-----------
FOLLOWING IS A SUMMARY OF THE PLANNING COMMISSION ACTION. NOT TO BE
CONSIDERED OFFICIAL MIANTES.
OPPOSITION: One interested person present.
OPPOSITION CONCERNS: 1700-foot long common border; unique canyon with
combination natural and man made percolation system; the church property
driveway becomes the only way water gets out in heavy rain; view of
massive graded slope to south; 8 to 10 houses will be looking right down
on top of church property; open air type church activities in garden
setting with many outside activities; noise from homes above would be
intrusive to outdoor setting; also, could be noise impact from church
activities on homes above; will be back in few weeks with permanent
plans for this church which will be an open air worship facility.
Drainage is concern to further studied.
~,.,~
~~ /
~~
Page No. 3 10/23/89
PETITIONER'S COMMENTS: Project consistent with Specific Plan; plans
~~ designed with geological constraints relating to drainage and street
~-' grades; first tier of lots which abut church vary from 70 feet above
existing topography to about 43 feet; increased amount of open space
between the church and subject property; natural slope must be taken out
and recompacted and put back; drainage is concern, studies have been
done to determine flows, timing and patterns which indicate that area at
100-year storm existing condition is 177 cfs and their design reduces
that to 175 cfs, and velocity will not be increased. Offered to add
condition that prior to fin31 tract approval, they will present a
drainage study for that small area to prove that they are not increasing
the flow, ~;hanging the drainage patterns or increasing the velocity,
over the existing condition. Should study show urstable condition off
their site, it would not be their responsibility. Will offer enhanced
landscaping to help the visual impact from the church property and to
provide plexiglass sound attenuation fence along first row of houses.
COMMISSION COMMENTS: Concerned about transitional area between subject
property and adjacent church property. Wanted to be able to review and
make recommendations on final grading plans.
STAFF COMMENTS: Engineering - Jurisdiction of final grading plans
approval lies with City Engineer; PC may consider scope and extent of
transitional area.
ACTION: Approved Negative Declaration
Granted Variance No. 4001 (For TT 14071)
Approved Supplement to EIR No. 281 and
Mitigating Negative Declaration
Approved TT 14071, 1409:: and 145093 & Site Plans
Subject to condition that final grading plans would be
reviewed by Planning Commission for any recommendations or
input to be given to City Engineer or City Council.

FOLLOWING IS A SUMMARY OF THE PLANNING COMMISSION ACTION. NOT TO BE

S
OPPOSITION: 5 people present; petition with 124 signatures
OPPOSITION CONCERNS: Density, traffic, parking, invasion of privacy -
Closest multiple-family development is two blocks away; buffered by La
Palma and commercial development, medical teaching facility and flood
control channel; homes have been upgraded; plans show windows facing
south; no landscaping or screening between apartments and home to the
south; parking in 20-foot setback, with 2 feet for landscaping; decrease
in property values; questioned sewer capacity. Some property owners
indicated did not receive notice of hearing. With rezoning to RM 2400,
apartments could be constructed. Suggested rezoning to RS 7200.
PETITIONER'S COMMENTS: Adjacent property to be a church use; subject
property already impacted by commercial to north and across the street
City water property; to be a buffer for church use; land too expensive
to consider apartments rather than condominiums.
COMMISSION COMMENTS: Single-family character of neighbhorhood should be
retained; asked if developer had consideration RS 5000 or RS 7200; would
be spot zoning; channel is nat~iral buffer; should be rezoned to maybe
RS5000; cumulative effect on whole area.

-------------------------------------------------------------------------
FOLLOWING IS A SUMMARY OF THE PLAN2dING COMMISSION ACTION. NOT TO BE
CONSIDERF~? OFFICIAL MINUTES.
OPPOSITION: 3 people present
OPPOSITION CONCERNS: Staff report indicates parking lot is to the west,
and their homes are next to parking lot; that the proposed reduced hours
of operation makes this better use for them than what is there now, but
are concerned the hours of operation would be changed in the future and
would. like guarantee that this would not become 24-hour car wash because
th.t would be a noise concern; car wash would be close to their bedroom
windows; asked if there would be a wall to block noise. Access to rear
parking lot which is currently used by medical students and they par;;
there during the day and are gone at night and was concerned that area
would be used for wipin4' down cars after going through ;:ar wash
PETITIONER'S COMMENTS: 3 fuel islands, will put in small car wash,
self-serve tunnel type, and 1200 sq. ft. convenience market; reduce to
one island with three pumps. Car wash tunnel is about 110 feet from
residential area; 6-foot high wall; car wash equipment is improved and.
not as noisy; convenience market open until 11 p.m., gasoline pumps 24
hours a day; tunnel is long enough for blower to be inside; no noise
impact to outside; discourage detailing area; no fast food type items
for sale.
COMMISSION COMMENTS: Questioned how customer would pay for gasoline
when market was closed; condition of CUP could guarantee hours of
operation; felt wall should be extended (wings) on each end of tunnel;
plus for neighbors that gasoline tanks are being removed.
ACTION: Granted
Subject to additional six foot high walls (wings) on each end
of building; approx. 33 feet long. Hours of operation as

PETITIONER'S COMMENTS: Expansion of existing restaurant; 9 spaces would

f4...1 spaces to increase number of spaces proposed; proposing 42 instead of
39.

COMMISSION COMMENTS: One of the busiest restaurants; concerned about
parking on the south side of the building; would rather than 39 regular
spaces and no small car spaces
STAFF COMMENTS: Traffic - Has strongly recommended no small car spaces
be allowed; ordinance proposed to be changed; asked additional
requirement be added that a concrete buffer has to be provided between
drive-through lane and parking area; not sure dimensions are correct on
plan; irrevocable offer of dQdication of 12 feet on State College should
also be added requirement; and if construction is in that right of way
