REGULAR MEETING OF THE ANAHEIM CITY PLANNING COMMISSION
MONDAY, JANUARY 16, 1989, AT 9:00 A.M.
PRELIMINARY PLAN REVIEW PUBLIC HEARING
AND/OR FIELD TRIP INSPECTION (PUBLIC TESTIMONY)

ALL COMMISSIONERS PRESENT
PROCEDURE TO EXPEDITE PLANNING COMMISSION PUBLIC HEARINGS
1. The proponents in applications which are not contested will have five
,ninutes to present their evidence. Additional time will be granted upon
request if, in the opinion of the Commission; such additional time will
produce evidence important to the Commission's consideration.
2. In contested applications, the proponents and opponent will each be given
ten minutes to present his case unless additional. time is requested and
the complexity of the matter warrants. The Commission's considerations
are not determined by the length of time a participant speaks, but rather
by what he says.
3. Staff Reports are part of the evidence deemed received by the Commission
in each hearing. Copies are available to the public prior to the meeting.
4. The Commission will withhold questions until the public hearing is closed.
5. The Commission reserves the right to deviate from the foregoing if, in its
opinion, the ends of fairness to all concerned will be served.
6. All documents are presented to the Planning Commission for review in
connection with any hearing, including photographs or other acceptable
visual representations of non-documentary evidence, shall be retained by
the Commission for the public record and shall be available for public
inspections.
7. At the end of the scheduled hearings, members of the public will be
allowed to speak on items of interest which are within the jurisdiction of
the Planning Commission, and/or agenda items. Each speaker will be
allotted a maximum of five (5) minutes to speak.

OPPOSITION COMMENTS: Opposed to location of building and proposed
parking location for doctors and employees; hospital leased 50 parking
spaces to shogping center next door to office building; residents
concerned about safety of children and felt if approved, no parking
~,~;,! should be permitted on Masters Lane; current parking problems would be
increased with approval of a parking waiver. Closing axisting entrance
could encourage someone looking for parking space to park on neighbor's
parking lot. because it is visible.
PETITIONER'S COMMENTS: Parking used to be a concern, but hospital not
as busy now and they have not hail any parking problems for the last 5 or
6 years, doctors and employees will be required to park in the rear,
freeing up 75 parking spaces. Mould control parking with gates and
magnetic cards for access and require employees to park in designated
area. Have security patrol area to ~,aite sure no employees are not
parking in guest parking spaces. Visitor's vehicle would have card
displayed in the windshield. Agreed to pay any costs incurred for any
permit parking area; City required 134 spaces to be leased to medical
office building; doctors required to sign lease which contains
information requiring their employees L-o park in designated areas.
COMMISSION COMMENTS: How will they control the employees and prohibit
parking on Masters Lane; distance to parking as designated for employees
too far away; severe parking problem in this area already, and not just
expense involved, bu% convenience and safety of public streets are major
considerations. No room to grow.
STAFF COMMENTS: Traffic Engineer just received traffic consultant's
evaluation and changes? recommezation for approval and did not think
adequate parking is provided.

PETITIONER'S COMMENTS: Resolved opposition's problems and letter of
agreement stipulating that they will not let a client leave their
property until they are paid was submitted; and also Traffic Engineer
,.~~ agreed. Stated Condition No. 3 requiring curbs and gutters is not
acceptable, pointing out they have a waiver of that requirement on the
~,~,~ previous CUP; that Condition No. 1, requiring payment of traffic signal
assessment fee, should be deleted because it was paid; Cond. 2 requires
dedication of Water Street and Water Street has been abandoned; Cond. 4
fee for street lighting along South street ::as been paid, and he also
objected to Cond. No. 5 requiring public utilities easement along north
and east property lines, and explained power lines are existing and
they have been serviced without an easement; and that an easement would
cover 6,000 feet of his property; and that the poles are in the alley.
He stated they would put in curbs and gutters when the property is
improved with some other use; amd that curbs and sidewalks would
destroy 30 parking spaces.
STAFF COMMENTS: Engineering - Street improvements are needed now and
this is a new CUP. Current records do not reflect that portion of.
Water Street as being abandoned. Applicant to provide evidence that
fees have been paid. Overhead lines existing - no easement and
Utilities Department felt one is needed to maintain lines. Easement
area could be used for anything other than construction of a structure.
Traffic Engineer - Signal assessment fees collected with issuance of
building permits, so would not be required in this instance.
COMMISSION COMMENTS: Carusillo - sympathy for applicant, been in
business for 8 yrs., and City wants to keep encroaching onto his
property.

dedication required, plus 12 additional feet for the critical
intersection. Critical intersection dedication condition not included
in staff report.
COMMISSION DISCUSSION: Convenience markets not permitted in CR Zone;
service stations are permitted and off sale beer and wine are permitted
if within a minimum enclosed retail sales area of 1200 sq. ft.
Discussed varying ways to approve the request. Traffic Engineer
reported that purchase of entire site could become a burden of the Gity
of Anaheim i.f CALTRANS went over their budgeted amount for the prouact.
ACTION: Continued to 1-12-89 for petitioner to meet with staff and
resolve this issue.
