Regulations, and Rule
21 of the Water Rates, Rules and Regulations shall be, and is hereby,
suspended for eligible businesses effective April 15, 2005 through July 29,
2005.
2. That the Public Utilities General Manager is authorized and
directed to prepare, promulgate, publish and take all actions necessary to
implement the revisions to Rule 3 of the Electric and Water Rates, Rules and
Regulations, Rule 23 of the Electric Rates, Rules and Regulations, and Rule
21 of the Water Rates, Rules and Regulations as set forth herein.
THE FOREGOING RESOLUTION is approved and adopted
by the City Council of the City of Anaheim this 2~h day of
