PROCEDURE TO ~ti^'EDITE PLANNING COMMISSION PUBLIC HEARINGS
1. The proponents in applications which are not contested will have five
minutes to present their evidence. Additional time will be gran~.gd
upon request if, in the opinion of the Commission, such additional.
time will produce evidence important to the Commission's
consideration.
,~_' 2. In contested applications, the proponents an6 opponent will each be
given ten minutes to present his case unless additional time is
requested and the complexity of the matter warrants. The
Commission's considerations are not determined by the length of time
a participant speaks, but rather by what he says.
3. Staff Reports are part of tl~e evidence deemed received by the
Commission in each hearing. Copies are available to the public prior
to the meeting.
4. The Commission will withhold questions until the public hearing is
closed.
5. The Commission reserves the right to deviate from the foregoing if,
in its opinion, the ends of fairness to all concerned will be served.
6. All documents are presented to the Planning Commission for review in

OPPOSITION'S CONCERNS: Traffic, density, YMCA & schools in area with lot
of children, encroachment into single-family neighborhood; too much on the
land. Anaheim Plaza 1/2 mi, away and changes proposed to Manchester for
widening of freeway will impact this area.
PETITIONER'S COMMENTS: Revised plans to 13 condominiums (homeownership)
and increased size of units. Conforms with Genera Plan designation for
RM-1200; single-family homes not practical because of busy street and
adjoining land uses; buffer between single-family homes and noise from
apartments and busy street. Followed Councilguidles for homeownership.
Single family homes not feasible economically. Requested continuance to
revise plans, eliminating two units.
COMMISSION CONCERNS: Recreation area in front setback; sewer capacity,
RS 10,000 property next door:, possibly could be RS-5000 with 8 units and
no waivers; neighbors willing to accept 8 units. McBurney-felt developer
had complied with Commission's requests; 2-story single-family home could
be 5 feet from property line; Carusillo-suggested eliminating 2 units on
west and creating more setback; Herbst-height weavier should be deleted
and single-story abutting single-family homes; Bouas-do not add bedrooms
in redesign and it was suggested developer meet with neighbors.

PETITIONER'S COMMENTS: Property values keep increasing, not decreasing;
pay school fees for new schools, will delete affordable; 31 feet high to
peak of roof; agreed to build 6 or 8-foot high wall; commercial property,
but residential u.e would generate less traffic, requested continuance to
talk with neighbors and possibly eliminate one waiver.
COMMISSION COMMENTS: Carusillo-not sensitive to neighbors with 3 stories
that close; Messe-did not think continuance would be in order;
Herbst-condominiums same as apartments; doesn't change appearance,
balconies overlooking back yards; commercial use could not be developed on
this property; 1000 feet back, into project with one access; did not think
could meet 100-year flood requirements; asked if petitioner would
withdrdaw the petitions.

ACTION: Withdrawn by appliant following the public hearing. Indicated he

divided into two lots; adverse to the citizens; no breathing room on lot,
no hardship for approval; bathroom window 3 feet from sidewalk, set
precedent and have denied same requests to other developers; Redevelopment
owns two adjoining lots; not a good design and no play area for children.

PETITIONER'S COMMENTS: Formed Transportation Task Force 2 years ago to
solve problems; unloading and loading buses on city streets; propose to
build nicest terminal which would accommodate 450 guests at one time, with
facilities for the handicapped; 6 restrooms; an average of 4 or 5 buses
which arrive between 8 and 9 a.m., not all at one time; he questioned the
requirement for reconstructing whole street because buses create a big
burden on the street and referred to the large trucks and semi trailers
using the streets al.l day; (it was noted Condition No. 2 would be 'i
deleted); he referred to fire fighting equipment which they will have on
the site; and equipment used to handled emergencies, noting he is Chairman
of the Earthquake Task Force; property formerly was used as a lumber yard
with business coming and going all day and this use will only be open
until around noon; and that only the buses will be coming to the site,
since the tourists are picked up at the motels and hotels and the guests
would not be parking at this site; Condition No. 3 requires reconstruction
of driveway on Claudina Way and that driveway was previously used by large
trucks; No. 7 requires dedicating 10 feet along a 12KV overhead line for
public utility purposes and landlord would not be willing to dedicate ZO
feet; (it was noted that should be a requirement for an easement); No. 9
limits bus traffic to using driveway on Claudina and there may be
occasions when they would need to use Katella (It was noted right turns
would be permitted on Katella, but no left turns); Condition No. 11
requires payment of $8.10 sq. ft. for interim development fees and
referred to certain exemptions and one is if the use is less intense than
the existing use; that they have a lease for 9 years only; that also any
building or use permitted in the ML zone would be exempted, and bus
terminals are a permitted use in the ML Zone; No. 18 p~•ohibits mechanical
repair to vehicles on site and there are break-downs and they would want
to be able to repair the bus and occasionally would clean the buses on
site.
