Parks, a property owner in the area, aiso appeared in oppoaition
to the granting of the Variance saying that he believed this use
wouid be detrimental to his property. It was brought out by Mr.
Parka that in conversation with the owner of the property he had
atated to him that the petition would probably be withdrawn.

VARIANCB N0. 1040 - Mr. Anthony, the petit:.oner, appeared before the Commisaion and
(Continued) presented a petition of property owners in the area endorsing
the request for the Variance. Mr. Bd Hddinger, 9941 Plores
3treet, and Mr. R. E. Harris, 9961 Plores Street, appeared be-
fore the Commission in oppoaition to the granting of the variance
and stated that thia use they felt was too near their R-1 reai-
dential properties. Mr. Harris statcd that they did not need a
bar and reataurant in the area and that the petition in favor of
the Variance had been signed by owners of commercial property in
the area. Mr. Anthony stated that he had contacted everyone
• within 300 feet and found that they were aii in iavor and ihat
a restaurant and cocktail bar in the area, to aerve the motels,
was believed necessary by Lhe moteY owners if they were to aur-
vive. Mr. Rnthony also stated that he would be glad to eliminate
the liquor store which was requested as pect of the Variance.
THR HEARING WAS CIASED.
U;._n a motion by Commissioner Allred, seconded by Commiesioner
~hompson and carried, it was moved by Resolution No.76, Seriea
1958-59, that Variance No. 1040 be approved for a Restaurant
and Cocktail Bar, with the elimination of a liquor atore, and
subject to:
1. The dedication of 53 feet from the center line of Ball
Road for street widening.
2 Preparation•of street tmpzovement plan and installation
of all improvements in accordance with the improved
standard plans on file in the office of the City Hngineer.
3, The paymeat of $2,00 per foot :or the inataliation of
street lights.
4. All improvements to be installed before final inspection
of the building is given.
