PROCEDURE TO EXPEDITE PLANNING COMMISSION PUBLIC HEARINGS
1. The proponents in applications which are not contested will have five
minutes to present their evidence. Additional time will be granted
upon request if, in the opinion of the Commission, such additional
time will produce evidence important to the Commission's consideration.
2. In contested applications, the proponents and opponent will each be
,- given ten minutes to present his case unless additional time is
requested and the complexity of the matter warrants. The Commission's
considerations are not determined by the length of time a participant
speaks, but rather by what he says.
3. Staff Reports are part of the evidence deemed received by the
Commission in each hearing. Copies are available to the public prior
to the meeting.
4. The Commission will withhold questions until the public hearing is
closed.
5. The Commission reserves the right to deviate from the foregoing if, in
its opinion, the ends of fairness to all concerned will be served.
6. All documents are presented to the Planning Commission fur review in
connection with any hearing, including photographs or other acceptable
visual representations of non-documentary evidence, shall be retained
by 'the Commission for the public record and shall be available for
public inspections.
~' 7. At the end of the scheduled hearings, members of the public will be
allowed to speak on items of interest which arc within the
jurisdiction of the Planning Commission, and/or agenda items. Each
speaker will be allotted a maximum of five (5) minutes to speak.

OPPOSITION CONCERNS: Current unkept condition of property; condo owners
next door concerned about security of underground parking area; doors
are left open 3 days a week for trash pick up and gardeners; noise is
also concern with people at motel coming in and going out all night.
Felt it is possible this motel would become a sleazy operation and bring
transients to this area; small units proposed; property values
decreased, increased traffic, increased parking and density. Did not
feel motel is appropriate use with residential on two sides.
PETITIONER'S COMMENTS; Currently developed with office building which
is not successful, more traffic with offices than a motel, on-site
manager would provide more security and protection for children walking
in the area; 50 feet away from residential and would be happy to provide
some trees; no kitchens proposed; proposed to be a major motel chain,
such as Comfort Inn; daily rates; have contacted CALTRANS and they are
not interested in acquiring property at this time.
COMMISSION COMMENTS: Hellyer & Herbst did not Eeel motel is the proper
use for this property,
STAFF COMMENTS: Traffic Engineer - State would have to purchase this
property fro freeway widening.

streets, and distinct design standards which could be more stringent.
PETITIONER'S COMMENTS: Submitted First plans in September 1988, and
were not aware of 12-f t. dedication for critical intersection;
redesigned and submitted second plan in March 1989, and requested two
waivers which wexe approved by the PC and then denied by CC. Redesigned
parking structure and access; canopy comes out 13 feet into the
landscaped area, no compact car parking spaces; will have sign for
registration, directing traffic into garage area where they car_ park and
go register; could use bus loading area for city bus lane, additional
bus lane too the deceleration lane; added windows in the front units.
Access same as recently approved for another motel in the area.
COMMISSION COh~4ENTS: Feldhaus: City Council was concerned about site
coverage and denaity; did not think trees as shown on rendering could be
planted (Pet. responded some of the trees shown are actually on adjacent
"~ property); Herbst: questioned how trash truck could get in an out
(petitioner responded they could use roll ,sway containers).

neighborhood; those property owners with agricultural uses (RSA-43,000
zoning) wanted to retain homes but when passed on to heirs or develop,
wanted flexibility; questions what changes would affect their
agricultural uses;
COMMISSION COMMENTS: Explain desire to dow-.~zone a lot of area because
of traffic, impact on in~rastructure, sewers, etc. affecting health,
safety and welfare of citizens.
STAFF COMMENTS; Recommended low-medium density residential because
property abuts arterial highway an properties to the west are developed
with apartments and designated medium density. Due to size of existing
properties, and location adjacent arterial, could be redeveloped in the
1onr. range as multiple-family units.
