Gustavo Liwiski., Agent, explained this is to be an automobile repair shop and that they will. specialize in European cars and that there is no need for the parking because no ~~ehicles will be parked outside overnight and very few would be outsi e during the day. THE PUBLIC HEARING WAS CLOSED. Responding to Commissioner Bouas, Mr. Liwiski explained they will not be doing any body work on these vehicles and will only be doing mechanical work and that is included as a restriction in their lease. ACTION: Commissioner Herbst offered a motion, seconded by Commissioner Bouas and MO'J'ION CARRIED (Commissioners La Claire and Lawicki absent) that the Anaheim City Planning Commission has reviewed the proposal to permit an automobile repair facility with waiver ,,P minimum number of parking spaces on a rectangularly-shaped parcel of land consisting of approximately 1.76 acres, having a frontage of approximately 110 feet on the east side of Tustin Avenue and further described as 1480 North Tustin Avenu?; and c]oes hereby approve the Negative Declaration upon finding that it has considEred the Negative Declaration together with any comments ceceived during the public review process and further finding on the basis of the Initial Study and any comments received that there is r.~o substant,ial evidence that the project will have a significant effecl• on the environment. Hugo Vazquez, agent, explained the past History of this property and pointed out this is to be a 12-unit owner-occupied condominium project with units of approximately 1200 square fr:~et with enclosed garage areas right into each individual unit and they feel there is market for this type owner-occupied unit anr] it would be nicer. for the area than having rent•.al units. He stated according to the RM-2400 Code, 11 units would be permitted, but he Eelt owner-occupied condominiums would he more desirable. He explained he dial meet with the Evelyn Drive neighborhood and even though Evelyn Drive is to be closed, and l•.hey are putting in an 8-inch sewer line and dedicating :yet of: their property- he is willing to meet with the neighbors and discuss ttre proposal anc9 look for ways to mitigate their. concerns. He stated they have set the huilding back 4U feet from the property line and there are no windows or doors which will intrude on the residential properties. He stated plans submitted show a pool and pointed aut that would only be a spa and not a pool. He stated this will be a high quality project. Ruth Motley, 203 Evelyn Drive, stated they did meet with Mr'. Vazquez and tie explained the plans and iL• does appear. that this would be a very nice project; however, they are concerned about r,he numl~~er of units being only 40 feet from the property line, which is where their recreational areas would be. She explained it• would be 8 feet to the entry of each unit. Mr. Sandoval, 204 Evelyn, stated he has been a resident of Anaheim for 63 years, and that- he Has never been before the Planning Commission because obviously the City has grown well and was planned well with schools, living areas and recreational areas to fit the needs. tfe stated that notice regarding this hearing indicated the property is approximately G.2 acres on the west side of Coffman, 149 feet north of the centerline of Center Street and did not think that is the same property being discussed. Malcolm Slaughter, Deputy City Attorney, stated in view of the discrepancy in the location, he would recommend this matter be readvertised and new notices sent to the owners within 300 feet of subject property because people receiving their notices could think it pertained to another property and could possibly challenge any actiun taken. James E. Millard, 239 Evelyn Drive, stated Evelyn Drive is a close knit neighborhood and Choy all k~.row exactly where this project- is to be located and they have had many discussions amung themselves and the people who are closely involved are all represented here today and the other people in the neighborhood are awace of it. He stated next to his property there was a vacant property and a contractor had wanted to construct a ?.-story senior citizen project there; however, after he sent a letter to everyone in ttie neighborhood prior to bcinging the plans to the Planning Commission and r.~ceived negative responses, he then decided to construct two, 3-bedroom units which are almost completed. He stated unfortunately, the young people moving into those units probably did not receive notices of these meetings today. She asked if the properties that are zoned RM-24U0 and RM-1200 could be designated on a map as part of the study. Ile stated he ran into a problem in his area because unfort~lnately, a General Plan Amendment will not protect a property and when plans are submitted to staff, zoning is reviewed and if the project complies with code, the property owner would be allowed to build, and he would suggest a reclassification be considered at the same time to avoid tt;e 6-month process. Greg Hastings stated the reclassification on the Lemon Street property has been approved. Commissioner La Claire stated she would like a reclassification considered at the same time as the General. She stated she thought the usable area should probably be just lawn areas or places where sand boxes or som~~thing very simple could he located because the developers need guidance. She asked if lawn areas would be considered usable. Chairman McBurney suggested including vtrbage in the Code r_xcluding planters, walkways, balconies or root toE>s and there should be a minimum lawn area clearly defined. Commissioner Houas stated usablo r.e?reational area should be available to everyone in the complex also. Grey Hastings stated the Code we have now could be used with a list of. exclusions which staff could use to assist the developer. Commissioner Bouas indicated concern with recreational rooms which are locked and are not available to all occupants. Commissioner La Claire stated the criteria should really be nailed down before an ordinance is adapted to eliminate any controversy i.n the future. He stated L•he matter was appealed to L•he City Council and was heard .Last week and the Council upheld the Planning Commission's action. tie stated he had spoke against the reclassifiration because it would cause e<:onomical hardships on a lot o[ people in L-hose three blocks mentioned. Iie stated he thought the petition submitted in favor of- the GPA was based on fal:,e information that had been promoted by those people who caused the roll back in zoning and stated he would suggest the Commission reevaluate the situation and inform tt~e people of that area as to exactly what was going to happen to their properties because in l:he future when those people are ready to develop, they will be disappointed. Mr. Vazquez explained he is a real estate agent and had arranged the sale of three properties in that area for. development and as a result, a lot of misunderstanding was started. Commissioner La Claire stated she walked a.ll those streets, including Lemon and ?.eyn Street, and talked t~ the people who lived there arrd also to some of the property owners who were not present and that the situation was very much reviewed, not only here, but by others, and by the people who live in the area and that there were two public hearings on the issue and everyone was notified and everybody was well aware of what was happening and ghe did not meet anyone who did not know what was going on.
