PROCEDURE TO EXPEDITE PLANNING COMMISSION Pi:TBLIC HEARINGS
1. The proponents in applications which are not contested will have five
minutes to present their evidence. Additional time will be granted
upon request if, in the opinion of the Commission, such additional
time will produce evidence important to the Commission's
consideration.
2. In contested applications, the proponents and opponent will each be
~'"`~ given ten minutes to present his case unless additional time is
~;.,~• requested and the complexity of the matter warrants. The
Commission's considerations are not determined by the length of time
a participant speaks, but rather by what he says.
3. Staff Reports are part of the evidence deemed received by the
Commission in each hearing. Copies are available to the public prior
to the meeting.
4. The Commission will withhold questions until the public hearing is
closed.
5. The Commission reserves the rig.~it to deviate from the foregoing if,
in its opinion, the ends of fairness to all concerned will be served.
6. All documents are presented to the Planning Commission for review in
connection with any hearing, including photographs or other
acceptable visual representations of non-documentary evidence, shall
be retained by the Commission for the public record and shall be
available for public inspections.
7. At the end of the scheduled hearings, members of the public will be
allowed to speak on items of interest which are within the
jurisdiction of the Planning Commission, and/or agenda items. Each
speaker will be allotted a maximum of five (5) minutes to speak.

PETITIONER'S COMMENTS: Request is due to widening of Ball Road by
CALTRANS, want to rebuild with food mart, with beer & wine sales, revised
plans to met minimum square footage requirements for beer & wine,
~~=°~~ currently in condemnation prceedings with CALTRANS.

STAFF COMMENTS: (Traffic Engineer) (1) Dedication requirement is the
ultimate right of way, and in no way affects negotiations between
applicant and CALTRANS; (2) Adequate space to accommodate the type of
traffic that will be frequenting site since most of the traffic is heading
to the freeway which is different than sites on arterial streets.
COMMISSION COMMENTS: (1) Questioned only one restroom proposed, lot of
tourists expected in that area; Planning Commission has been requesting
separate men and women's restrooms for about six months, and that
restrooms must be properly supplied and maintained; (2) this was service
station prior to condemnation and now wants to intensify use with
convenience store and the sale of beer and wine next to the entrance to
the freeway; parking waiver is necessary and felt since Code requires a
parking study before waiver can be granted, t:~at the study should be
submitted, even though traffic engineer had indicated the parking waiver
could be granted; (3) felt people likely to drink beer purchased at
facility after getting on the freeway; asked if Code could be changed to
allow market without beer and wine; (4) study currently being done of CR
area - will be finished in 7 or 8 months and staff indicated the portion
of study dealing only with the retail uses could possibly be done in a few
months.
ACTION: Continued to 3-27 in order for applicant to submit traffic
study.

it, no space to move it to other side of driveway; not an "affordable"
project; space between garage and neighbor's wall is usually 2" off
property line, and would be willing provide flashing over it; could
provide pipe guards or devices to prevent someone from hitting wall;
property is unique because it is sandwiched between two different zones;
carports will preclude visual intrusion.
OPPOSITION CONCERNS: High density units in single-family area; units
referred to across street are next to freeway with no single-family next
door; small units would not attract high quality tenants; were told
property had a; ready been rezoned; concerned about visual intrusion; was
shown line of sight drawing and would like to have that become part of
official exhibit; requested trash relocated away from their property line;
appearance of garage walls; wall being damaged from automobiles;
maintenance of area between their wall and garage wall; number o~
occupants; would like wall extended to the eastern boundary to prohibit
people climbing over it; currently no parking on Rio Vista and wanted to
be sure there would be no parking allowed on Rio Vista

centers not full, existing apartments in area have caused parking problem;
would put more traffic on Fairhaven where children play; primary access
proposed from alley which is problem now; decrease property value;
increase in crime; would rather see a commercial use because people leave
at night; a nice condominium complex with larger units would attract
people who could afford the payments.
PETITIONER'S COMMENTS: commercial office building could be 35 feet high
20' from the property line; project will provide parking; not proposing
access through residential area; tandem parking spaces would be assigned
to individual units; could restrict street parking; agreed never to access
Fairhaven Street; agreed to record covenant that tenants will agree not to
park on the street.
COMMISSION COMMENTS: Apartments do not bring in crime, burglaries, etc.;
that depends on particular apartment complex; agreed this property should
probably be developed with commc::cial use; that a; ea being studied b~

acres and the one just presented showed 17.2 acres and that is probably
the open space areas adjacent to to Weir Canyon Road and that should be
added back in; standards changed to require full width sidewalk from the
curb to the property line to eliminate problem with city-owned proproty on
other side of sidewalk; add condition relative to electical, "developer
shall be responsible to provide for necessary changes in the electrical
system in Tract 12992; developer responsible for 300-foot long
deceleration lane on Weir Canyon road at the entrance to 61 single-family
