DISCUSSION: POTENTIAL ORDINANCE FOR MIXED USE (RESIDENTIAL/
COMMERCIAL) DEVELOPMENT (CONTINUED FROM THE JULY 10, 1989, PLANNING
COMMISSION WORK SESSION AND FROM THE JUNE 19, 1989 PLANNING
COMMISSION MEETING).
MOTION to inform City Council that a developer has requested an
ordinance be prepared for adoption to permit mixed use of commercial
and residential on a single parcel. The developer offered to pay for
a study by a consultant, with consultant to be agreed upon by the
City.
PROCEDURE TO EXPEDITE PLANNING COMMISSION PUBLIC HEARINGS
~~'" 1. The proponents in applications which are not contested will have five
'r'?' minutes to present their evidence. Additional time will be granted upon
request if, in the opinion of the Commission, such additional time will
produce evidence important to the Commission's consideration.
2. In contested applications, the proponents and opponent will each be given
ten minutes to present his case unless additional time is requested and
the complexity of the matter warrants. The Commission's considerations
z.re not determined by the length of time a participant speaks, but rather
by what he says.
3. Staff Reports are part of the evidence deemed received by the Commission
in each hearing. Copies are available to the public prior to the meeting.
4. The Commission will withhold questions until the public hearing is closed.
5. The Commission reserves the right to deviate from the foregoing if, in
its opinion, the ends of fairness to all concerned will be served.
6. All documents are presented to the Planning Commission for review in
connection with any hearing, including photographs or other acceptable
visual representations of non-documentary evidence, shall be retained by
the Commission for the public record and shall be available for public
inspections.
7. At the end of the scheduled hearings, members of the public will be
~.,~r allowed to speak on items of interest which are within the jurisdiction
of the Planning Commission, and/or agenda items. Each speaker will be
allotted a maximum of five (5) minutes to speak.

for ultimate development will he submitted. Intend to clean property
up, and all but 1 temporary building will be removed.
COMMISSION COMMENTS: Felt traffic signal assessment fee should not be
postponed. Property could be oiled for dust control, rather than
repaved.
STAFF COMMENTS: If use changes, fees paid would be credited to new
use. Ordinance requires fees, cannot be waived. Been effective since
1978. $28 per 1000 sq. ft.
ACTION: Granted, for 3 years. Modified Cond. No. 11 to allow surface
to be oiled for dust control rather than repaving. Postponed condition
Nos. 1, 2, 7, 5, and 8 until March 1992.

ft. of fast food uses should be eliminiated and any individual requests
could be submitted in the future.
STAFF COMMENTS:
Traffic Engineer - Traffic study indicates parking adequate for
indicated uses due to different times of operation, but 2166 sq. ft. is
the limit; driveway on Euclid should have 10-foot radius returns; cars
on street would have to stop for any cars trying to exit because of
raised curb; no street parking permitted.
Zoning - Modify Condition No. 13 to read that no additional prepare:
food service facilities beyond the 2166 sq. ft. allowed by this
resolution would be permitted.
