Two corrections were requested by the Commission. On Variance No.
889, the followiag should be inserted: "Mr. Whitmore, after Commis-
sioner Thompson explained his position on :he opinion requested
from the City Attorney, agreed to have the Hearing continued." Also
on the last page, under Tentative Map of Tract No. 3303, No. 1, the
word "line" should be inserted after the word "straight". With
these changes, t~; :~?autes of the Adjourned Regular Meeting of
January 20, iy58, were approved.
VARIANCH NO. 889 - This was the time set for the re-opening of the Hearing upon this
Va=iance. The Secretary read a letter from Mr. Preston Turner.

Dear Mr. Mungall:
I hasten to apologize for my delay in answering your
request of January 14 for an opinion upon the matter therein re-
ferred to. I was engaged in Court all of last week and was unabie
to complete my research.
You advise that by Reclassification proceeding No.
F-55-56~19 a 50-foot P-L Zone, starting at Bali Road and running
southerly along South Los Angeles Street, was established on March
5, 1956 as a part of the over-all planaing for that area. This
50-foot zone is, in effect, a setback regulation for the construc-
tion of buildings or_ property in the area and is required to be
landscaped by the property owners.
You advise that an application for Variance No. 889 has
been filed by a proposed purchaser of a small triangular parcel of
property, lying on the east side of South Los Angeies Street,
seeking a waiver of compliance with this setback. I am informed
that the setback established covers a substantial portion of this
triangular parcel of land.

You reque~t an opinion as to whether or not the P-L,
Parking~Landscaping setback Zone is a valid exercise of the police
power of the City insofar as it appiies to this particular pazcel
of property. It appears that this small triangular parcet. of ~
property was originally a portion of a largez parcei of property ~
on the westerly side af South Los Angeies Street and that whea the ~
State Highway was established at thet point, the State of California, ~
either by purchase or coademnation, took a strip across the property ~

Undoubtedly~ the original owner was compensated at that time for
the property taken by the State and for the severance damages which
he suffered as it affected this triangular parcel of property.
Since it is my understanding that the applicant is not the present
owaer of this property, and siace the zoning of the area and the
estabiishment of this Parking-Landscaping setback 2one was estab-
lished as a part of the general plan for zoning the area prior to
the date of acquisition by applicant, it is my opinion that the
establishment of ~the P-L Zone is a valid exercise of the police
power by the City of Anaheim and is binding upon this proposed
purchaser of the property.
If coaditions affecti.ng a pF=ticular parcel of property
exist at the time of its acquisition by an owner, he is not misled
as 4o any use that may be made of the property nor deprived of any
property right by the City. If he acquires the property under
such conditions, h~ does so with full knowledge that its use is
limited by the zoning regulations of the City, and any loss which
he may sustain would be the result of his own act and not the act
of the City Planning Commission nor the City Councii.
Whether or not an application should be graated in any
;*+~tance is a matter that is committed to the discretion of the
Planning Commission and the City Council. The denial of a variance
dces not deprive the property otvner of any vested right. It is my
opinion that the denial of the application for Variance No. 889
would not result in denial to the applicant of any substantial
property right and would be a valid exercise of the discretion
vested in the City Planning Commission.

Mr. Witmore, attoraey for the applicant, appeared before the Com-
mission and stated that if the P-L Zone is maintained along this
property, no use couid be mar!e of the property, and this wuuld
be discriminatory and ua~easonable. He stated that the commercial
use proposed, namely a:estaurant and cocktaiJ. J.~unge, is a use
permitted in an M-1 Zone, and that this would act as a buffer
between the M-1 Zone surrouading the property and the C-1 Zone on
the other side of South Los Angeles Street. He also stated that
the proposed use would be an attractive-buildiag that would aot
detract from other buildings that might be erected ia the area.
Mrs. A. A. Warnoff, ~311 South Los Angeles Street, as the broker
handling the sale of this property, stated that, if ailowed the
usual setback for commercial uses, they could erect an attractive
building with ample off-street parking on the property. Mr, Wii-
liam P, CYark, Santa Ax-a, as representative of the owners of the
property to the South, North, and 8ast, stated that the City of
Anaheim in settiag up a P-L Zone along South Los Angeles Street
and Ball Road showed real vision, an1 this setback would enhance
the industrial area. He also stated that the P-L Zone should not
be broken down on this smail parcel. He also stated that they
would be willing to purchase this property at a fair appraised
price. Mr. McPhersoa, of Orco Commercial Properties, stated that
they have never received an offer for the purchase of the property
by the owners of the property at the rear, Mr. Clark stated that
theq would be willing to sell a.portion of the lot at the rear so
that the proposed buildin~ could be e~ected and the P-L 2one
maintauted. He also stated that they had received a letter from
Mr. Bryan of Orco Commercial Properties, offering the property

A representative of the Culligan Water Company, who are consider- ~
ing the purchase of a site along the Proniage Road, inquired as to
what the building line setback would be. Plans for the Herber4
property called for a 17-foot setback from the property line. It
was pointed out that this setback had been pretty weil established
by the County, who allowed one or two variances to go in on the
Prontage Road in this section with 15-foot buildiag line setbacks,
and although the Commission would like to see a greater setback,
the pattern has been pretty well established. The 15-foot setback
would satisfy the Culiigan Water Company, the representative stated.
