Minutes-PC 1959/08/17ADJOURNBD RBGULAR MHHTING - At 2:00 0'Clock P.M., the following Commissioners were on
hand, Chairman Gauer, Commissioners Mauerhan Summers and
Mungall. It was found the Commissioners Allred and Morris
were on vacation, so a hurry cail was sent out to Com-
missioneis DuBois~and Hapgood so that a quorum might be
had and the meeting started.
Commissioner Hapgood entered the meeting at 2:45 0'Clock
P.M., Commissioner DuBois entered the meeting ai 3:13
0'Clock P.M.
ANAHBIM CITY SCHOOL - During the interim while a quorum was being assembled the
DI3TRICT Setter received from the Anaheim City School District was
read, whereby, approvai was songht for a school site at
the southwest corner of Santa Ana and Walnut Streets to-
gether with a waiver of the zoaing condition that a
Special Use Permit must be obtained before any industry
can be located within 330 feet of any school site. The
proposea property for this site is presently classified
as M-l, Light Manufacturing.
Mr. Arval Morris, President of the Anaheim City School
District appeared before the Commission and stated that
the proposed site is urgently needed for the erection of
a school to serve the area and keep down the conveying
of pupils to the schooi by busses. This site would
relieve a crowded condition at the Bejamin Pranklin
School, The present owner of the property is willing to
seli this site to the schooi providing that the rights
presently enjoyed cn the property can be maintained.
Mr. Morria further stated #hat he believed the owner
would not place any industries next to the school
property that would be detrimental.
Mr. Geisier of the City Attorney's office stated that
in his opinion that there was no way by which the
Pianning Commission could recommend such a waiver or
any way that the City Council could waive such a re-
quirement as required by the 2oning Ordinance. lhis
provision he stated twas placed in the ordinance so
that a review must be required in order to insure the
safety of the pupils and that the Council in granting suc
a waiver wouid be surrendering their police power. He
further stated that apparently the only thing that could
be done would be for the School District to guarantee
they would not object to uses proposed by the owner
within the.330 feet provided such phases as smoke, noise,
odors etc did not create a nuisance which by osdinance
would have to be abated anyway.
The meeting was officially opened upon the
Commissioner Hapgood.
Upon a motion by Commissioner Summers, seconded by
Commissioner Maue=han and carried the Coromission voted
approval of the southwest corner of Santa Ana and Walnut
Streets as an elementary school sites.

Upon a motion by Commissioner Mungall, seconded by
Commissioner Mauerhan and carried, it was voted to
grant a six months extension on Special Use Permit No. 29.

Henry plou, 214 Graad Avenue, Anaheim, California as to
whether a non-commercial provate Bowling Alley would be
permissabie in an R A Zone. It would be considered as
aa accessory building and would be 300 feet to the nearest
residenc~.
The R A zone permits recreation facilities except
amusement devices for hire. By Section 9200.14-b, the
Planning Commission found t:~at this would be a permitted
use by their interpretation and upon a Resolution No. 29,
Series 1959-60 by Commissioner Mauerhan, seconded by
Commissioner Hapgood and carried it was vated to recommend
this use subject to:
1. lhat these alleys never be used for commercial purposes,
2. lhat the building be soundproofed,
BOAT ST'QRA~B - A letter was received from James J, Liptak, property owner
at 2040 West Ball Road, requesting a ruling on the storage
of boats on C-1 zoned property.
It is proposed to use the b ack part of this property
facing along Bmpire Street for the storage of small
boats by owners of same when not in use. The entrance to
the area would be from the alley at the rear and the area
would be enclosed with ? chainlink fence and landscaped

and stated that this was considered oace before for all

again that the reciassification be denied. He pulled
several qnestions, to Mr. G~oden, 1. Can a religious
corposation normally a non-profit organization seil land
for a profit? 2. Does the Baptist Children's Home
plan to develop this propert~? 3. Is this request for
rezoning for monetary gain? Mr. Gooden replied that most
religious corporations whether non-profit or not can sell
2and for a profit which wiii go to the construction of
other facilities and that the Baptist Chiidren`s Home
does not plan to develop this property, but wiil sell the
same to a possible developer. He further stated that it
certainly is to some extent a rezoning for a monetary
gain and that the land as R-A is not conducive to the
highest and best use for the land. Mr. Goodea also
stated that aii the property around it have R-1 iots and
that they are not strictly R-0, in fact some of the lots
on the north do not even meet the frontage requirements

aew grocery market. This was now complete and the off-
street parking had been provided and it was now ready
fo~ occupancy, but that the owner desired to ase the old
building for other types oi uses that were not known at
the time the variance was requested. It still is not
known, but the owner does wish to use the old building
for uses other than a grocery store and would be willing
to specsfy that C-1 Deed Restrictions be filed limited
to the uses shown under C-1, Neighborhood Commercial in
the new proposed zoning ordinance, which eliminates a
great many uses that are now presently in the C-1
classification. The•e are some 16 uses in the new
propased zoning ordinance and at the preseat time in
the grocery store there are 9 of tliese uses, as listed,
teing conducted. It is proposed to remodei the old
auilding and the reclassification was requested to
avoid the use of variances. He further stated that the
propertq for 33 years had been a neighborhood market.
Mrs. Hick of 725 North Lemon Street presented a petition
containing 20 names of property owr,ers in the area
objec~:ing Yo the reclassification for any other business
than the one presently estabiished, namely a grocery
store. Mrs. A. T. House of 761 North Zeyn Street objected
to the beer and wine sales in the grocery store and stated
that empty beer cans were found iri their trash cans at;d on
the alley. It was painted out b~ Mr. Coons that while
they do sell wine and beer at #he market which is done
in every gzocesy sto=e in the city, these p=oducts are not
coasumed on the premises. Mrs. Robinson who appeared fox
Mr~. L. M. Wilson, 714 North Lemon Street stated that they
lived directly across the street and they did not believe
that the old store could be remodeled and further sta•ted
that cars are naiking across the driveways in the area.
lkr. Coons stated that parking across the driveways is bad,
but that Mr. Roquet could instruct the truck drivers
where to pazk when delivering arateriais to the store so
that they would not bother any of the neighbors in the
