RESOLUTION NO. 68R-627
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING VARIANCE NO. 2002.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from Carl
H. Lindgren, et al., owners of certain real property situated
in the City of Anaheim, County of Orange, State of California,
described as follows:
PARCEL 1:
South 115.00 feet of Lot 6 of the Kellogg Homestead Tract,
as shown on a map thereof recorded in book 8, page 51, Mis-
cellaneous Maps records of said Orange County.
PARCEL 2:
North 115.00 feet of the South 230 feet of Lot 6 of the Kellogg
Homestead Tract, as shown on a map thereof recorded in Book
8, page 51, Miscellaneous Maps, records of said Orange County.
PARCEL 3:
That portion of Lot 6 of the Kellogg Homestead Tract, as
shown on a map thereof recorded in book 8, page 51, Miscellaneous
Maps, records of said Orange County, described as follows:
Beginning at a point in the West line of said lot, distant
thereon South 00 55' 23" West 395.00 feet from the Northwest
corner thereof, said Northwest corner being in the center
line of the street, 60.00 feet in width, now known as Ball
Road, adjoining said lot on the North, and running thence
South 890 40' East parallel with the North line of said lot,
249.40 feet to a line parallel with and 200.00 feet Westerly
of the East line of said lot, said East line being the center
line of the street, 40.00 feet in width, now known as Nutwood
Avenue, adjoining said lot on the East; thence South 10 07'
40" West, parallel with said East line 85.00 feet to a line
parallel with and 450.00 feet Southerly of the North line
of said lot; thence South 890 40' East along said parallel
line, 200.00 feet to said East line; thence South 10 07'
30" West along said East line, 101.89 feet to a line parallel
with and 230.00 feet North of the South line of said lot;
thence Westerly, parallel with said South line, to the West
line of said lot; thence North 00 55' 23" East along said
West line, 186.20 feet to the point of beginning.
AND WHEREAS, the City Planning Commission did hold
a public hearing at the City Hall in the City of Anaheim on
August 12, 1968, notice of which said public hearing was duly
given as required by law and the provisions of Title 18, Chapter
18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission after due
inspection, investigation and studies made by itself and in
its behalf, and after due consideration of all evidence and
reports offered at said hearing, did adopt Resolution No. PC68-
247, granting Variance No. 2002, in part; and

WHEREAS, thereafter within twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action taken by
the City Planning Commission in granting said variance and did
set a public hearing thereon to be held on the 17th day of September,
1968, at 1:30 o'clock, P.M. in the City Hall in the City of
Anaheim, and notice of such public hearing was duly given as
required by law and the provisions of Title 18, Chapter 18.76
of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made
DY itself and in its behalf, and after due consideration of
all the evidence and reports offered at said hearing, the City
Council does find and determine that:
1. There is no substantial property right, possessed
by other property in the same vicinity and zone
and denied the subject property.
2. It appears that the subject property can be
adequately developed and used under the present
zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that tile action of the City Planning
Commission granting Variance No. 2002 be, and the same is hereby
disapproved, and that the petition for a zoning variance to
permit the construction of a 101-unit apartment complex, on
the property hereinbefore described, with waivers of the following
Anaheim Municipal Code requirements or limitations:
(a) Maximum height of any building located within 150
feet of any R-A or single-family residential zone
(Section 18.28.050 [5-b]);
(b) Minimum distances between buildings (Section
18.28.050 [7-a] ) I
(c) Location of accessory buildings (Section l8.28.050[6-c]);
(d) Maximum distance living units shall be located from
a standard street (Section l8.28.050[9-b]),
be and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by me
this 22nd day of October, 1968.
