1. The proponents in applications which are not contested will nave flue
minutes to present their evidence. Additional time will ba granted
open request it, in the opinion of the Commission, such additional
time will produce evidence important to the Commission's
consideration.
7. In contested applications, the proponents and opponent will each be
given ten minutes to present his case unless additional time is
requested and the complexity of the matter warrants. The
Commission's caasiderationa are not dRtermined by the length of time
a participant speaks, but rather by what he says.
~. Sta[E Reports are pert of the evidence deemed received by the
Commission in each hearing. Copies are available to the public prior
to the meeting.
4. The Commission will withhold questions until the public hearing is
closed.
S. The Commission reserves the right to deviate from the foregoing if,
in its opinion, the ends of fairness to all concerned will be served.
6. All documents ere presented to the Planning Commission for review in
connection with any hearing, including photographs or c~.her
acceptable visual representations of non-documentary evidence, shall
be retained by the Commission for the public record and shall be
available for public inspections.
7. At the end of the scheduled hearings, menbers of the public will be
allowed to speak on items of interest which are within the
jurisdiction of the Planning Commission, and/or agenda items. Each
speaker will be allot::ed a maximum of five (5) minutes to speak.

to be consistent with the other properties. Most of the long narrow
strip is in escrow to be purchased by the City of Anaheim and the rest
will be a parking lot for tlse existiary use. It currently exists as a
parcel now because the Subdivision Map Act required it to be part of a
parcel that touched the street.
COMMISSION COMMENTS: There was concera about acting on the reclasa at
this time as tha petitioner has not submitted a proposal regarding
future commercial use.
STAFP COMMENTS: Ren Rothchild, Administrative Serivices Director, stated
that the City is in escrow to buy nls+ost all of the 5 plus acres for
relocation of the Phoenix Club and retention of some of the property for
the City. The relocation of the Phoenix Club will be dependent upon a
zone change and it is consistent rith tkse City's planned use of the
property. They will be looking at going into partnerhsip with the Fluor
property to the north for some sort of retail application. it would be
the intention for the City to put in a roadway which would allow access
to what is proposed for the parkixq facility for the proposed arena.
Joel Fick, Planning Director, stated that the staff has been analysing
this area for several months an3 there are contemplated land uses for
commercial; there has been discussion in the City Manager's office for
commercial development and to expand the auto center on one of the
adjacent lots. There has been discussion that the Phoenix Club may
possibly relocat^ in that ^~icinity. A blanket zone change on any of
these pieces could create a satellite office area that could compete
with the Anaheim Business Center.

OPPOSITION CONCERNS: Residential structure is located behind her house
with a narrow alley which separates her house from the proposed
business. She was concerned about it being converted to a flower shop
which would be open 7-days a week. Other concerns were about drainage
of water that would be used to water the flowers; additional cars;
trucks now park in the alley so she has difficulty getting to her garage.
PETITIONER'S COMMENTS: Wants to convert residential structure to
Commercial office use for artificial flower business (not fresh
flowers). This would be a business office only. It would only be open
5-days a week rather than 7-days as reported in the staff report; the
hours will be from 9AM to 5PM and he would stipulate to that.
COMMISSION COMMENTS: There are no retail services permitted in the
area. The Commission asked that the applicant stipulate that there
would be no retail sales, no delivery trucks, no warehousing on the
premises, that the office would only be open 5-days (Monday through
Friday),the hours of business would be from 9AM to 5PM and that he would
close off the driveway in the front and that access would be dedicated
to the City.
STAFF'S COMMENTS: Greg Hastings, Zoning Division Manager, stated the
Resolution of Intent on the property is Commercial Office and there are
no retail sales permitted and does not allow extensive warehousing.

OPPOSITION CONCERNS: This is a single-family neighborhood; they have a
petition signed by I2 of the neighbor; who are opposed to this. The
CC&R's were in the title search when they bought their homes and they
were asked to sign them and return them to escrow saying that Y.hey have
read them. It clearly states that a building of this nature is not
permitted. There was a lot of concern about the lack of parking.
PETITIONER'S COMMENTS: The staff report implies that the structure is
not legal. It is legal and fully permitted as a rumpus room and legal
~wza., as a fourth bedroom. The concern is about the retention of the
•,,,.~„I 27" x 54" cooking unit in the accessory structure. The house was
purchased because of their special need to take care of their severely
disabled grandchild. There were 4 neighbors that wc•e in favor of this.
COMMISSION COMMENTS: Inquiries were made to the number of cars that
were on the property and as to how many people lived on the property.
The neighbors do not object to the child being taken care of, but they
are objecting to the number of cars in frant of the house and what the
area looks like. This should not be a i~ardship on the neighborhood.
Petitioner to stipulate to a covenant that property will not be used as
a rental. Neighbors complained to Code Enforcement that multiple
families lived in the two units. There is certain language that states
the quarters are to be used for servants or for temporary guests only.
There is nothing that states it can be used for permanent residency
except for servants.

already heard. He had intended to speak against this.
Governments should be more interested in how to accommodate
housing rather than how to eliminate it.
OTHER DISCUSSION:
Should remove massage businesses out of Adult Entertainment
Business category of the Code. City Attorney's Office reviewed
this regarding discrimination. Agendize for future PC Work
Session.
Should agendize issue for care of disabled children and balloons
for future PC Work Session.
