PROCEDURE TO EXPEDITE PLANNING COMMISSION PUBLIC HEARINGS
1. The proponents in applications which are not contested will have five
minutes to present their evidence. Additional time will be granted upon
request if, in the opinion of the Commission, such additional time will

(' produce evidence important to the Commission's consideration.

2. In contested applications, the proponents and opponent will each be given
ten minutes to present his case unless additional time is requested and
the complexity of the matter warrants. The Commission's considerations
are not determined by the length of time a participant speaks, but rather
by what he says.
3. Staff Reports are part of the evidence c^emed received by the Commission
in each hearing. Copies are available to the public prior to the meeting.
4. The Commission will withhold questions until the public hearing is closed.
5. The Commission reserves the right to deviate from the foregoing if, in
its opinion, the ends of fairness to all concerned will be served.
fi. All documents are presented to the Planning Commission for review in
connection with any hearing, including photographs or other acceptable
visual representations of non-documentary evidence, shall be retained by
the Commission for the public record and shall be availabl~a for public
inspections.
7. At the end of the scheduled hearings, members of the public will be
allowed to speak on items of interest which are within the jurisdiction
of the Planning Commission, and/or agenda items. Each speaker will be
allotted a maximum of five (5) minutes to speak.

is not done for pleasure purposes. Individuals cannot come in off of
the streets. Land lord from Ralph's Grocery store will be present at
meeting with City Traffic Engineer to help mitigate traffic issues.
COMMISSION COMMENTS: Concern about vehicular access on State College;
lots of accidents occur in that area; land lord always says he is going
to take care of the traffic problem and he never does; can make this a
condition of the CUP; does not seem to be a parking problem in the
center.
STAFF COMMENTS: Alfred Yalda, Traffic Engineering, indicated the issue
of the median island will be discussed at the meeting with the City
Traffic Engineer.
ACTION: Continued to 5/21/90. Applicant to clarify the median island
and solve problem re access on State College Blvd.

to an office facility for an advertising agency. The architecture of
the home is very unique; took plans to the neighbors and just received
the letter with their objections today; will be open only during
i,usiness hours; this project should not affect the neighbor's property.
COMMISSION COMMENTS: Could have a 6-foot wall with decorative on the
top; too much building on this piece of property; some of the things the
City is asking for is creating a problem; should get rid of the trash
enclosure and have 2 residential trash cans; would like to see more
landscaping; would rather see parking waiver rather than a landscape
waiver; should be readvertised.
STAFF COMMENTS: Parking study will be required by Traffic Engineer.

and "C"; they have a dynamic anchor tenant that will make or break the
center; want 2 signs, one on the end of each buildings.
COMMISSION COMMENTS: Cannot see too much business coming from the
freeway; should not try to advertise from the freeway; waiver "C" in the
staff report is not stated properly, it should read 1 to 2 signs per
unit proposed as opposed to 1 to 3 signs; there was some language on the
sign that were not authorized.

PETITIONER'S COMMENTS: Project varies from 2-stories to various 3-story
buildings within the project; they do not consider the subterranean
x') parking a story; major entrance to the site is off of Magnolia; this
~u=~ will be a secured project, i.e., gated and controlled. There are 334
units made up of 1 and 2-bedrooms. They have mitigated site
intrusions. They held 3 property owner/tenant meetings to discuss the
project and there was very little attendance from the adjacent property
owners; they have approximately 130,800 square feet of rep .ational area
and only 66,000 is required; they have a recreational room and a pool.
They have 3 open space areas which amount to twiC° the area the current
tenants have.
OPPOSITION CONCERNS: Density is too great; concern that apartment
buildings will continue to be added to an already dense area; item no. 2
that is being heard today should be passed; additional apartments add
additional problems to the community such as a need to increase police
and fire services; traffic on Magnolia is currently a problem and
traffic could be increased as much as 25~; traffic study did not include
the impact on the freeway on-ramps and off-ramps; the existing apartment
complex is a family oriented project and the new project appears to be
adult oriented; there are many financial concerns such as paying higher
rents and the possibility of relocating.

COMMISSION CONCERNS: Concern about height of buildings closest to
single-family residences; the main access to the proposed project,
located behind the single-family residences, creates a traffic pattern
;~ that will cause amain thoroughfare behind the resident's homes; the
traffic in the complex would cause an impact to the neighbors in terms
of noise, fumes, etc. and there will be an impact on Magnolia. Concern
as to what the accumulated effect would have on the streets of the City
of Anaheim, schools and the health, safety and welfare of the citizens.
There is just too much density.

Utilities Undergrounding - Report from subcommittee members.
The following motion was made to the Public Utilities Board.
Commissioner Messe offered a motion, seconded by Commissioner
Hellyer and MOTION CARRIED that the Planning Commission go on
~~ record with the Public Utilities Board to unanimously support
the recommendation of the Undergrounding Subcommittee and urge
the expeditious implementation of the Subcommittee's primary
recommendation to underground all overhead facilities in the
City of Anaheim (69KV and less) and finance the costs of the
program with a combination of a rate increase that would cap
out at 4~ in five years and utilization of funds received by
the Public Utilities Department from the antitrust action
against Southern California Edison. In making this
recommendation, the Planning Commission understands that this
is a long term project that will, of necessity, start slowly
and proceed at a rate that will not cause undue hardships on
circulation in the City of Anaheim.
